UPS drivers do not get a full “no tax on overtime” break, but they can claim a new federal income tax deduction on part of their overtime pay for tax years 2025 through 2028. The One Big Beautiful Bill Act, signed on July 4, 2025, created a deduction under 26 U.S.C. ยง 225 for qualified overtime compensation earned by hourly workers covered by the Fair Labor Standards Act. Most UPS package car drivers, feeder drivers, and warehouse workers are hourly and nonexempt, so they qualify. The deduction is capped at $12,500 for single filers and $25,000 for joint filers, and it applies only to the premium portion of overtime pay, not the whole overtime line on your check.
Only the Premium Half Is Deductible
This is where most drivers misread the benefit. When you work more than 40 hours in a week and earn time-and-a-half, only the extra half counts as “qualified overtime compensation.” The base rate you would have earned anyway is still taxed normally.1Internal Revenue Service. Questions and Answers About the New Deduction for Qualified Overtime Compensation
Say your regular hourly rate is $40 and your overtime rate is $60. Only $20 per overtime hour is deductible. On a 50-hour week, that means $200 of your $600 overtime line qualifies for the deduction. The other $400 stays fully taxable. Your pay stub shows one lump overtime figure, which is why the distinction catches people off guard.
Which UPS Drivers Qualify
The test is whether the FLSA requires your employer to pay you overtime. If you are a nonexempt hourly employee entitled to at least time-and-a-half for hours beyond 40 in a workweek, your overtime premium qualifies.2Office of the Law Revision Counsel. 26 USC 225 Qualified Overtime Compensation Most UPS drivers are covered by the Teamsters collective bargaining agreement, which builds on FLSA overtime rules, and their pay stubs show a separate overtime rate. That structure puts them in the eligible category.
Drivers who have moved into salaried management lose eligibility because they are typically classified as exempt from FLSA overtime, and voluntary extra pay from an employer does not count. You also need a valid Social Security number on the return when you claim the deduction.2Office of the Law Revision Counsel. 26 USC 225 Qualified Overtime Compensation
The Annual Cap and Income Phase-Out
The deduction tops out at $12,500 per year for single filers and $25,000 for married couples filing jointly.3Internal Revenue Service. One Big Beautiful Bill Act Tax Deductions for Working Americans and Seniors At a $40 base rate, hitting the $12,500 single cap takes about 625 overtime hours in a year, roughly 12 extra hours a week. Peak-season drivers can blow past that, so the cap is a real limit for heavy overtime earners.
A phase-out kicks in at higher incomes. For single filers it starts at $150,000 of modified adjusted gross income and phases out completely at $275,000. For joint filers it runs from $300,000 to $550,000, shrinking the deduction by $100 for every $1,000 above the threshold.2Office of the Law Revision Counsel. 26 USC 225 Qualified Overtime Compensation Most UPS drivers earn under $150,000, so this rarely bites, but a driver with a high-earning spouse should check combined AGI before assuming the full benefit.
You Claim It on Your Tax Return, Not Your Paycheck
Your employer still withholds federal income tax on every overtime dollar at the normal rate. The deduction shows up when you file your annual return, so you receive the benefit as a smaller tax bill or a larger refund, not as bigger weekly paychecks.1Internal Revenue Service. Questions and Answers About the New Deduction for Qualified Overtime Compensation
Employers are required to report qualified overtime compensation on your W-2 or other wage statement.3Internal Revenue Service. What the Deduction Does Not Cover
The deduction reduces federal taxable income. It does not wipe out taxes on overtime.
Social Security tax still applies at 6.2% on wages up to $184,500 in 2026, and Medicare tax applies at 1.45% with no cap.4Internal Revenue Service. Topic No 751 Social Security and Medicare Withholding Rates5Social Security Administration. Contribution and Benefit Base FICA is calculated on gross wages, and the overtime deduction does not touch it. On a $20 deductible overtime premium, FICA still takes about $1.53.
Federal income tax also still applies to the base-rate portion of overtime hours and to any premium above the $12,500 cap. The 2026 brackets run from 10% to 37%.6Internal Revenue Service. Federal Income Tax Rates and Brackets A driver in the 22% bracket who deducts the full $12,500 saves roughly $2,750 in federal income tax for the year.
State Tax Treatment Varies
Whether your state also lets you deduct overtime depends on how it conforms to the federal tax code. States that automatically adopt the federal definition of taxable income will generally allow the deduction. States that set their own rules may decouple, meaning they tax the overtime premium even though the federal government does not.
New York, California, and Illinois have announced they will not follow the federal overtime deduction and will require taxpayers to add the amount back on the state return. Other states had not decided as of late 2025 and planned to address conformity in 2026 sessions. Check your state tax agency’s guidance before assuming the deduction applies at both levels.
Married Drivers Must File Jointly
If you are married, you can only claim the deduction on a joint return. Married filing separately disqualifies you entirely, no matter how much overtime you worked.2Office of the Law Revision Counsel. 26 USC 225 Qualified Overtime Compensation This matters mostly if you and your spouse have been filing separately to manage income-driven student loan payments or similar obligations. Weigh the overtime deduction against whatever those separate filings were saving you.
The Break Expires After 2028
The overtime deduction is temporary. No deduction is allowed for any tax year beginning after December 31, 2028, unless Congress extends it.2Office of the Law Revision Counsel. 26 USC 225 Qualified Overtime Compensation UPS drivers have a four-year window to benefit. Plan around it as a near-term tax break, not a permanent feature of the code.
