No. Standard plastic rebar caps — the small orange or yellow “mushroom” caps sold at most hardware stores — do not comply with OSHA when used as impalement protection. They were built to prevent scratches and scrapes on workers brushing against exposed steel, not to stop a falling body. To satisfy 29 CFR 1926.701(b), a cap or other guarding device must withstand at least 250 pounds dropped from a height of 10 feet without the rebar penetrating through it.1Occupational Safety and Health Administration. What the Rule Requires

If a worker could fall onto it and be pierced, it has to be guarded.
There is no minimum height and no minimum fall distance. Why the Common Plastic Caps Fail
When the small mushroom caps are tested against forces simulating a falling worker, they shatter or the rebar drives straight through them. They are larger, and they typically incorporate an internal steel plate or a reinforced polymer body designed to spread and absorb the impact load. Impalement-rated caps generally run between $1 and $14 per unit depending on size and design, so the cost gap versus non-compliant caps is small enough that price is rarely a defensible reason to use the wrong product.
How to Tell If a Cap Actually Complies
Manufacturers that make impalement-rated caps say so on the packaging and in their product literature, and they reference the 250-pound drop test. A few things to check before installing:
- The product is explicitly marketed as impalement protection, not scratch protection or “rebar safety caps” without further qualification.
- The manufacturer states the cap meets or exceeds the 250-pound drop-from-10-feet performance criterion.
- The cap has a rigid internal reinforcement (usually a steel plate) or is thick reinforced polymer, not thin injection-molded plastic.
- The cap fits the rebar size it’s rated for. A cap that wobbles or sits loosely can be knocked off before it’s ever tested by a fall.
If none of that information appears on the product, treat the cap as non-compliant. OSHA inspectors do.
Other Ways to Comply
Rated caps are the most common solution, but they are not the only one. OSHA accepts any method that genuinely eliminates the impalement hazard.
Bending the rebar is the most durable approach. Vertical bars bent at 90 degrees or more, with the ends pointing down, no longer present an end that can catch a falling body. OSHA confirmed in a 2006 letter that rebar bent into “ears” with the ends pointing down does not require additional guarding.1Occupational Safety and Health Administration. Wooden troughs and structural covers work too, provided the assembly can pass the same 250-pound drop test.4Occupational Safety and Health Administration. Protection of Impalement Hazards: Rebar and Other Hazards Commercial braces are sold that hold a 2×4 or 2×6 directly over exposed ends. The trough has to be secured well enough that it will not shift or collapse on impact.
Whichever method you use, it needs regular inspection. Caps crack, get knocked off during pours, and disappear as trades move through. Wooden troughs shift. New rebar goes in without protection. Penalties for Using the Wrong Caps
Failing to guard protruding rebar is almost always cited as a serious violation, because impalement is by definition likely to cause death or serious physical harm. The maximum penalty for a serious violation is $16,550, and willful or repeat violations reach $165,514 per violation.6U.S. Department of Labor. On a site with hundreds of unguarded dowels, OSHA has discretion to treat instances or groupings as separate violations, which can multiply the total quickly. A serious citation also triggers an abatement deadline, and missing it exposes the employer to additional penalties of up to $16,550 per day past the deadline. For something as easy to correct as swapping caps, there is little room to negotiate extra time.
Employees also have to be trained to recognize the hazard. Under 29 CFR 1926.21(b)(2), each worker must be instructed in recognizing and avoiding unsafe conditions in their work environment.7eCFR. 29 CFR 1926.21 – Safety Training and Education For anyone working near rebar, that includes knowing what a rated cap looks like, understanding that the standard scratch caps do not qualify, and reporting missing or broken guarding rather than working around it.
Capping Rebar Is Not Fall Protection
One boundary worth naming: rated caps do not substitute for fall protection. OSHA has stated that 1926.701(b) addresses the impalement hazard, while Subpart M (1926.501 and related standards) addresses the hazard of falling to a lower level, and complying with one does not eliminate the need for the other.8Occupational Safety and Health Administration. The short version: if the caps on your site are the small orange scratch caps, replace them. They do not comply, they will not stop an impalement, and swapping them for rated protection is one of the cheapest fixes on a jobsite.
