Yes. An LLC taxed as a partnership does get a 1099 when you pay it $2,000 or more for services during the 2026 tax year. The label “LLC” is not what decides the question; the LLC’s federal tax classification is. A multi-member LLC is a partnership for tax purposes by default, and partnerships are not corporations, so the corporate exemption doesn’t apply. You issue Form 1099-NEC.
Why Partnership Classification Triggers a 1099
The IRS has no “LLC” tax box. Every LLC falls into one of four federal classifications: disregarded entity, partnership, C-Corporation, or S-Corporation. A multi-member LLC is treated as a partnership by default unless it files Form 8832 to elect corporate treatment.1Internal Revenue Service. LLC Filing as a Corporation or Partnership A partnership is a pass-through entity: the income flows through to the partners’ individual returns. Because a partnership is not a corporation, it stays inside the 1099 reporting net, and payers must issue Form 1099-NEC for qualifying service payments.2Internal Revenue Service. Instructions for Forms 1099-MISC and 1099-NEC (Rev. April 2025)
If the same LLC had elected C-Corp or S-Corp treatment, the corporate exemption would apply and no 1099 would be required for service payments. One exception overrides that: attorney fees. Payments for legal services get reported on Form 1099-NEC regardless of whether the law firm is a corporation, an LLC, or a solo practitioner.3Internal Revenue Service. Single-member LLCs sit on the other end. By default a single-member LLC is a disregarded entity, meaning the IRS treats it as if it doesn’t exist separately from its owner.4Internal Revenue Service. Limited Liability Company (LLC) For 1099 purposes, paying a single-member LLC is the same as paying an individual sole proprietor. You issue the 1099-NEC using the owner’s name and Social Security number or EIN, not the LLC’s EIN.5Internal Revenue Service. Single Member Limited Liability Companies
How to Confirm the LLC Is Taxed as a Partnership
The Form W-9 is where you find the answer. Collect a completed W-9 from every vendor before the first payment goes out; hunting them down in January is a preventable form of stress.
Box 3 on the W-9 lists the vendor’s federal tax classification. An LLC taxed as a partnership will either check the “Partnership” box, or check the “Limited liability company” box and write “P” beside it. Either way, that vendor gets a 1099-NEC if your service payments hit $2,000. If the LLC checks “C Corporation” or “S Corporation,” you’re off the hook (except for legal fees).6Internal Revenue Service. Form W-9 Instructions
A signed W-9 also gives you a defensible record if the IRS later questions your reporting decision. If a vendor refuses to provide one or leaves the TIN blank, you have a different problem: backup withholding at 24% applies to any reportable payment when the payee has not furnished a TIN.7Internal Revenue Service. Instructions for the Requester of Form W-9 (Rev. March 2024)
TIN Matching Before You File
Even a completed W-9 can carry a wrong name-and-TIN combination. Filing a 1099 with a mismatched TIN produces a CP2100 or CP2100A notice and possible penalties. The IRS offers a free TIN Matching service that verifies name-and-TIN pairs before you file.8Internal Revenue Service. Taxpayer Identification Number (TIN) Matching Registration on the IRS Payer Account File is required, but the upfront work saves correction cycles later. For a partnership-LLC, note that any backup withholding can only be recovered by the individual partners on their own returns, not by the LLC itself.9Internal Revenue Service. The $2,000 Threshold for 2026
For payments made during the 2026 tax year, the reporting threshold for Form 1099-NEC and most Form 1099-MISC categories is $2,000, up from the longstanding $600.10Internal Revenue Service. Form 1099-NEC and Independent Contractors The change came from the One Big Beautiful Bill Act, signed into law on August 5, 2025, and it applies to payments made after December 31, 2025. Starting in 2027, the $2,000 figure adjusts annually for inflation.
The higher threshold changes the dollar trigger, not the rule about who qualifies. Pay a partnership-LLC $1,500 for consulting work in 2026 and no 1099-NEC is required. At $2,000, the obligation kicks in. The separate $10 threshold for royalties and broker payments on Form 1099-MISC is unchanged.
Which Payments Count
Not every dollar you send a partnership-LLC counts toward the $2,000 threshold. The type of payment matters as much as the recipient.
Payments reported on Form 1099-NEC include nonemployee compensation for services and attorney fees. Payments reported on Form 1099-MISC include rent, royalties, medical and healthcare payments, prizes and awards, and gross proceeds paid to an attorney in settlement.3Internal Revenue Service. Am I Required to File a Form 1099 or Other Information Return
Payments that don’t require a 1099, even to a partnership-LLC:
- Merchandise, inventory, supplies, and other goods, regardless of amount.
- Utilities, phone service, freight, and similar operating expenses.
- Payments to tax-exempt organizations, government agencies, and certain tax-exempt trusts.
- Payments made through a credit card processor or a payment app like PayPal or Venmo. The payment network reports those on Form 1099-K, and you do not issue a duplicate 1099-NEC or 1099-MISC.2Internal Revenue Service. Instructions for Forms 1099-MISC and 1099-NEC (Rev. April 2025)11Internal Revenue Service. Form 1099-K FAQs – Third Party Filers of Form 1099-K
The third-party payment rule catches people out. If every invoice from a partnership-LLC vendor moved through a payment app or credit card, you have no 1099-NEC obligation for that vendor even if the total blows past $2,000.
Deadlines for 2026 Payments
For payments made during the 2026 calendar year:
- Form 1099-NEC is due to both the IRS and the recipient by January 31, 2027, whether you file on paper or electronically.
- Form 1099-MISC is due to the recipient by January 31, 2027. IRS filing is due February 28, 2027 on paper, or March 31, 2027 electronically.12Internal Revenue Service. Publication 1099 General Instructions for Certain Information Returns (For Use in Preparing 2026 Returns)
If a deadline lands on a weekend or legal holiday, the next business day is timely. If your business files 10 or more information returns of any type during the year, electronic filing is mandatory. That threshold is aggregate across return types, so five 1099-NECs plus three 1099-MISCs plus two W-2Gs puts you at 10 and triggers the mandate.13Internal Revenue Service. Penalties for Missing or Wrong 1099s
The IRS assesses penalties per return, so a missed batch compounds fast. For information returns due in 2026:
- Up to 30 days late: $60 per return.
- 31 days late through August 1: $130 per return.
- After August 1 or never filed: $340 per return.
- Intentional disregard: $680 per return, with no maximum cap.14Internal Revenue Service. Information Return Penalties
The same schedule applies to furnishing incorrect payee statements. A wrong TIN, wrong amount, or wrong name counts as an incorrect return.
