Do IRS Audit Letters Come via Certified Mail?

Most IRS audit letters do not come by certified mail. Initial audit notices, document requests, and underreporter proposals almost always arrive as regular first-class mail in an IRS envelope. The agency reserves certified or registered mail for a small set of notices where federal law requires proof of mailing, and the most important of those is the Notice of Deficiency, which starts a 90-day clock for challenging a proposed tax increase in U.S. Tax Court. If a letter from the IRS arrives certified, the deadlines are shorter and the consequences of ignoring it are worse than with an ordinary notice.

Certified mail comes in when the law requires the IRS to prove it sent a notice. The certified receipt documents the mailing date, and that date starts a legal deadline. Once the deadline runs, the IRS can assess the tax and move to collect if you haven’t responded.

Which Audit-Related Notices Come by Certified Mail

Two notices tied to the audit and collection process are sent by certified or registered mail. Both cut off legal rights if you miss the deadline.

Notice of Deficiency (the 90-Day Letter)

The Notice of Deficiency is the certified-mail notice that matters most. It is often labeled CP3219N for correspondence audits or Letter 531 after an in-person audit. It tells you the IRS has determined you owe more tax and gives you 90 days from the mailing date to file a petition with the U.S. Tax Court. If you’re outside the United States, the window is 150 days.3Office of the Law Revision Counsel. 26 USC 6213 Restrictions Applicable to Deficiencies; Petition to Tax Court Saturdays, Sundays, and legal holidays in the District of Columbia don’t count when they land on the final day. Federal law authorizes the IRS to send this notice by certified or registered mail to your last known address, and that is why the delivery method is what it is.4Office of the Law Revision Counsel. 26 USC 6212 Notice of Deficiency

Collection Due Process Notice Before a Levy

Before the IRS can levy wages, bank accounts, or other property, it must give you written notice of your right to a hearing. Federal law says this Collection Due Process (CDP) notice has to be delivered in person, left at your home or workplace, or sent by certified or registered mail at least 30 days before the levy.5Office of the Law Revision Counsel. 26 USC 6330 Notice and Opportunity for Hearing Before Levy The notice explains what you owe, your right to request a hearing, and the alternatives that could stop the levy, including an installment agreement. Request the CDP hearing within 30 days and the IRS generally cannot levy until the hearing process is done.

Audit Notices That Arrive by Regular Mail

Several notices connected to audits and unpaid balances arrive through standard first-class delivery, even though the consequences can be serious.

These letters arrive by regular mail, but ignoring them is what pushes a case to the certified-mail stage. If you don’t respond to a CP2000 or a 30-day letter, the IRS will eventually issue a Notice of Deficiency by certified mail, and your options narrow sharply once it lands.

What a Certified Letter Means for Your Deadlines

Missing the 90-day window on a Notice of Deficiency is one of the more costly mistakes a taxpayer can make. Let it pass and the IRS will formally assess the tax and start collection. After that, you lose the right to challenge the amount in Tax Court without paying the full balance first.3Office of the Law Revision Counsel. 26 USC 6213 Restrictions Applicable to Deficiencies; Petition to Tax Court

What remains after the deadline is slower and more expensive. You can pay the assessed amount, file a refund claim, and if the IRS denies it or doesn’t respond within six months, file a refund suit in a U.S. District Court or the Court of Federal Claims.10Internal Revenue Service. You can also ask the IRS for audit reconsideration, but it isn’t required to grant one.

Meanwhile the balance grows. The IRS charges 7% annual interest on underpayments, compounded daily.11Internal Revenue Service. Interest Rates Remain the Same for the First Quarter of 2026 A failure-to-pay penalty starts at 0.5% of the unpaid tax per month, capped at 25% total, and doubles to 1% per month after the IRS issues a final notice of intent to levy.12Internal Revenue Service. How to Respond, Certified or Not

Whichever way the letter came, responding on time is the most important step. A few habits protect you.

  • Read the deadline on the letter itself. A 30-day letter gives you 30 days to agree or request an appeals conference. A Notice of Deficiency gives you 90 days (150 if you’re outside the U.S.) to petition Tax Court. These are strict.
  • Use the specific address printed on the notice, not the general IRS filing address. Include any response stub so your reply is routed to the right team.
  • Send your response by certified mail with return receipt, or through a private delivery service the IRS recognizes. That gives you proof of the mailing date if the IRS later says it didn’t receive anything.
  • For some notices, the IRS now includes an access code letting you upload documents through the IRS Document Upload Tool. Even without a code, you can use the tool by entering the notice or letter number.13Internal Revenue Service. IRS Document Upload Tool

Keep copies of everything: your response, your supporting documents, and the certified receipt or upload confirmation.

If you need more time to gather records for a mail audit, the IRS can generally grant a one-time automatic 30-day extension. Fax the request to the number on the letter, or mail it to the address on the letter if you can’t fax.14Internal Revenue Service. The 90-day deadline on a Notice of Deficiency is different. It cannot be extended. You can keep working with the IRS on the underlying tax issue, but the clock for a Tax Court petition runs no matter what.14Internal Revenue Service. IRS Audits

Verifying the Letter Is Real

Before you share information or send money, check the letter. Legitimate IRS correspondence carries a notice number (starting with “CP”) or letter number (starting with “LTR”) in the upper right of the first page, and you can look that number up on the IRS website to confirm what it means.15Internal Revenue Service.
