No, you do not need to attach Form 1099-NEC to your federal tax return. The business that paid you already filed a copy with the IRS, so sending yours in would only duplicate what the agency has. You report the income on the appropriate schedule of your Form 1040 and keep the 1099-NEC in your own files.
Why the IRS Doesn’t Want It
When a business pays you $600 or more as a non-employee, it files Copy A of the 1099-NEC with the IRS and sends you Copy B. By the time you sit down to file, the agency already has the numbers. The 2025 Form 1040 instructions confirm this: the only information returns you attach are Forms W-2G and 1099-R, and only when federal tax was withheld. Form 1099-NEC is not on that list.1Internal Revenue Service. 2025 Instructions for Form 1040
If you e-file, there is nothing to physically attach anyway. If you file on paper, leave the 1099-NEC out of the envelope.
One exception worth flagging: your state return. Copy 2 of the 1099-NEC exists specifically for filing with state tax departments, and some states do require you to include it.2Internal Revenue Service. Instructions for Forms 1099-MISC and 1099-NEC Check your state’s filing instructions before you throw that copy away.
Where the Income Actually Goes on Your Return
Not attaching the form is not the same as not reporting the income. Every dollar shown on a 1099-NEC has to appear on your return, and so does any self-employment income you earned without receiving a form. The IRS treats all income as taxable unless a specific exemption applies.3Internal Revenue Service. Taxable Income
For most people, that means Schedule C (Profit or Loss From Business). You enter your total nonemployee compensation as gross receipts on Line 1.4Internal Revenue Service. About Form 1099-NEC, Nonemployee Compensation If several clients sent you 1099-NECs, combine them all into that single line along with any additional business income that wasn’t reported to you on a form.
From gross receipts you subtract ordinary and necessary business expenses. An ordinary expense is one that’s common in your line of work; a necessary expense is one that’s helpful and appropriate for your business.5Office of the Law Revision Counsel. 26 U.S. Code 162 – Trade or Business Expenses Supplies, software subscriptions, mileage, home office costs, and professional development are common examples. Your net profit then flows to Schedule 1 (Additional Income and Adjustments), Line 3, and from there onto your Form 1040.6Internal Revenue Service. 2025 Schedule C (Form 1040)
Schedule C is not always the right form. If the payment is rental income from property where you didn’t provide substantial services to tenants, or royalties from patents, copyrights, or natural resources, it goes on Schedule E instead.7Internal Revenue Service. About Schedule E (Form 1040) The nature of the income controls, not the fact that it landed on a 1099-NEC.
Self-Employment Tax Comes With It
Something that catches many first-time freelancers off guard: 1099-NEC income triggers self-employment tax on top of regular income tax. A W-2 employer splits Social Security and Medicare taxes with you. As an independent contractor, you pay both halves.8Internal Revenue Service. Independent Contractor Defined
The self-employment tax rate is 15.3%: 12.4% for Social Security and 2.9% for Medicare. For 2026, the Social Security portion applies only to the first $184,500 of net earnings.9Social Security Administration. Contribution and Benefit Base The Medicare portion has no cap. You calculate the tax on Schedule SE, and you can deduct half of it as an adjustment to income on Schedule 1, which reduces your income tax bill.
If the Form Never Arrived or the Amount Is Wrong
Payers were required to send 1099-NECs by January 31. If yours hasn’t shown up by mid-February, contact the payer and ask for it.10Internal Revenue Service. What to Do When a W-2 or Form 1099 Is Missing or Incorrect
If it never comes, report the income anyway using your own records: bank statements, invoices, payment app history, and contracts. There is no substitute form for a missing 1099-NEC the way Form 4852 substitutes for a missing W-2 or 1099-R.11Internal Revenue Service. About Form 4852 Your own records are enough.
If the amount on the form is wrong, ask the payer to issue a corrected 1099-NEC. That is the fix the IRS prefers.2Internal Revenue Service. Instructions for Forms 1099-MISC and 1099-NEC If the payer refuses, report the amount you actually received rather than the inflated figure. Because the IRS will see a mismatch with the 1099-NEC on file, you can attach Form 8275 (Disclosure Statement) to explain the discrepancy. It doesn’t guarantee the IRS will side with you, but it can help avoid accuracy-related penalties.12Internal Revenue Service. Challenging Information Returns
How Long to Keep the 1099-NEC
Hold onto your 1099-NEC forms along with receipts, invoices, and bank statements supporting the income and deductions on your return. The IRS’s general assessment window is three years from the date you filed. If you underreported income by more than 25% of gross income, the window extends to six years, and if you didn’t file a return at all, there is no time limit.13Internal Revenue Service. Topic No. 305, Recordkeeping Six years is a reasonable default that covers the worst case short of fraud.
