Do I Need an EIN to Sell on Etsy: SSN vs. EIN and When to Upgrade

No, most Etsy sellers do not need an EIN to sell on Etsy. If you run your shop as a sole proprietor or a single-member LLC with no employees, your Social Security Number satisfies both Etsy and the IRS. An Employer Identification Number becomes mandatory only when your business structure or activities trigger one of a short list of federal rules, though plenty of sellers who aren’t required to get one still choose to.

When Your SSN Is Enough

Etsy accepts a Social Security Number, an EIN, or an Individual Taxpayer Identification Number from U.S. sellers.1Etsy. How to Update Your Legal Name and Taxpayer Information If you sell under your own name without employees, your SSN is all you need.

The IRS treats a single-member LLC with no employees and no excise-tax liability as a “disregarded entity,” meaning it does not need its own EIN for income-tax purposes. You report shop income on your personal return using your SSN, with earnings and expenses going onto Schedule C.2Internal Revenue Service. Single Member Limited Liability Companies

That changes the moment a single-member LLC hires an employee, takes on an excise-tax obligation, or files any of the excise-tax forms the IRS lists (Forms 720, 730, 2290, or 11-C). At that point an EIN is required.2Internal Revenue Service. Single Member Limited Liability Companies

When an EIN Is Required

Federal regulations require an EIN for any entity that is not an individual, including corporations, partnerships, multi-member LLCs, nonprofits, trusts, and estates. Individuals must also use an EIN when they hire employees or when the returns they file direct them to.3eCFR. 26 CFR 301.6109-1 – Identifying Numbers For Etsy sellers, the common triggers are:

  • You hire employees. Anyone who pays wages, even a part-time assistant helping with production or shipping, needs an EIN for payroll-tax reporting.
  • Your shop is a partnership or corporation. These entities are legally separate from their owners and always need their own EIN.
  • You operate a multi-member LLC. The IRS treats these as partnerships by default, so they need an EIN whether or not they have employees.
  • You set up a Keogh retirement plan. Administering certain retirement plans requires an EIN.4Internal Revenue Service. Get an Employer Identification Number
  • You have excise-tax obligations tied to your products.
  • You run the shop through a trust or estate. If a deceased seller’s shop continues under an estate or trust, the fiduciary must obtain a new EIN for that entity.5Internal Revenue Service. Instructions for Form SS-4

Reasons to Get an EIN Even When You Don’t Have To

A few practical reasons push many optional sellers toward an EIN anyway.

Keeping Your SSN Off Business Paperwork

Every time you share your SSN with a platform, payment processor, or vendor, you expand the surface area for identity theft. An EIN lets you keep your SSN off most business-related forms. Etsy will still hold a valid identifier for you either way, but an EIN means fewer documents overall carry your personal number.

Opening a Business Bank Account

Most banks want an EIN before they will open a dedicated business checking or savings account. The U.S. Small Business Administration lists the EIN as a standard document banks ask for.6U.S. Small Business Administration. Open a Business Bank Account Separating shop revenue from personal funds simplifies bookkeeping and gives you a clean paper trail if you are ever audited.

Building Business Credit

Business credit agencies track a company’s credit profile using its EIN. Over time, that history can help you qualify for financing, business credit cards, and vendor accounts without tying activity to your personal credit score. Without an EIN, business credit activity gets bundled with your SSN.

Before you start, have the responsible party’s name and SSN or ITIN ready, the legal name of the entity exactly as it appears on your formation documents, a mailing address, your reason for applying, and the business start date and primary activity. A name mismatch with existing IRS records is the most common cause of rejection or delay.

Entering Your EIN on Etsy

What Happens If the Number on File Is Wrong

Providing an incorrect taxpayer identification number to Etsy, or failing to provide one at all, can trigger backup withholding at 24 percent on your shop earnings.9Internal Revenue Service. Backup Withholding The withheld money is applied toward your tax bill, but it comes out of your payouts first, which is a serious cash-flow hit.

The IRS also imposes penalties on incorrect information returns under Section 6721. The standard penalty is $250 per return with wrong information, such as a bad taxpayer ID. Corrected within 30 days of the filing deadline, the penalty drops to $50; corrected after 30 days but before August 1 of the same year, it is $100.10Office of the Law Revision Counsel. 26 USC 6721 – Failure to File Correct Information Returns Errors involving a taxpayer identification number are never treated as minor or inconsequential.11eCFR. 26 CFR 301.6721-1 – Failure to File Correct Information Returns
