Do I Need an EIN for Rental Property? LLCs, 1099s, and SSNs

If you own rental property in your own name, have no employees, and don’t sponsor a retirement plan, you generally do not need an EIN for rental property. You can report the income on Schedule E of your Form 1040 using your Social Security number.1Internal Revenue Service. 2025 Instructions for Schedule E (Form 1040) The answer changes once you put the property inside an LLC or partnership, hire staff, or take on certain reporting obligations. Below is how to tell which side of the line you’re on.

When the IRS Requires an EIN

Federal regulations require any non-individual entity, such as a corporation, partnership, or multi-member LLC, to use an EIN rather than a personal Social Security number on tax filings.2eCFR. 26 CFR 301.6109-1 – Identifying Numbers A few specific activities also trigger the requirement no matter how the property is titled:

  • Hiring anyone as a W-2 employee, such as a live-in property manager or maintenance worker. You need an EIN to handle payroll tax withholding and reporting.3Internal Revenue Service. Get an Employer Identification Number
  • Operating as a partnership or corporation. These are separate taxpayers and file their own returns.
  • Sponsoring a qualified retirement plan through the rental business.3Internal Revenue Service. Get an Employer Identification Number

Once you have employees, federal unemployment tax kicks in too. Paying total cash wages of $1,000 or more in any calendar quarter means you owe FUTA on the first $7,000 of each employee’s wages, at a gross rate of 6.0% that a credit typically reduces to 0.6%.4Internal Revenue Service. When You Can Stick With Your SSN

A landlord who owns property individually, hires no employees, and runs no retirement plan can use a Social Security number for all federal income tax reporting. Schedule E attached to the Form 1040 covers rental income and expenses, and no separate business return is required.1Internal Revenue Service. 2025 Instructions for Schedule E (Form 1040) Most owners with one or two properties and no staff fit here.

“Not required” isn’t the same as “not useful,” though, and there are practical reasons to apply anyway. More on that below.

How Your Business Structure Changes the Answer

Single-Member LLC

A single-member LLC is treated as a “disregarded entity” for federal income tax purposes unless it elects corporate treatment by filing Form 8832.5Internal Revenue Service. Single Member Limited Liability Companies For income reporting, you and the LLC are the same taxpayer, and you can generally use your SSN.

The trap: even though the LLC is disregarded for income tax, it is treated as a separate entity for employment tax. A single-member LLC with any employees must get its own EIN and use it for all payroll reporting and payment. Your personal SSN cannot stand in for the LLC’s employment taxes.5Internal Revenue Service. Single Member Limited Liability Companies In practice, most single-member LLCs end up with an EIN either for this reason or because their bank asks for one.

Multi-Member LLC

A domestic LLC with two or more members is classified as a partnership by default. Partnerships file Form 1065 each year, and the form requires an EIN in Item D. If the partnership doesn’t have one when the return comes due, the IRS instructions say to apply before filing.6Internal Revenue Service. Instructions for Form 1065 (2025)

S-Corp or C-Corp Election

Some landlords elect S-corporation treatment for their LLC by filing Form 2553. That form also requires an EIN in Item A, and the entity must apply before filing if it doesn’t already have one.7Internal Revenue Service. Instructions for Form 2553 Any entity taxed as a corporation needs its own EIN.

The 1099 Trigger Landlords Often Miss

If you pay an independent contractor, such as a plumber, electrician, or landscaper, $600 or more during the tax year in the course of your rental business, you’re required to file Form 1099-NEC for that contractor.8Internal Revenue Service. Instructions for Forms 1099-MISC and 1099-NEC This applies when the rental activity is treated as a trade or business, which matters especially for landlords claiming the qualified business income deduction.

You can put your SSN on 1099s as the payer, but that means giving your Social Security number to every contractor you hire. An EIN meets the same reporting obligation without the exposure. Penalties for failing to file correct information returns under IRC Section 6721 run from $60 per return for quick corrections up to $660 per return for intentional disregard, with no cap for willful failures.9Office of the Law Revision Counsel. 26 USC 6721 – Failure to File Correct Information Returns

Reasons to Get One Even When You Don’t Have To

The application is free and takes minutes, so plenty of sole proprietors and single-member LLC owners get an EIN by choice.

Identity protection is the main reason. Every W-9 you sign for a tenant, every 1099 you send a contractor, and every bank form you complete is another place your SSN could leak. An EIN keeps that number off business paperwork. Banks and credit unions generally accept an EIN for a business checking account, even for sole proprietors, which makes it easier to keep rental finances separate from personal ones.

Some lenders also require an EIN before extending business credit or approving a commercial mortgage. And if you later add a partner or hire someone, you’ll already have the number in hand instead of racing a payroll deadline to get one.
