If you’re asking whether you need an EIN for your LLC, the short answer is that most LLCs do. Federal law requires one the moment your LLC has more than one member, hires an employee, owes excise taxes, withholds tax on payments to a nonresident, or sets up a retirement plan. A single-member LLC with none of those features can technically use the owner’s Social Security Number, but banks, clients, and state agencies almost always push those owners to get an EIN anyway.
When the IRS Requires an EIN
The IRS spells out specific triggers. If any one of these describes your LLC, the EIN is mandatory:
- Your LLC has more than one member. Multi-member LLCs default to partnership treatment and must file Form 1065 each year, an information return that passes income and losses through to the individual members. Partnerships must have an EIN.1Internal Revenue Service. About Form 1065, U.S. Return of Partnership Income
- Your LLC has employees. You need an EIN to report payroll taxes. A single-member LLC with employees files employment tax returns under the LLC’s name and EIN, not the owner’s personal information.
- Your LLC owes excise taxes, including anything tied to alcohol, tobacco, or firearms.
- Your LLC withholds tax on payments to a nonresident alien, such as a foreign contractor subject to withholding.
- Your LLC has a retirement plan, including a Solo 401(k) set up for a one-person business.
These are the categories the IRS itself uses to identify who needs an EIN.2Internal Revenue Service. Employer Identification Number Failing to comply with information reporting requirements when they apply carries a penalty of $50 per failure, capped at $100,000 per calendar year, and unlike many IRS penalties this one is not adjusted for inflation.3Office of the Law Revision Counsel. 26 USC 6723 – Failure To Comply With Other Information Reporting Requirements
The Single-Member Exception
If you’re the sole owner of your LLC, have no employees, owe no excise taxes, and haven’t elected corporate tax treatment, the IRS does not require you to get an EIN. You report business income on Schedule C of your personal Form 1040 using your Social Security Number.4Internal Revenue Service. Single Member Limited Liability Companies5Internal Revenue Service. About Schedule C (Form 1040), Profit or Loss From Business (Sole Proprietorship)
The IRS calls this “disregarded entity” status. Your state still recognizes the LLC as a separate legal entity, but for federal income tax purposes the IRS looks through the LLC to you. The IRS itself acknowledges that a disregarded single-member LLC may still need an EIN if a bank requires one to open an account or if state tax law demands a federal EIN.
Why Most Single-Member Owners Still Get One
“Not required” and “not useful” are different things. A few practical pressures push almost every LLC owner toward applying:
Banks. Nearly every financial institution requires an EIN to open a business checking account and won’t accept a Social Security Number for an LLC account. Business credit cards and lines of credit follow the same pattern.
Clients and vendors. Anyone who pays your LLC $600 or more for services during the year must report it on Form 1099-NEC, and they’ll ask for your taxpayer identification number on a W-9 to do so.6Internal Revenue Service. Am I Required to File a Form 1099 or Other Information Return? You can put your SSN on a W-9, but handing it to every client is an identity theft risk that’s easy to avoid.
Legal separation. If you ever need to show a court that your LLC is a genuinely separate entity and not your alter ego, a distinct tax ID, separate bank accounts, and clean records all help. Using your SSN for everything muddies that line.
S-corporation election. If you plan to elect S-corp treatment by filing Form 2553, the form requires an EIN. If you haven’t received one by the deadline, the IRS lets you write “Applied For” in the EIN field, but you’ll still need the actual number.7Internal Revenue Service. Instructions for Form 2553
What You Need Before You Apply
Have this ready before you start:
- The legal name of the LLC, exactly as it appears on your state-filed Articles of Organization. Mismatches cause problems.
- A mailing address. The IRS uses it to send your confirmation notice (CP 575) and future correspondence.
- The responsible party’s name and SSN or ITIN. The IRS defines the responsible party as the individual who ultimately owns or controls the entity and can direct its funds and assets. For most LLCs, that’s the managing member or sole owner.8Internal Revenue Service. Instructions for Form SS-4
- The reason for applying, such as starting a new business, hiring employees, or setting up a retirement plan.
- The entity type and tax classification. A multi-member LLC on default treatment checks “Partnership.” A single-member disregarded entity checks “Other” and writes “disregarded entity.” An LLC electing corporate treatment checks “Corporation” and notes whether it will file Form 1120 or 1120-S.
If the responsible party ever changes, you’re required to notify the IRS by filing Form 8822-B within 60 days.9Internal Revenue Service. Form 8822-B, Change of Address or Responsible Party – Business

If the responsible party has neither an SSN nor an ITIN and isn’t eligible for one, enter “foreign” or “N/A” on line 7b of Form SS-4. The line cannot be left blank.
When You’ll Need a New EIN Later
An EIN usually stays with an LLC for its lifetime, but some structural changes require a new one. The IRS requires a new EIN if you terminate an existing LLC and form a new corporation or partnership, or if you own a single-member LLC and become required to file excise or employment tax returns for the first time.12Internal Revenue Service. When To Get a New EIN
Adding a member to a single-member LLC changes the default tax classification from disregarded entity to partnership, but IRS guidance on whether that specific change requires a new EIN is less clear-cut. Before filing under the old number, check the IRS’s “Do I Need a New EIN?” tool or ask a tax professional.
