You do not need a new visa stamp after an H1B transfer as long as you remain inside the United States. Once USCIS approves the transfer, your new I-797 Approval Notice is enough to prove you are in valid H1B status and authorized to work for the new employer. A visa stamp only becomes necessary when you leave the country and need to re-enter, because the stamp is a travel document, not a work permit.
Status and Stamp Are Not the Same Thing
Most of the confusion around this question comes from treating “H1B status” and “H1B visa stamp” as one thing. They are separate, and they expire independently.
Your H1B status is your legal permission to live and work in the U.S. for a specific employer. USCIS grants it, and the I-797 Approval Notice is your proof.1U.S. Citizenship and Immigration Services. So you can hold valid status with no current stamp, and you can hold an expired stamp while your status is still good. After a transfer, what changes is the petition and the approval notice tied to it. The stamp in your passport is untouched by USCIS.
Staying in the U.S. After the Transfer
If you have no international travel planned, you do not need to do anything about a visa stamp. Once your transfer is approved, USCIS issues a new I-797 Approval Notice tied to your new employer. The I-797A version includes a tear-off I-94 at the bottom showing your new authorized stay period. That I-94 stays valid until you leave and re-enter the country, at which point CBP issues a fresh one. You can also pull your electronic I-94 from the CBP website at any time. The expiration date on the I-94 is your status expiration date, so track it closely.
You do not have to wait for the transfer approval to start work either. When You Do Need a New Stamp
The moment you plan to travel abroad, the stamp becomes essential. To be admitted back into the U.S. in H1B status, you need an unexpired H1B visa stamp in your passport. If the stamp has expired and you leave, you cannot come back until you attend a consular appointment and get a new one. The I-797 alone will not get you through a port of entry.
This is where people get caught out. Everything feels fine inside the country because the I-797 is valid and paychecks are landing, then a family emergency or a client trip forces travel, and suddenly the expired stamp becomes a wall. If any international travel is realistic in the coming months, planning the stamping ahead of time is worth it.
Can You Reuse Your Old Stamp From a Previous Employer?
Yes, as long as it hasn’t expired. A valid H1B stamp lets you seek admission in H1B status regardless of which employer sponsors you now. The employer name printed on the stamp is an annotation, not a restriction. Carry your new I-797 Approval Notice showing the transfer, because the CBP officer will want to confirm that your underlying petition is active and tied to the new employer.
The word doing the work here is “unexpired.” If the stamp has passed its printed expiration date, it cannot be used for regular re-entry even if your H1B status is valid through a later date. In that case you need a fresh stamp from a consulate before returning.
Short Trips to Canada or Mexico
There is one narrow exception to the expired-stamp problem. Under automatic visa revalidation, certain H1B holders with expired stamps can re-enter the U.S. after a brief trip to Canada or Mexico without getting a new stamp.5U.S. Customs and Border Protection. You are not eligible for automatic revalidation if:
- You are a citizen or national of a country designated as a state sponsor of terrorism.
- Your visa was previously canceled under INA 222(g).
- You applied for a new U.S. visa while abroad and are waiting for a decision.
- You originally entered under the Visa Waiver Program rather than on a visa.
F and J visa holders can use automatic revalidation for trips to adjacent Caribbean islands, but H1B holders cannot. Only Canada and Mexico qualify.5U.S. Customs and Border Protection. Traveling While the Transfer Is Still Pending
Traveling internationally before your transfer is approved is possible with a valid unexpired H1B stamp, but the risk is real. At the border you would show the stamp along with the I-797C receipt notice for the pending petition and a letter from the new employer confirming the job.
The problem is that re-entry on a pending transfer is not guaranteed. If a CBP officer has concerns, or if the petition is denied while you’re abroad, you can end up stuck outside the country with no easy path back in. Leaving while a change-of-status petition is pending can also be treated as abandonment of that request, which would push the case into consular processing instead.
If you have to travel before approval, the safer play is premium processing. Your employer files Form I-907 alongside the transfer petition, and USCIS commits to a decision within 15 business days. Premium processing only speeds up the USCIS decision; it does not affect any consular timeline. Its value here is getting the approval in hand before you leave, so the only remaining variable is the stamping itself.
If You Do End Up Needing a Stamp
The process runs through a U.S. embassy or consulate, usually in your home country. You complete the DS-160 online nonimmigrant visa application, pay the MRV fee, and book an interview through the embassy’s scheduling system. At the interview a consular officer reviews your documents and asks about your job, qualifications, and employer. Most interviews are brief. The outcome is typically approval (your passport is held for stamp placement and returned in a few days), refusal, or administrative processing under Section 221(g) for additional review.
Some H1B holders try third-country stamping to shorten wait times, but consulates restrict this. The short version stays the same: if you are not leaving the country, the transfer approval is all you need. The stamp is only for the trip back.
