If your ESTA is denied, the embassy cannot tell you why or resolve the underlying issue. What You Give Up by Traveling Under the Visa Waiver Program
Entering on an ESTA is faster and cheaper than getting a visa, but it comes with real trade-offs. Before you are admitted, you waive your right to contest removal from the United States, except through an asylum claim.5U.S. Citizenship and Immigration Services. You also cannot extend your stay beyond 90 days or change your immigration status once inside the country. Someone on a B-2 tourist visa can sometimes request an extension. A VWP traveler cannot. One narrow exception: if a genuine emergency prevents you from leaving before day 90, a local USCIS office may grant up to 30 additional days of “satisfactory departure.” It is not available for a change of plans. Overstaying: The Mistake With the Longest Shadow
Staying past your authorized period, whether on ESTA or a visa, triggers consequences that compound the longer you remain. This is the single biggest mistake French travelers make, sometimes unintentionally when a trip extends by just a few days.
Under federal law, anyone who remains unlawfully for more than 180 consecutive days but less than one year, then voluntarily departs, is barred from reentering the United States for three years.
