Do Chileans Need a Visa for the USA or Just ESTA?

What the Visa Waiver Program Covers

The VWP allows stays of up to 90 days per visit for tourism, visiting friends or family, business meetings and conferences, or transit through the U.S. to another country. If your trip falls into any of those restricted categories, or you plan to stay longer than 90 days, Chile’s VWP membership does not help you. You need a visa.

How to Get an ESTA

Every Chilean traveling under the VWP must have an approved ESTA before departure. You apply online through the official U.S. Customs and Border Protection site with your personal details, passport data, travel history, and a U.S. point of contact.4U.S. Customs and Border Protection. The fee is $40.27. Most decisions come back within 72 hours, and many are approved almost immediately. Once granted, your ESTA is valid for two years or until your passport expires, whichever comes first, and it covers multiple trips during that window.5U.S. Customs and Border Protection. ESTA is also required if you are only transiting through a U.S. airport on your way somewhere else. Even a short layover counts. What You Need at the U.S. Border

An approved ESTA gets you on the plane. It does not guarantee entry. At the port of entry, a Customs and Border Protection officer decides whether to admit you, and you need to arrive with two things in order.

You must travel on an e-passport, which is a passport with an embedded electronic chip storing your biometric data. Look for the small rectangular chip symbol on the cover. You should also be able to show you can support yourself financially during the visit. Officers may ask for proof of funds and accept credit cards, cash, travelers’ checks, and money orders. If a host in the U.S. is covering your expenses, bring a written invitation letter with their full name, address, and confirmation that they will provide lodging and meals. What You Give Up by Using the VWP

The program is fast and cheap, but it has real trade-offs compared with a regular visa.

You cannot extend your stay. If you enter under the VWP and your plans change, there is no way to file for more time. You also waive the right to challenge a removal order. As a condition of VWP admission, you agree that if the government moves to remove you, you cannot contest it in court. What Happens If You Overstay

Overstaying a VWP admission is one of the more damaging immigration mistakes a traveler can make. Once your 90 days expire and you are still in the country, you begin accruing unlawful presence, and the penalties climb quickly.

Because you cannot extend a VWP stay and have waived the right to fight removal, the 90-day clock is firm.

When You Need a Visa Instead

You need a B-1 (business) or B-2 (tourism) visa whenever your trip does not fit the VWP. Start with the DS-160, the online nonimmigrant visa application on the Department of State’s Consular Electronic Application Center.15U.S. Department of State. Bring your DS-160 confirmation page, your passport, and documents showing the purpose of your trip and your ties to Chile. The consular officer is looking for evidence you intend to return home: employment records, property, family, or enrollment at a Chilean university. The burden is on you to show the visit is temporary, and organized documentation makes a difference.

If Your ESTA Is Denied

There is no formal appeal of an ESTA decision. You have two practical options: apply for a B-1/B-2 visa, or file a traveler redress inquiry if you believe the denial was based on a data error.

The Department of Homeland Security runs the Traveler Redress Inquiry Program (DHS TRIP) for travelers who think they were incorrectly denied boarding, delayed at entry, or flagged for extra screening. You file online, receive a Redress Control Number, and check status through the same portal.17Homeland Security. If you need to travel before redress resolves, apply for a visa. There is no waiting period after an ESTA denial before you can submit a visa application.
