Australians do not need a visa for the USA for short tourism or business trips, but they do need an approved ESTA before boarding. Australia is part of the Visa Waiver Program, so an Australian passport holder can visit for up to 90 days for tourism or business without going through a U.S. Embassy or Consulate.1U.S. Department of Homeland Security. When an ESTA Is Enough
Australia joined the Visa Waiver Program in 1996. Since then, Australian citizens have been able to travel to the United States for tourism or business stays of 90 days or less without a traditional visa, provided they hold an e-passport and get approval through the Electronic System for Travel Authorization, known as ESTA.2U.S. Customs and Border Protection. “Business” here is narrower than most people expect. It covers meeting business associates, attending conferences, negotiating contracts, and short-term training.4U.S. Citizenship and Immigration Services. B-1 Temporary Business Visitor It does not cover performing work, and that includes remote work for an Australian employer. U.S. immigration law looks at where the work is physically done, not where the employer sits or where you’re paid. Volunteering is generally allowed, but only for activities that are normally unpaid. Helping at a food bank is fine. Filling a shift that would ordinarily be a paid role, like nursing at a hospital, is not, even if you take no money for it.
Applying for the ESTA
The ESTA application is online and takes around 20 minutes. It asks for passport details, your itinerary, and eligibility questions about criminal history, prior immigration violations, communicable diseases, and travel to certain countries.5U.S. Customs and Border Protection. The fee totals $21 if you’re approved. Four dollars is charged upfront for processing, and $17 more is added on approval. Denied applicants pay only the $4.6Federal Register. When You Need an Actual Visa
Some Australians can’t use the Visa Waiver Program at all and must apply for a nonimmigrant visa at the U.S. Embassy in Canberra or a consulate in Sydney, Melbourne, or Perth. The common disqualifiers:
- Any arrest or conviction involving serious harm to people or property, or any drug offense.
- A previous U.S. overstay, denial of entry, or removal.
- Travel to North Korea, Iran, Iraq, Libya, Somalia, Sudan, Syria, or Yemen on or after March 1, 2011, or Cuba on or after January 12, 2021, with narrow exceptions for diplomatic or military travel on behalf of a VWP country.7U.S. Department of State. Visa Waiver Program

The purpose of the trip matters too. Studying at a U.S. institution needs an F visa, working generally needs an H visa or another employment category, and foreign journalists need an I visa. Tourism or medical treatment that doesn’t fit the VWP falls under a B-2 visa; business that doesn’t fit falls under a B-1. If your ESTA is denied, the embassy processes any subsequent visa application on its own merits. Staff can’t tell you why the ESTA was denied or reverse it.9U.S. Customs and Border Protection. The Tradeoff: No Extensions on a VWP Entry
Entering under the Visa Waiver Program means waiving the right to extend your stay, change your immigration status, or contest removal before an immigration judge. A narrow asylum exception aside, that waiver is a condition of the program.10Office of the Law Revision Counsel. 8 USC 1187 – Visa Waiver Program for Certain Visitors Come in on an ESTA and then decide you want to stay longer, enroll in a course, or accept a job, and you generally have to leave the U.S. and apply for the appropriate visa from Australia.
A B-1/B-2 visa keeps those options open. If your plans might realistically shift once you arrive, the extra cost and interview are worth it.
What Overstaying Costs
Overstaying by even one day carries serious penalties, and VWP overstays are treated harshly. Once your 90 days end you are unlawfully present, and because you waived your right to a hearing, you can be removed without seeing an immigration judge.10Office of the Law Revision Counsel. 8 USC 1187 – Visa Waiver Program for Certain Visitors
The re-entry bars scale with the length of the overstay. More than 180 days but less than a year of unlawful presence, followed by a voluntary departure, triggers a three-year bar. A year or more triggers a ten-year bar.11Office of the Law Revision Counsel. 8 USC 1182 – Inadmissible Aliens You also lose ESTA eligibility for future trips. A careless overstay on a holiday can lock you out of the United States for a decade.
At the Border
An approved ESTA or visa gets you to the front door. It does not guarantee entry. The Customs and Border Protection officer at your port of arrival makes the final call.
Australians are exempt from the general rule that a passport must be valid for at least six months beyond the intended stay; a passport valid for the duration of your visit is enough.12U.S. Customs and Border Protection. Two Things Frequent Visitors Should Know
The United States has no public healthcare available to foreign visitors. An urgent care visit typically runs $150 to $280, and an emergency room visit or hospital stay can easily reach five figures. Travel health insurance isn’t legally required, but arriving without it is a financial gamble.
Repeat visitors should also watch the IRS substantial presence test. You can be treated as a U.S. tax resident, and required to report worldwide income, if you’re present at least 31 days in the current year and at least 183 days over three years, using a weighted count: all days this year, one-third of last year’s days, and one-sixth of the year before.14Internal Revenue Service. Substantial Presence Test A single 90-day VWP trip doesn’t trigger it, but consecutive near-maximum years can get close. Three straight years of 90 days works out to 90 + 30 + 15 = 135, still under the threshold, but additional shorter trips in the same calendar year narrow the margin. The U.S.-Australia tax treaty offers a closer connection exception, but relying on it without planning is risky.
