Asylum seekers do not get Social Security benefits while their case is pending. Social Security retirement and disability payments depend on having a Social Security Number, legal work authorization, and enough work credits earned through payroll-tax contributions, and none of that is in place when an application is still under review. Once asylum is granted, an asylee can work toward those benefits and may also qualify sooner for Supplemental Security Income and short-term refugee assistance.
Why a Pending Applicant Can’t Collect
Filing Form I-589 with U.S. Citizenship and Immigration Services starts the asylum process, but it does not open the door to Social Security.1U.S. Citizenship and Immigration Services. I-589, Application for Asylum and for Withholding of Removal An applicant cannot legally work, and therefore cannot earn Social Security credits, until USCIS issues an Employment Authorization Document (EAD).
The timing is set by the 180-Day Asylum EAD Clock. An applicant can file Form I-765 for an EAD 150 days after the asylum application is submitted, but USCIS will not issue the card until the case has been pending at least 180 days without a decision.2U.S. Citizenship and Immigration Services. The card issued while the case is still pending carries the restriction “VALID FOR WORK ONLY WITH DHS AUTHORIZATION.”5E-Verify. Employers – Are You Accepting a Restricted Social Security Card The number is real and the earnings tracked under it are real; the restriction is about who can employ the holder.
How Work Credits Add Up Once You’re Employed
Once an asylum seeker has an EAD and an SSN, an employer withholds Federal Insurance Contributions Act taxes from every paycheck, the same as for any other worker.6Internal Revenue Service. In 2026, one credit is earned for every $1,890 in covered wages, up to a maximum of four credits per year. Earning $7,560 in the year gets the full four.7Social Security Administration. Benefits Planner – Social Security Credits and Benefit Eligibility Credits stay on the record permanently under the worker’s SSN, so time spent working while the asylum case is pending is not lost. Every quarter of coverage counts toward whatever benefit the person eventually qualifies for.
Combining Earlier Tax Filings Under an ITIN
Some asylum seekers filed tax returns using an Individual Taxpayer Identification Number before they had a Social Security Number. Those earlier records don’t move over automatically. To combine everything under the new SSN, write to the IRS with your full name, mailing address, ITIN, and a copy of your Social Security card, and mail it to the IRS in Austin, Texas.8Internal Revenue Service. Foreign Work History and Totalization Agreements
Work done abroad may also help. The United States has totalization agreements with about 30 countries, including Canada, the United Kingdom, Germany, South Korea, and Australia.9Social Security Administration. Status of Totalization Agreements When someone has U.S. coverage but not enough to qualify on their own, SSA can combine U.S. and foreign credits to meet the eligibility threshold. At least six quarters of U.S. coverage are needed before SSA will totalize a record.10Social Security Administration. U.S. International Social Security Agreements For people who spent most of their working life in one of those countries before coming here, this can mean the difference between qualifying and not.
Retirement Benefits After Asylum Is Granted
There is a meaningful difference between an asylum seeker, whose case is pending, and an asylee, who has been granted protection. Once asylum is granted, SSA treats the person like a lawful permanent resident for issuing a Social Security card, meaning the DHS-authorization restriction can be removed. The asylee brings proof of status, such as an I-94 with an asylum-granted stamp, Form I-797, or the immigration judge’s order, to get an unrestricted card.11Social Security Administration. Retirement benefits still require 40 credits, which is roughly ten years of covered work.7Social Security Administration. Benefits Planner – Social Security Credits and Benefit Eligibility Credits earned while the asylum application was pending count toward that total, but for most asylees the 40-credit mark is years away.
Disability Benefits Can Come Sooner
Social Security Disability Insurance uses a different credit test that depends on how old the worker is when the disability starts. The general rule is 40 credits with 20 of them earned in the ten years right before disability begins, but SSA says younger workers may qualify with fewer credits, and the required number scales with age.12Social Security Administration. How Does Someone Become Eligible – Disability Benefits A younger asylee who develops a serious disability after only a few years of U.S. work may already meet the requirement.
Supplemental Security Income for Asylees
Supplemental Security Income is a separate, needs-based program for people who are 65 or older, blind, or disabled and have very limited income and resources. SSI does not require any work credits.
Asylees are among the “qualified aliens” eligible for SSI, but only for seven years from the date asylum is granted, and only if the SSI application is filed within that window.13Social Security Administration. The 2026 maximum federal SSI payment for an individual is $994 per month, and some states add a supplement.15Social Security Administration. 2026 Cost-of-Living Adjustment (COLA) Fact Sheet For an elderly or disabled asylee with no realistic path to ten years of employment, SSI is often the most important federal cash benefit available, and the seven-year clock starts on the day asylum is granted.
Medicare and the Same Credit Test
Premium-free Medicare Part A requires the same 40 quarters of coverage as retirement.16Centers for Medicare & Medicaid Services. Health Coverage Options for Immigrants An asylee who reaches 65 without those credits can still enroll in Part A but pays a monthly premium of up to $565 in 2026.17Medicare. 2026 Medicare Costs A totalization agreement with the person’s home country can close that gap by combining foreign and U.S. work history.
Shorter-Term Help After the Grant
Retirement is a long horizon; the Office of Refugee Resettlement funds programs meant to bridge the gap right after asylum is granted. Refugee Cash Assistance and Refugee Medical Assistance provide a short safety net while a new asylee looks for work. For individuals whose ORR eligibility date falls on or after May 5, 2025, both programs last four months from the date asylum is granted.18Administration for Children & Families. Office of Refugee Resettlement Notice of Change of Eligibility Four months is a short window, so applying quickly after the grant letter arrives matters.
Depending on household income, asylees may also qualify for the Supplemental Nutrition Assistance Program, Temporary Assistance for Needy Families, and Medicaid.18Administration for Children & Families. Benefits and Services Available for Asylees None of these are available while the asylum case is still pending.
What a Removal Order Does to Benefits
An asylee or former asylee who receives a final order of removal loses eligibility for Social Security retirement and disability payments. Benefits stop the month after SSA receives notice of the removal from the Department of Homeland Security.20Social Security Administration. The credits on the earnings record are not erased, but they cannot be drawn on while the removal order stands.
