The Davis-Bacon Act sets prevailing wages on federal construction work: any contractor or subcontractor on a federal contract over $2,000 for the construction, alteration, or repair of public buildings or public works must pay every laborer and mechanic on the job at least the local prevailing hourly wage and fringe benefit rate that the U.S. Department of Labor has published for that job classification and area.1Office of the Law Revision Counsel. 40 USC 3142 – Rate of Wages for Laborers and Mechanics Compliance is proven weekly through certified payrolls, and getting it wrong can freeze your progress payments or bar the company from federal work for three years.
Which Contracts Are Covered
The $2,000 threshold has never been adjusted for inflation, so nearly every federal construction contract is covered. Painting and decorating count. Public works like highways, bridges, and dams are in when federal funding is involved. The prime contractor and every subcontractor down the chain share the obligation, and it runs to every laborer and mechanic physically working at the site regardless of whose payroll they are on. Agencies build the wage requirements into the bid documents, so the labor cost floor is visible before you price the job.
Coverage reaches beyond direct federal contracts. Dozens of related statutes extend prevailing wage rules to projects funded through federal grants, loans, loan guarantees, or insurance, collectively the Davis-Bacon and Related Acts.2U.S. Department of Labor. Davis-Bacon and Related Acts Federally assisted highway work, HUD-funded housing, and water infrastructure paid for through the Federal Water Pollution Control Act all trigger the same wage duties even though the federal government is not the one holding the shovel. A privately developed affordable housing project or a state highway expansion partly funded with federal dollars falls under the same rules.
What Counts as the Site of the Work
Prevailing wages apply at the primary construction site and also at secondary sites where a significant portion of the building or work is constructed, provided that construction is for specific use in the project and the site is either set up for the contract or dedicated almost exclusively to it.3eCFR. 29 CFR 5.2 – Definitions Adjacent tool yards, batch plants, and borrow pits dedicated to the project are in. Permanent offices, independent fabrication plants, and established material suppliers that existed before the bid are generally out, even if they end up supplying the project. Truck drivers hauling material between covered sites can fall under the rule when the facility they work at is closely tied to the federal job.
How the Prevailing Wage Is Set
The Department of Labor publishes wage determinations by geographic area and by type of construction: building, highway, residential, and heavy.4Congressional Research Service. The Davis-Bacon Act – Institutional Evolution and Public Policy A wage determination lists the hourly rate and fringe benefit rate for each job classification the Department has found to be prevailing in a given county.5U.S. Department of Labor. Davis-Bacon Wage Determinations
A 2023 DOL final rule restored the three-step method the Department used from 1935 to 1983. If a majority of surveyed workers in a classification earn the same rate, that rate prevails. If no rate hits a majority but one rate is paid to at least 30 percent of workers, that rate is adopted. Only when no rate reaches 30 percent does the Department fall back to a weighted average.6Federal Register. Updating the Davis-Bacon and Related Acts Regulations Prevailing wages tend to reflect the rate most commonly paid rather than an average pulled down by a few low-paying employers.
Finding and Applying the Right Rate
Wage determinations are searchable on SAM.gov by state, county, and construction type. The determination locked into the contract at signing becomes binding for the life of that contract. If the job needs a classification that is not listed, the contractor requests a conformance from the DOL’s Wage and Hour Division through the contracting agency using Form SF-1444, proposing a rate that bears a reasonable relationship to the classifications already on the determination.7U.S. Department of Labor. Davis-Bacon Wage Determination Conformance Request Guide Do not start work in the missing classification at a lower rate while the request is pending.
Basic Rate, Fringe Benefits, and the Cash Equivalent
Every wage determination has two components: a basic hourly rate and a fringe benefit rate. The fringe portion is meant to cover employer contributions for things like health insurance, pension plans, and paid leave. Social Security and workers’ compensation contributions do not count toward it.
You can satisfy the fringe obligation with actual benefits through funded plans, with cash paid directly to the worker, or with a mix.8eCFR. 29 CFR Part 5 Subpart B – Interpretation of the Fringe Benefits Provisions of the Davis-Bacon Act A contractor who offers no benefits at all can comply by paying a straight-time hourly rate equal to the basic rate plus the full fringe amount. When a worker performs tasks in more than one classification in a week, the employer tracks the hours separately and applies each classification’s rate to the corresponding hours.
Overtime
Most Davis-Bacon covered contracts also trigger the Contract Work Hours and Safety Standards Act, which requires time-and-a-half pay for all hours worked beyond 40 in a workweek. The overtime premium is calculated on the basic hourly rate from the wage determination, not on the fringe.9U.S. Department of Labor. Overtime Pay on Government Contracts When a worker performs in multiple classifications in the same week, the overtime rate can be a weighted average of the straight-time rates, or the employer and worker can agree in advance to use the rate for the classification the worker is performing during the overtime hours. If the worker’s actual pay is above the wage determination rate, overtime is calculated on the higher actual rate. Computing overtime on the wage determination rate while paying above it is a common mistake.
Apprentice Pay
Apprentices may be paid less than the full prevailing wage only if they are individually registered in a bona fide program approved by the DOL’s Office of Apprenticeship or a recognized state apprenticeship agency.10eCFR. 29 CFR Part 5 – Labor Standards Provisions Applicable to Contracts Someone certified as eligible for probationary employment can be paid the apprentice rate for their first 90 days, but must move to the full prevailing rate after that if still not registered.
Ratio limits apply as well. The number of apprentices in a given craft on the project cannot exceed the ratio allowed by the contractor’s registered program, and anyone working beyond that ratio must be paid the full journeyworker rate. Pre-apprentices and other unregistered workers are not recognized under Davis-Bacon and get the full prevailing rate.
Certified Payrolls, Posting, and the Kickback Ban
Contractors and subcontractors must submit certified payrolls every week they perform covered work.11eCFR. 29 CFR 5.5 – Contract Provisions and Related Matters The weekly obligation comes from the Copeland Act.12Office of the Law Revision Counsel. 40 USC 3145 – Regulations Governing Contractors and Subcontractors A false statement on the payroll is a federal crime under 18 U.S.C. ยง 1001.
Form WH-347 is the standard DOL form, and its use is optional as long as your own format captures every required field: each worker’s name, an individual identifying number such as the last four digits of a Social Security number, job classification, daily hours, hourly rate, and deductions. Full Social Security numbers must not appear.13U.S. Department of Labor. Instructions For Completing Davis-Bacon and Related Acts Weekly Certified Payroll Form WH-347 Each submission includes a signed Statement of Compliance. Payrolls go to the federal agency overseeing the project, or on federally assisted work, to the grant recipient or project sponsor for forwarding. Records must be preserved for at least three years after all work on the prime contract is complete.11eCFR. 29 CFR 5.5 – Contract Provisions and Related Matters Falling behind on submissions can delay progress payments for the whole project.
At the job site, post the DOL’s WH-1321 poster, “Worker Rights Under the Davis-Bacon Act,” in a prominent, accessible location, and post the applicable wage determination next to it so workers can check their pay against the listed rates.14U.S. Department of Labor. Davis-Bacon Poster (Government Construction) Investigators look for these postings on their first walk-through.
The Copeland Anti-Kickback Act makes it a federal crime to pressure or induce a worker to give back any part of the pay they are owed. It covers direct kickbacks and indirect ones, such as forcing workers to buy tools or supplies from the employer at inflated prices as a condition of employment.
What Happens When a Contractor Underpays
The federal agency or funding recipient must withhold enough from accrued contract payments to cover unpaid wages plus interest, then distribute those funds to the affected workers.15U.S. Department of Labor. Davis-Bacon and Related Acts Why Are Contract Payments Being Withheld Withholding can be triggered by a worker complaint, a routine investigation, or discrepancies in the certified payrolls.
Willful or repeated violations put the contractor and subcontractor on a federal debarment list maintained by the Comptroller General. Debarment lasts three years from the date the list is published and reaches any firm in which the debarred individuals hold an interest.16Office of the Law Revision Counsel. 40 USC 3144 – Authority of Comptroller General The contractor can request a hearing before an administrative law judge before a final debarment decision.15U.S. Department of Labor. Davis-Bacon and Related Acts Why Are Contract Payments Being Withheld
Breach of the required contract clauses can also be grounds to terminate the contract.10eCFR. 29 CFR Part 5 – Labor Standards Provisions Applicable to Contracts If the government terminates and brings in a replacement, the original contractor and any responsible subcontractors remain liable for unpaid wages and monetary relief, with interest. Prime contractors can be held responsible for wage violations by lower-tier subcontractors, which is why compliance monitoring gets built into subcontract management on federal jobs.
How Workers File a Complaint
A worker who believes they are being underpaid on a covered project can file a complaint with the DOL’s Wage and Hour Division by calling 1-866-487-9243 or filing online. U.S. citizenship is not required, and retaliation for filing is prohibited. The contracting agency or the DOL can also open an investigation on its own when certified payrolls raise red flags or a routine audit turns up discrepancies.
