Date of Receipt Rules: Delivery Method, Proof, and Deadlines

The date of receipt is the moment the law treats a document, payment, or communication as having reached you, and that moment starts the clock on deadlines to answer a lawsuit, cancel a loan, petition the Tax Court, or report income in a given year. The rules that fix the date of receipt depend on how something was delivered, what kind of transaction it involves, and whether the law cares about when you actually held the item or only when it became available to you. Miss the date by a day and you can lose a right of rescission, draw a default judgment, or push income into the wrong tax year.

Actual Receipt and Constructive Receipt

Most timing disputes come down to one question: did you actually receive it, or does the law treat you as having received it?

Actual receipt is what it sounds like. A process server hands you papers, you sign for a certified letter, an email arrives in your inbox. The date is whatever the evidence shows. Under the Uniform Commercial Code, a person receives a notice when it comes to their attention or when it is duly delivered in a reasonable form at the place of business through which the contract was made.1Cornell Law Institute. Constructive receipt is the harder concept. You are treated as having received something even if you never touched it, so long as it was made available to you without substantial restrictions. Notice delivered to your registered agent, left at your address with a person of suitable age, or deposited in the mailbox you designated for business correspondence starts the clock whether you read it or not. The rule exists so that recipients cannot dodge obligations by ignoring the mail or ducking a server. Refusing to sign for a certified letter does not stop the clock; when a sender proves proper attempted delivery and refusal, courts routinely treat the document as received on the date of refusal.

How the Delivery Method Fixes the Date

The delivery method changes the legal rule for when receipt is established, not just how fast the item arrives.

Personal Service

When a process server or sheriff’s deputy hands documents to you directly, the date of receipt is the date of that handoff. The server files an affidavit describing the time, place, and manner of delivery, and courts treat that affidavit as presumptive proof. This is the cleanest form of receipt evidence, which is why courts require it for initial service in many types of cases.

U.S. Mail

Physical mail creates the most ambiguity. Certified mail produces a signed receipt with a date stamp, so the receipt date is easy to pin down. Regular first-class mail is trickier. Many contracts and regulations use a presumption that mail is received a set number of days after it is deposited with the postal service. Federal mortgage rules, for example, presume that mailed disclosures are received three business days after they are placed in the mail.2Consumer Financial Protection Bureau. These presumptions are generally rebuttable, so you can offer evidence that the letter arrived earlier or later than the assumed date.

Electronic Delivery

Under the Uniform Electronic Transactions Act, an electronic record is received when it enters an information processing system the recipient has designated for receiving that type of communication and the record is in a form the system can process.3National Conference of Commissioners on Uniform State Laws. Uniform Electronic Transactions Act – Section 15 In plain terms, your email is received when it hits your mail server, not when you open it. Court filings work the same way. Under the Federal Rules of Civil Procedure, electronic service is complete the moment the document is filed with the court’s e-filing system or sent by other electronic means the recipient consented to in writing.4Cornell Law Institute. The federal ESIGN Act reinforces that electronic records cannot be denied legal effect solely because they are electronic.5Office of the Law Revision Counsel. 15 USC 7001 – General Rule of Validity For consumer disclosures that must be provided in writing, the sender must first obtain your affirmative consent to receive records electronically. Without that consent, an emailed disclosure may not count as delivered at all.

International Service

When documents must be served on a party abroad, the Hague Service Convention governs most U.S. litigation and does not set a single receipt date the way domestic rules do. Article 15 prohibits a court from entering a default judgment unless service was accomplished through a method recognized by the receiving country’s law and the defendant had sufficient time to prepare a defense. If no proof of service comes back, the court must wait at least six months from the date of transmission before proceeding.6HCCH. The Mailbox Rule Is Not the Receipt Rule

These two rules are often confused, and mixing them up can cost a deadline. The mailbox rule applies to contract acceptances: an acceptance is effective the moment the offeree drops it in the mail, regardless of when the offeror receives it.7Cornell Law Institute. Mailbox Rule The receipt rule applies to almost everything else, including notices, revocations, and rejections, which take effect only when they actually arrive. If a contract requires you to send written notice of termination, the notice is effective when the other party receives it, not when you mail it. The distinction matters most when a deadline is close.

When the Mailing Date Controls Instead

Some deadlines are measured from mailing, not receipt, and the IRS notice of deficiency is the most important example. When the IRS sends the formal letter proposing additional tax, you have 90 days to petition the Tax Court, and the clock starts from the date the IRS mails the notice.8Office of the Law Revision Counsel. 26 USC 6213 – Restrictions Applicable to Deficiencies; Petition to Tax Court If you are outside the United States, the window is 150 days from mailing. The IRS must send the notice to your last known address by certified or registered mail, but the notice is valid even if you never actually receive it, as long as it was properly addressed.9Internal Revenue Service. IRM 4.8.9 – Statutory Notices of Deficiency If you have moved and have not updated your address with the IRS, the 90-day clock can expire before you know a notice was sent.

Receipt Dates in Mortgage and Consumer Transactions

Two receipt-driven rules in consumer finance catch borrowers off guard more than others.

Closing Disclosure Timing

Federal mortgage rules require that you receive your Closing Disclosure at least three business days before your loan closes.2Consumer Financial Protection Bureau. TILA-RESPA Integrated Disclosure FAQs If the lender mails the disclosure instead of handing it to you, they must add three business days for delivery, meaning they effectively need to mail it six business days before closing. If certain terms change after you receive the initial disclosure, such as the interest rate becoming inaccurate, the loan product changing, or a prepayment penalty being added, the lender must issue a corrected disclosure and wait another three business days before closing.

Right of Rescission

On certain home-equity loans and refinances of a primary residence, you have the right to cancel until midnight of the third business day after the latest of three events: the closing itself, delivery of all material disclosures, and delivery of the rescission notice explaining your cancellation rights.10eCFR. 12 CFR 1026.23 – Right of Rescission The receipt date of those disclosures controls when the window opens. If the lender never delivers the required notice, the right to cancel extends to three years after closing.

Constructive Receipt of Income for Tax Purposes

Cash-method taxpayers, which includes most individuals, report income in the year they receive it or when it becomes available without substantial restrictions. You cannot push income into next year by asking a payer to hold your check until January. If the money was available to you in December, it is December income. This trips up freelancers who receive a late-year payment, business owners whose customers prepay, and anyone settling a lawsuit near year-end. Settlement funds landing in your attorney’s trust account on December 28 are generally your income for that tax year, even if the check does not reach your personal bank account until January.

Proving the Date

Knowing the rule is only half the battle. You need evidence that holds up.

Certified mail return receipts and private carrier tracking records with delivery signatures are the strongest proof for physical mail. A signed USPS green card or a FedEx delivery record showing a recipient’s signature creates a clear date that is hard to contest. Packages left without a signature weaken the proof considerably, because a photo of a box on a doorstep does not establish who picked it up or when.

For electronic communications, email server logs and system timestamps carry the load. These records show exactly when a message reached the recipient’s mail server, independent of when anyone opened it. Court e-filing systems generate automatic confirmation receipts tied to the filing timestamp. Where no automated record exists, an affidavit of service fills the gap. A process server or other individual files a sworn statement describing the date, time, location, and manner of delivery, and challenging it requires more than a simple denial of receipt.

Deadlines the Receipt Date Triggers

Once the receipt date is set, it becomes the starting line for countdowns that vary by context.

Missing these deadlines rarely produces a second chance. A late answer in federal court can bring a default judgment. A late Tax Court petition means the IRS assessment becomes final and collectible. A missed rescission window means the right to cancel is gone. When the stakes are this high, count your deadline from the earliest plausible receipt date, not the latest.
