Your Marriage Certificate Is the Legal Document
You do not need a court order to take your spouse’s last name. In most states, the certified marriage certificate itself is the legal authorization for your new name, and USCIS accepts it as sufficient evidence of a legal name change when updating immigration documents.1U.S. Citizenship and Immigration Services. A court petition only comes into play in narrow situations: you want a name that isn’t your spouse’s surname, your state has unusual requirements, or a specific agency asks for one. Filing fees for a court-ordered change run roughly $25 to $500 depending on the state, and some states require publication in a local newspaper, which can add $120 to over $2,000.

Check DACA’s Status Before You File
DACA remains under active legal challenge. As of early 2025, a federal court order prohibits USCIS from granting initial DACA requests, but the agency continues to accept and process renewals for people who received DACA before July 16, 2021.3U.S. Citizenship and Immigration Services. Step 1: Update Your Social Security Card
Start with SSA. Nearly every other agency, including USCIS and the DMV, will eventually want to see that your Social Security record already matches your new legal name.

Bring your certified marriage certificate, your current Social Security card, and immigration documents proving your lawful status, typically your Employment Authorization Document. There’s no fee. The new card usually arrives within two weeks.
Step 2: Update Your Name With USCIS
How you handle USCIS depends on where you are in your DACA cycle.
Update at Your Next Renewal
The simplest path. When you file, use your new legal name on Form I-821D and Form I-765, and include the marriage certificate as supporting evidence.6U.S. Citizenship and Immigration Services. The tradeoff: until then, your EAD still shows your old name, which can create friction with employers.
File for a Replacement EAD Now
If you can’t wait for renewal, file a new Form I-765 for a replacement card with your corrected name, and include the marriage certificate.1U.S. Citizenship and Immigration Services. Current USCIS Fees
Older articles list a $495 fee that no longer applies. Under the current fee schedule:

Step 3: Tell Your Employer
Every U.S. employer verifies identity and work authorization on Form I-9.9U.S. Citizenship and Immigration Services. Your employer may ask to see and copy your marriage certificate for their I-9 file. Most will also want the updated Social Security card and the new EAD once it arrives. Tell payroll early so nothing gets flagged in an audit.
Step 4: Driver’s License, Passport, and Other IDs
Driver’s License or State ID
Go to your state DMV after the Social Security card update lands. Typical requirements: updated Social Security card, marriage certificate, and current ID. Fees and specifics vary by state, so check the DMV website before you go. Many states let you book an appointment online.
U.S. Passport
If you hold a U.S. passport and your name changed within one year of its issuance, you can update it for free using Form DS-5504. Selective Service
Male DACA recipients ages 18 to 25 are required to be registered with the Selective Service. After a legal name change, call Selective Service directly to update your record. Name changes can’t be submitted online.13Selective Service System. Update Your Information
Banks and Credit Cards
Update your bank, credit cards, and other financial accounts after the DMV, so you have a matching photo ID to show them. Most will also want a copy of the marriage certificate.
Taxes and the IRS
The IRS matches the name and Social Security number on your return against SSA records. A mismatch, whether because you filed under a new married name before updating SSA or the reverse, can delay processing and hold up refunds.14Internal Revenue Service. If you also moved after the wedding, file Form 8822 with the IRS to update your address. The form has a line for the new name too.15Internal Revenue Service. Form 8822, Change of Address There’s no fee, and it keeps notices and refund checks from going astray.
Advance Parole Adds Complexity
If you’ve applied for or received advance parole on Form I-131, a name change needs extra attention. The name on that travel document has to match your passport and other ID at re-entry.

Sort this out before you travel; a mismatch can turn re-entry into extended secondary inspection.
When to Call an Immigration Attorney
A straightforward name change, where you’re taking your spouse’s surname, your DACA is up for renewal, and you have no criminal history, is manageable on your own with careful paperwork. Attorneys earn their fee in edge cases: you want an entirely different name, you have a pending removal case, your DACA has lapsed, or you’re coordinating a name change with an advance parole trip or an adjustment of status application.
Look for someone with specific DACA experience rather than general immigration practice. Legal aid organizations and nonprofit immigration clinics often offer reduced-fee or free consultations, and many law school clinics handle DACA renewals. Given the ongoing court challenges to the program, a quick review before you file can catch issues a government website won’t flag.
