Credit One Arbitration Agreement: Opt-Out, Scope, and Costs

The Credit One arbitration agreement is a clause in the bank’s cardholder agreement that pushes almost any dispute you have with the bank out of court and into a private arbitration process, where a single arbitrator decides the outcome instead of a judge or jury. You can reject the clause, but only by sending a written opt-out notice within 45 days of opening your account.1Justia Law. Brown v. Credit One Bank, No. 1:2023cv23008 – Document 13 (D.N.J. 2024) Miss that window and the clause locks in for the life of the account, and beyond.

What Rights You Give Up

Accepting the card agreement means accepting two waivers most cardholders never notice. You give up your right to a jury trial, and you give up your right to bring or join a class action against the bank.2Credit One Bank. Cardholder Agreements Any dispute goes to one arbitrator, in private, with no public record and no ruling that sets precedent for anyone else.

The class action waiver is the piece that reaches the most people. When a bank charges the same improper fee to thousands of customers, a class action lets a single case fix the problem for everyone. Without it, each customer fights alone, and small-dollar claims rarely justify the effort.

These clauses have federal backing. The Federal Arbitration Act treats written arbitration agreements in commercial contracts as enforceable to the same degree as any other contract, which is what gives Credit One’s clause its bite.3Office of the Law Revision Counsel. 9 U.S. Code 2 – Validity, Irrevocability, and Enforcement of Agreements to Arbitrate Courts can refuse to enforce arbitration agreements only on the narrow grounds that would invalidate any contract, such as fraud or duress.

How to Opt Out Within 45 Days

Credit One gives you a way out, but the window is short. Send a written rejection notice within 45 days of accepting the card agreement.1Justia Law. Brown v. Credit One Bank, No. 1:2023cv23008 – Document 13 (D.N.J. 2024) One day late and the clause is permanent for that account.

Your opt-out letter should list your name, account number, and a clear statement that you reject the arbitration provision. Send it by certified mail so you have proof of delivery. The mailing address for opt-out notices appears in the arbitration section of your card agreement; the current version is posted on Credit One’s website if you no longer have your copy.2Credit One Bank. Opting out changes nothing else about the account. Your interest rate, credit limit, and every other term stay the same. The only thing you keep is your access to the courts if something goes wrong later. Given the cost is a stamp and a few minutes, it’s worth doing even if you never expect a problem.

What Disputes the Clause Covers

The clause casts a wide net. It covers disputes over account terms, interest rates, fees, billing errors, unauthorized transactions, and the bank’s services, and it also reaches claims of fraud, misrepresentation, and breach of contract. In practice, almost any disagreement with Credit One falls inside it.

Small Claims Court Is Still Available

One carve-out matters. You can still bring an individual claim in small claims court without triggering arbitration, as long as the case stays there and seeks only individual relief.2Credit One Bank. Cardholder Agreements Small claims courts handle disputes up to a dollar cap that varies by state, and filing fees are usually modest.

This is a useful exception because most credit card disputes involve smaller amounts, like a single disputed charge or an unexpected fee. If your claim fits under your state’s cap, you can skip arbitration and file in a local court, which is often faster and easier to navigate without a lawyer.

Claims Federal Law Keeps Out of Arbitration

Federal law carves certain claims out of forced arbitration regardless of what the contract says. Since 2022, disputes involving sexual harassment or sexual assault cannot be pushed into mandatory arbitration.3Office of the Law Revision Counsel. 9 U.S. Code 2 – Validity, Irrevocability, and Enforcement of Agreements to Arbitrate That exception is more common in employment cases but applies to any arbitration agreement under the Federal Arbitration Act.

Closing the Account Doesn’t End the Clause

Canceling the card does not release you from arbitration. Credit One’s agreements include a survival provision keeping the arbitration clause in effect after the account is closed, transferred, or sold to a third party, and through bankruptcy.4Credit One Bank. Deposit Agreement Disclosures A billing dispute or fraud claim that surfaces after you close the card still goes to arbitration.

That’s why the 45-day window carries so much weight. Once it closes, you can’t escape the clause by canceling. The only remaining route is arguing in court that the clause itself is unenforceable, which is a steep climb.

Active-Duty Service Members Are Protected

If you’re on active military duty, federal law overrides the arbitration clause. The Military Lending Act makes it illegal for a creditor to require a service member or military dependent to submit to arbitration as a condition of consumer credit.5Office of the Law Revision Counsel. 10 U.S. Code 987 – Terms of Consumer Credit Extended to Members and Dependents Any agreement to arbitrate a consumer credit dispute is unenforceable against a covered service member or dependent, whatever the contract says.6Consumer Financial Protection Bureau. Military Lending Act (MLA)

This overrides the Federal Arbitration Act’s general rule favoring enforcement. It applies to credit cards, payday loans, and other consumer credit covered by the MLA. A covered service member with a Credit One card keeps full court access, including the ability to join class actions.

Starting Arbitration If You’re Bound by the Clause

Past the 45-day window with a dispute worth pursuing? The agreement requires a specific sequence before you can file.

Send a Notice of Dispute First

Mail a written Notice of Dispute to Credit One at P.O. Box 6050, Sioux Falls, SD 57117-6050.2Credit One Bank. Cardholder Agreements Include your name, address, phone number, and account number; a description of what happened and why you believe Credit One is at fault; and the specific dollar amount or other remedy you want.

Credit One then has 30 days to respond and try to resolve the dispute. If the bank fixes it in that window, arbitration is off the table. If not, or if the response falls short, you can move forward.2Credit One Bank. Cardholder Agreements

File With the American Arbitration Association

Credit One’s card agreement designates the American Arbitration Association (AAA) to administer proceedings. Filing requires a Demand for Arbitration, a copy of the arbitration clause from your agreement, and the appropriate filing fee.7American Arbitration Association. AAA Arbitration Services The AAA then notifies Credit One and sets a response deadline.

Do not skip the Notice of Dispute step. Filing directly with the AAA before giving Credit One its 30 days invites a procedural objection that can dismiss or delay the case.

What Arbitration Costs

Arbitration isn’t free, though consumer cases typically cost less than full litigation. Fees split between the provider’s filing and administrative charges and the arbitrator’s own hourly rate.

For consumer disputes handled by JAMS, another major arbitration provider, the consumer’s filing fee is capped at $250.8JAMS. Arbitration Schedule of Fees and Costs The AAA has a similar consumer fee structure, with the exact amount tied to claim size and applicable rules. Many credit card arbitration agreements make the bank cover the remaining administrative costs, but the split depends on your specific card agreement.

Arbitrator hourly rates at major providers run from roughly $300 to over $1,000, with higher rates in large markets like New York and Los Angeles. Straightforward consumer disputes usually don’t require much arbitrator time, but complex cases involving fraud or larger dollar amounts push costs up quickly. Some agreements cap the consumer’s share or require the bank to pay the arbitrator’s fees outright. Read the fee provision before filing.

One cost trap: arbitration agreements sometimes limit the arbitrator’s authority to award attorney fees or punitive damages, even where a court could grant both. If you’re thinking about hiring a lawyer, factor in that you may not recover those fees even if you win.

How Courts Treat These Clauses

When a dispute reaches court and Credit One moves to compel arbitration, the Federal Arbitration Act tells the court to pause the case and send the parties to arbitration, so long as the agreement is valid.9Office of the Law Revision Counsel. 9 U.S. Code 3 – Stay of Proceedings Where Issue Therein Referable to Arbitration Courts enforce these clauses even when the consumer never read or fully understood the terms, which is why the opt-out window matters so much.

Courts can still refuse enforcement in narrow situations. The most common successful challenge is unconscionability, where a judge finds the clause so one-sided that it shocks the conscience. Courts look at whether the clause was hidden in fine print, whether the consumer had any realistic room to negotiate, and whether the terms themselves are unreasonably stacked. These challenges succeed more often at the state level, but they remain difficult given the federal presumption in favor of arbitration.

Once an arbitrator issues a decision, appeal options are extremely limited. Courts vacate arbitration awards only in rare cases, such as arbitrator corruption, fraud, or a fundamental procedural failure. Disagreeing with how the arbitrator read the facts or the law is not enough. For most consumers, the arbitrator’s decision is the end of it.
