A construction safety policy template is the written document a construction employer uses to satisfy the accident-prevention program required by 29 CFR 1926.20, and it needs to cover named responsibilities, hazard-specific procedures, incident reporting deadlines, and worker participation. Federal law does not hand you a fill-in-the-blank form. It tells you what your program must accomplish, and your template is the evidence that you built one. Get the sections below right and you have a document that holds up to an OSHA inspection. Leave them vague and you have paper that increases your exposure rather than reducing it.
The Legal Basis for the Document
Two provisions drive the requirement. The General Duty Clause of the OSH Act obligates every employer to provide a workplace “free from recognized hazards that are causing or are likely to cause death or serious physical harm.”1Occupational Safety and Health Administration. 29 USC 654 – Duties For construction specifically, 29 CFR 1926.20 requires employers to initiate and maintain accident prevention programs that include frequent and regular inspections of the job site, materials, and equipment by competent persons the employer designates.2eCFR. 29 CFR 1926.20 – General Safety and Health Provisions The written policy is how you document that program, and OSHA inspectors routinely ask to see it.
One boundary before you build. About half the states run their own OSHA-approved plans that must be at least as effective as federal standards, and some go further with additional training hours or reporting duties.3Occupational Safety and Health Administration. State Plans Meet the federal minimums below as a baseline, then check whether your state plan layers anything on top.
Administrative Foundations
Start with the company information every inspector looks for first. Use your legal business name as registered with the state, not a trade name. Identify the designated competent person by name and contact. The regulations define this role as someone capable of identifying existing and foreseeable hazards and authorized to take immediate corrective action.4Occupational Safety and Health Administration. 29 CFR 1926.32 – Definitions Several construction standards require a competent person for specific operations, so name one for each: excavations, scaffolding, fall protection, and steel erection at minimum.
Each active project needs a site-specific addendum. Include the project address, the nearest hospital or emergency medical facility with phone number, and local emergency response numbers. Provisions for prompt medical attention must be in place before construction starts.5eCFR. 29 CFR 1926.50 – Medical Services and First Aid Where 911 is not available, those emergency numbers must be conspicuously posted. Identify where the first aid kit lives and who holds current certification. OSHA publishes sample programs that can serve as a starting skeleton, but every personnel field, medical provider, and phone number must be filled in accurately.6Occupational Safety and Health Administration. Fall Protection
Falls are consistently the most cited construction hazard, so this section deserves specificity. Under Subpart M, fall protection is required whenever employees work six feet or more above a lower level, and the employer must provide guardrails, safety nets, or personal fall arrest systems.7Occupational Safety and Health Administration. 29 CFR 1926.501 – Duty to Have Fall Protection The default requirement varies by activity, so your policy should state which system applies to each type of work your crews perform.
When personal fall arrest systems are used, anchorage points must support at least 5,000 pounds per employee attached, unless the system is designed by a qualified person with a safety factor of at least two.8eCFR. 29 CFR 1926.502 – Fall Protection Systems Criteria and Practices Identify who inspects harnesses and lanyards before each use, how often anchor points are load-tested, and the procedure for pulling damaged equipment from service.
Scaffold Safety
Scaffold requirements differ from general fall protection. Fall protection on scaffolds is triggered at ten feet above a lower level rather than six.9eCFR. 29 CFR 1926.451 – General Requirements for Scaffolds Every scaffold must be designed by a qualified person and built to carry at least four times its maximum intended load. A competent person must inspect scaffolds for visible defects before each work shift and after any event that could affect structural integrity.
Address who is authorized to erect, move, and dismantle scaffolds, since the regulation limits those tasks to experienced and trained employees working under a competent person’s supervision. Include daily inspection procedures and the criteria for pulling a scaffold out of service. If your crews use both supported and suspended scaffolds, cover each separately because the guardrail heights and fall arrest obligations differ.
Electrical Safety and Lockout/Tagout
Subpart K covers electrical hazards. Your template must require ground-fault circuit interrupters or an assured equipment grounding conductor program for all 120-volt, single-phase, 15- and 20-ampere receptacle outlets on the job site. These outlets power tools and temporary lighting, and electrocution from unprotected circuits is one of the “Fatal Four” construction hazards.
The policy must also spell out lockout and tagging procedures. Under 29 CFR 1926.417, controls being deactivated during work on equipment or circuits must be tagged, and deenergized equipment must be rendered inoperative with tags placed at every point where it could be reenergized.10eCFR. 29 CFR 1926.417 – Lockout and Tagging of Circuits State who has authority to lock out a circuit, where locks and tags are stored, and the verification procedure before anyone touches supposedly dead equipment.
Hazard Communication and PPE
Include a written hazard communication program covering every chemical employees could encounter. The standard requires you to maintain Safety Data Sheets, label chemical containers, and train workers on the specific substances they handle.11eCFR. 29 CFR 1910.1200 – Hazard Communication On construction sites this typically means adhesives, solvents, concrete additives, and coatings. Designate who maintains the Safety Data Sheet binder or electronic access point and how new chemicals are added on arrival.
Personal protective equipment under Subpart E is driven by a hazard assessment, not a blanket checklist. Evaluate the workplace, identify hazards, and provide appropriate protection for eyes, face, head, and extremities.12eCFR. 29 CFR Part 1926 Subpart E – Personal Protective and Life Saving Equipment Hard hats and eye protection are nearly universal. High-visibility vests are specifically required for flaggers, workers in excavations near vehicular traffic, and employees in highway or road construction work zones, not across all construction activities.13Occupational Safety and Health Administration. Excavation and Trenching
Any trench five feet or deeper requires a protective system such as sloping, shoring, or shielding, unless the excavation is made entirely in stable rock. Protection is also needed in shallower trenches if a competent person sees any indication of potential cave-in.14Occupational Safety and Health Administration. 29 CFR 1926.652 – Requirements for Protective Systems
Your template should require a competent person to inspect every trench at the start of each shift, after any rainstorm or water intrusion, and following any occurrence that could change conditions inside the excavation.15Occupational Safety and Health Administration. Trenching and Excavation Safety Name the protective system your company uses as its default, the conditions that trigger an upgrade, the competent person by title, and the inspection documentation you keep.
Silica and Fire Prevention
Cutting concrete, brick, or stone generates respirable crystalline silica. The construction silica standard requires employers to either follow OSHA’s Table 1 engineering controls for each tool type or conduct air monitoring and develop a written exposure control plan. For handheld power saws cutting masonry, Table 1 requires an integrated water delivery system that continuously feeds water to the blade, and the saw must be operated per the manufacturer’s instructions.16Occupational Safety and Health Administration. 29 CFR 1926.1153 – Respirable Crystalline Silica Specify which Table 1 controls apply to your tools and designate responsibility for maintaining the dust suppression equipment.
For fire protection, a fire extinguisher must be within 100 feet of travel from any point in a protected area.17Occupational Safety and Health Administration. 29 CFR 1926.150 – Fire Protection Map extinguisher placement to the site layout, identify who inspects them, and describe the hot work permit process for welding, cutting, or brazing.
Multi-Employer Worksite Duties
Construction sites almost always involve multiple employers, and OSHA can cite more than the offending subcontractor. Under the multi-employer citation policy, four categories of employers can be held responsible for the same hazard:
- The creating employer, which caused the hazardous condition.
- The exposing employer, whose workers are exposed to the hazard.
- The correcting employer, responsible for fixing the hazard, usually by contract.
- The controlling employer, with general supervisory authority over the site, typically the general contractor.18Occupational Safety and Health Administration. Multi-Employer Citation Policy
If you are a general contractor, your policy must address the controlling employer’s duty to exercise reasonable care in preventing and detecting hazards across the entire site. Describe the inspection frequency, the competent person assigned to conduct walkthroughs, and the process for documenting and correcting violations by subcontractors. Require every subcontractor to sign an acknowledgment that they received your safety policy and agree to follow it. That paper trail matters if OSHA cites you for a subcontractor’s violation and you need to show reasonable care.
Fatality and Severe Injury Reporting
The template must include the reporting timelines federal law imposes after serious incidents, because missing them is a separate violation. A work-related fatality must be reported to OSHA within 8 hours. An in-patient hospitalization, amputation, or loss of an eye must be reported within 24 hours.19Occupational Safety and Health Administration. 29 CFR 1904.39 – Reporting Fatalities, Hospitalizations, Amputations, and Losses of an Eye The clock starts when the employer or its agent learns the incident is work-related, not necessarily when the injury occurs.
Reports can be made by calling the nearest OSHA area office, using the toll-free number 1-800-321-6742, or submitting electronically through OSHA’s website. List all three options and designate who in the company is responsible. The fatality reporting obligation applies only to deaths within 30 days of the incident, and the hospitalization obligation applies only when the admission occurs within 24 hours. Include these thresholds so supervisors don’t waste critical time debating whether a report is required. Separately, many construction employers must submit their OSHA 300A summary data annually through the Injury Tracking Application.20Occupational Safety and Health Administration. Worker Participation and Anti-Retaliation
OSHA recommends building worker participation into every phase of the program: identifying hazards, developing solutions, conducting inspections, investigating near misses, and evaluating effectiveness.21Occupational Safety and Health Administration. Safety Management – Worker Participation Your template should establish a safety committee that includes non-supervisory employees and describe how workers can report hazards without going through the chain of command. Anonymous reporting reduces the fear that keeps hazards hidden.
Section 11(c) of the OSH Act prohibits retaliation against workers who report safety concerns, refuse dangerous work, or file OSHA complaints. An employee facing retaliation has 30 days from the adverse action to file a complaint.22Occupational Safety and Health Administration. Protection From Retaliation for Engaging in Safety and Health Activity Under the OSH Act State explicitly that no employee will face discipline for reporting hazards and that all workers have the right to request an OSHA inspection. Include a stop-work authority provision: any worker can shut down an activity they believe is unsafe. Crews that know they can pause a questionable operation without getting chewed out will use that authority at the moments it matters most.
Implementation and Review
A finished template sitting in a filing cabinet protects nobody. Every worker on site needs to receive the policy and understand it before starting work. Run a documented safety orientation for new hires combined with regular toolbox talks that rotate through specific sections. Keep sign-in sheets. Have subcontractors sign an acknowledgment form.
Keep the physical policy accessible at the job site, whether in the main trailer, at a central safety board, or through a digital platform workers can pull up on their phones. Inspectors check whether employees can look up a procedure without tracking down a supervisor. Maintain a master copy in corporate records alongside your OSHA 300 logs and incident documentation. Gaps between those records raise questions about whether the program is real.
Review the policy on a set schedule and whenever conditions change. Trigger points for immediate review include a new type of work being added to the project scope, a near-miss incident, a change in subcontractors, or an OSHA standards update. Assign ownership by title, not by “management,” so the task doesn’t fall through the cracks.
What Gaps Cost
For 2026, OSHA’s maximum penalty for a serious or other-than-serious violation is $16,550 per instance. A willful or repeated violation carries a maximum of $165,514 per instance.23Occupational Safety and Health Administration. 2026 Annual Adjustments to OSHA Civil Penalties These are per-violation figures, and a single inspection can produce dozens of citations across multiple standards. A site with unprotected floor openings, missing scaffold guardrails, and no lockout tags on deenergized equipment could face six-figure exposure from one visit.
A serious violation means the employer should have known about the hazard. A willful violation means the employer knew and ignored it, or showed plain indifference. An actively enforced written policy is one of the strongest defenses against a willful classification. A boilerplate document nobody has read makes the willful argument easy for OSHA to build.
