You can file Form I-140 and Form I-485 at the same time whenever a visa number is immediately available in your employment-based category on the day USCIS receives the package. Concurrent filing of I-140 and I-485 collapses what would otherwise be two sequential waits into a single filing, and it gives you work authorization, a travel document, and the start of the 180-day job portability clock much earlier than if you waited for the I-140 to be approved first.
Who Can File Concurrently
The gate is visa availability. Federal regulations require that an immigrant visa be immediately available before you can properly file an adjustment application, and USCIS will reject the I-485 outright if no number is available on the filing date.1eCFR. 8 CFR 245.2 – Application
Availability is set month by month in the Department of State’s Visa Bulletin, which publishes a Final Action Dates chart and a Dates for Filing chart.2U.S. Department of State. The Visa Bulletin USCIS announces each month which chart governs new I-485 filings. A “C” (current) in your category and country means you can file. A date means your priority date must fall earlier than that date. Your priority date is normally the day your employer filed the labor certification with the Department of Labor, or the day the I-140 was filed if no labor certification was required.
The employment-based classifications that can be filed concurrently are EB-1 (priority workers, including people with extraordinary ability, outstanding professors and researchers, and multinational executives), EB-2 (professionals with advanced degrees or exceptional ability), and EB-3 (skilled workers and professionals).3U.S. Citizenship and Immigration Services. Green Card for Employment-Based Immigrants EB-2 National Interest Waiver applicants can also file concurrently, and because the NIW waives the job offer requirement, they can self-petition without an employer sponsor.
You also need to be physically present in the United States and maintaining valid nonimmigrant status at the time of filing to avoid admissibility problems.
What Concurrent Filing Gets You
Immediate Work and Travel Authorization
Once you have a pending I-485, you can file Form I-765 for an Employment Authorization Document and Form I-131 for advance parole. Filed together, they produce a single combination card that serves as both work permit and travel document.4U.S. Citizenship and Immigration Services. USCIS to Issue Employment Authorization and Advance Parole Card for Adjustment of Status Applicants There is no separate filing fee for I-765 or I-131 when they are based on a pending I-485. If you wait for I-140 approval before filing the I-485, you also wait for the EAD and advance parole.
The 180-Day Portability Clock Starts Sooner
Under INA Section 204(j), once your I-485 has been pending for 180 days or more and you have an approved or approvable I-140, you can move to a new employer in the same or a similar occupation without losing your place in line.5Office of the Law Revision Counsel. 8 USC 1154 – Procedure for Granting Immigrant Status The 180-day count starts the day USCIS receives a properly filed I-485.6U.S. Citizenship and Immigration Services. Job Portability after Adjustment Filing and Other AC21 Provisions Filing concurrently means that clock begins months earlier than it would if you filed the I-485 only after I-140 approval.
H-1B Extensions Beyond Six Years
If you are on H-1B, a pending or approved I-140 unlocks extensions past the usual six-year cap. With an approved I-140 and no available visa number, your employer can request H-1B extensions in three-year increments. If the I-140 is not yet approved but a labor certification or immigrant petition was filed on your behalf at least 365 days ago, one-year extensions are available.7U.S. Citizenship and Immigration Services. FAQs for Individuals in H-1B Nonimmigrant Status For workers from backlogged countries, this is often what keeps them legally employed during a multi-year wait.
Protection for Children Approaching 21
If you have a child getting close to 21, concurrent filing can be decisive. The Child Status Protection Act calculates a child’s age as their age on the date a visa becomes available, minus the number of days the I-140 was pending before approval.8U.S. Citizenship and Immigration Services. Child Status Protection Act (CSPA) To keep the benefit, the child must “seek to acquire” permanent resident status within one year of a visa becoming available, and filing Form I-485 satisfies that requirement. Submitting the child’s I-485 concurrently locks in eligibility on the earliest possible date rather than after weeks or months waiting for the I-140 to be approved.
What Goes in the Package
Form I-140 is the employer’s petition. It establishes that the employer has a real job offer and can pay the offered wage, supported by tax returns, annual reports, or audited financial statements for each year since the priority date. Employers with 100 or more workers can substitute a statement from a financial officer.9U.S. Citizenship and Immigration Services. USCIS Policy Manual Volume 6 – Immigrants Part E Chapter 4 – Ability to Pay The petition must state the correct EB classification, and if the job required a labor certification, include the certified ETA Form 9089.
Form I-485 is your adjustment application. It collects biographical data, residential and employment history, a complete record of every U.S. entry, and detailed answers on criminal history and other admissibility factors.10U.S. Citizenship and Immigration Services. Instructions for Form I-485, Application to Register Permanent Residence or Adjust Status Supporting documents include your birth certificate, passport copies, educational credentials, and employment verification letters. Every name and date should match across the I-140 and I-485; inconsistencies are a common cause of Requests for Evidence.

I-693, Report of Immigration Medical Examination and Vaccination Record For any I-693 signed on or after November 1, 2023, the form is valid only while the application it was submitted with is pending; if the I-485 is denied or withdrawn, a new exam is needed for any future filing.12U.S. Citizenship and Immigration Services. Fees
Form I-140 costs $715. Form I-485 costs $1,440 for applicants 14 and older, and $950 for children under 14 filing with a parent.14U.S. Citizenship and Immigration Services. Form G-1055 Fee Schedule Payment can be made by check (one per form) or credit card using Form G-1450. Fees are adjusted periodically, so confirm the current amounts before filing.
Premium processing on the I-140 is optional. Form I-907 carries an additional $2,965 fee effective March 1, 2026.15Federal Register. Adjustment to Premium Processing Fees It guarantees USCIS action on the I-140 within 15 business days for most EB classifications, or 45 business days for multinational executive/manager and NIW cases.16U.S. Citizenship and Immigration Services. How Do I Request Premium Processing? “Action” can mean approval, denial, a Request for Evidence, or a notice of intent to deny. There is no premium processing option for the I-485 itself.
Where to File
A concurrent I-140/I-485 package goes to the USCIS Dallas Lockbox. After acceptance, USCIS issues Form I-797C receipt notices for each application.18U.S. Citizenship and Immigration Services. Form I-797C, Notice of Action A biometrics appointment notice follows. The median processing time for employment-based I-485 applications runs roughly six months, though individual cases vary with EB category, country of birth, and whether a Request for Evidence is issued.19USCIS. While the Case Is Pending
Once the EAD or combo card is issued, you can work for any U.S. employer, not only the sponsor. H-1B holders can choose to keep working on H-1B instead, which preserves H-1B protections and simplifies international travel.
Travel is the trap. Leaving the country while the I-485 is pending without an advance parole document causes USCIS to treat the application as abandoned.20U.S. Citizenship and Immigration Services. While Your Green Card Application Is Pending with USCIS H-1B holders in valid status can travel and return without advance parole if they have a valid H-1B visa stamp and are returning to the same employer; L-1 holders have a parallel exception.7U.S. Citizenship and Immigration Services. FAQs for Individuals in H-1B Nonimmigrant Status Everyone else should have the advance parole document in hand before any international trip.
USCIS requires an interview for all adjustment applicants unless it waives the interview case by case.21U.S. Citizenship and Immigration Services. Chapter 5 – Interview Guidelines Employment-based cases are not among the categories that routinely get waivers, but USCIS has in practice waived interviews for many straightforward EB cases in recent years. If an interview is scheduled, bring originals of everything you submitted plus current employment letters and pay stubs.
If you move, notify USCIS within 10 days using Form AR-11 or the online address change tool.22U.S. Citizenship and Immigration Services. AR-11, Alien’s Change of Address Card A missed biometrics or interview notice can end the case.
Changing Employers Under AC21
After the I-485 has been pending 180 days and you have an approved or approvable I-140, you can port to a new employer whose position is in the same or a similar occupational classification. The port is documented on Form I-485 Supplement J, which the new employer completes to confirm the job offer.23U.S. Citizenship and Immigration Services. I-485 Supplement J, Confirmation of Valid Job Offer or Request for Job Portability Under INA Section 204(j) Supplement J is not part of the initial concurrent filing; it is used when you change jobs or when USCIS asks you to confirm the original offer is still valid.
“Same or similar” is judged on the totality of the circumstances, including Department of Labor occupational codes, duties, required skills, education, and salary.6U.S. Citizenship and Immigration Services. Job Portability after Adjustment Filing and Other AC21 Provisions A move between two software engineering roles is straightforward. A move from software engineering to product management is where portability disputes tend to arise. Applicants classified as EB-1 Extraordinary Ability or with an approved National Interest Waiver do not file Supplement J and are not bound by the portability framework, because those classifications are not tied to a specific employer’s job offer.
If the Employer Withdraws the I-140
If the I-140 was approved for at least 180 days before withdrawal, or if the I-485 has been pending for at least 180 days, the approved petition remains valid. You keep the priority date and can port to a new employer in the same or similar occupation.6U.S. Citizenship and Immigration Services. Job Portability after Adjustment Filing and Other AC21 Provisions USCIS can still revoke on substantive grounds like fraud, but a simple employer withdrawal past 180 days does not destroy the case.
Withdrawal before that 180-day mark, and before the I-140 has been approved for 180 days, leaves the I-485 without an underlying basis and it will be denied. This is a common reason to pay for premium processing on the I-140 in a concurrent filing: an early approval starts the 180-day protection clock much sooner.
If the I-485 Is Denied
A denied I-485 does not by itself trigger removal. If you still hold valid nonimmigrant status such as H-1B at the time of denial, you can remain under that status until it expires. If your only authorized presence was the pending I-485, you are out of status the day after the denial and begin accruing unlawful presence.
You have 30 days from the denial date to file a motion to reopen with new evidence, or a motion to reconsider arguing legal or factual error. USCIS may issue a Notice to Appear in immigration court, where a new adjustment application can be presented before a judge, or it may deny without initiating court proceedings, leaving refiling, consular processing, or another remedy as options. Move quickly and get qualified legal advice before options narrow.
