To change a representative payee on a Social Security account, the person who wants to take over files Form SSA-11 (Request to be Selected as Payee) with the Social Security Administration and sits for an interview at a local field office. SSA then runs a background check, gives the current payee 15 days’ advance notice, and, if no valid objection comes in, appoints the new payee. Start to finish, the change usually takes 30 to 60 days.
Why Payee Changes Happen
The most common trigger is the current payee’s death, which needs an immediate replacement so benefits are not interrupted. SSA will also remove a payee who misuses benefits, fails to meet the beneficiary’s basic needs, or stops filing the required annual accounting report. A payee whose own health declines, or who moves far from the beneficiary, may no longer be able to serve. Any of these situations can prompt SSA to act on its own or in response to a request from the beneficiary, a family member, or another concerned party.
If you suspect the current payee is misusing a beneficiary’s funds, you can report it to SSA’s Office of the Inspector General at oig.ssa.gov or by calling 1-800-269-0271. A payee who misuses benefits is personally liable for repaying every dollar.1Social Security Administration. Code of Federal Regulations 416-0641 – Who Is Liable if Your Representative Payee Misuses Your Benefits When the payee is an organization or an individual serving 15 or more beneficiaries, SSA repays the beneficiary regardless of whether it recovers the money. For individual payees serving fewer beneficiaries, SSA repays only if its own negligence contributed to the misuse.
Filing Form SSA-11
The process starts with Form SSA-11, “Request to be Selected as Payee.”2Social Security Administration. POMS GN 00502.115 – The SSA-11-BK, Request to be Selected as Payee You can pick up a paper copy at any Social Security office or download it from ssa.gov. There is no public online submission portal; SSA’s electronic system for payee applications is an internal tool used by field office staff.3Social Security Administration. POMS GN 00502.110 – Taking Applications in the eRPS
The form asks for names, Social Security numbers, and dates of birth for both you and the beneficiary. You will describe your relationship to the beneficiary, their living situation, and why the current payee should be replaced. It also asks whether the beneficiary has a court-appointed legal guardian.4Social Security Administration. Form SSA-11-BK – Request to be Selected as Payee Bring a government-issued ID and, where applicable, guardianship papers, birth certificates, or marriage records that confirm your relationship to the beneficiary.
The Interview
SSA requires an interview with every prospective payee. Most are held face-to-face at a field office, though SSA sometimes conducts them by phone or video.5Social Security Administration. POMS GN 00502.113 – Interviewing the Payee Applicant The claims representative verifies your identity, reviews your SSA-11, and assesses whether you understand a payee’s responsibilities. Mailing or faxing the form does not substitute for the interview; SSA treats mailed forms as leads that still require a follow-up.3Social Security Administration. POMS GN 00502.110 – Taking Applications in the eRPS
Incomplete applications and missing ID will slow things down. Gather documents before the appointment, and confirm the mailing address where benefits should be sent, because that gets locked in during this step.
The 15-Day Notice and Total Timeline
Once SSA has tentatively decided to approve the new payee, it sends the current payee and the beneficiary an advance notice of the change. The current payee has 15 days from the date of that notice to respond or object.6Social Security Administration. POMS GN 00504.240 – Representative Payee or Name Change If the beneficiary contacts SSA during that window to confirm they understand and agree, the office can move forward without waiting the full 15 days. If the current payee contests the change, SSA reviews the objection before finalizing.
After approval, SSA sends a formal notice confirming the appointment and outlining the new payee’s reporting duties. Expect the full process to run 30 to 60 days, depending on how quickly you get an interview appointment, whether the current payee objects, and how complicated the beneficiary’s circumstances are. Benefit payments can be held or delayed during a gap between payees, so getting paperwork in promptly matters.
Who SSA Will Approve
Federal regulations set a preference order that guides SSA’s choice among candidates. For adult beneficiaries, the ranking runs:7eCFR. 20 CFR 404.2021 – What Is Our Order of Preference in Selecting a Payee for You
- A legal guardian, spouse, or other relative with custody or strong concern for the beneficiary’s welfare
- A friend with custody or strong concern for the beneficiary
- A public or nonprofit agency that has custody
- A private, state-licensed institution that has custody
- Any other qualified, willing person, including community volunteers
For beneficiaries under 18, the list starts with a natural or adoptive parent who has custody. The preferences are flexible, not rigid. If the beneficiary previously filed an advance designation naming someone they trust, SSA considers that person first.
Every prospective payee goes through a background check under Section 205(j) of the Social Security Act, and refusing to consent is itself a disqualification.8Social Security Administration. Social Security Act Title II 0205 – Evidence, Procedure, and Certification for Payment SSA re-checks existing payees at least once every five years.9Federal Register. 10Federal Register. Prohibiting Persons With Certain Criminal Convictions From Serving as Representative Payees Anyone previously removed as a payee for misusing benefits is also ineligible.
Handing Off Saved Funds
Any money the outgoing payee has been holding for the beneficiary, called conserved funds, must be turned over when the relationship ends. As a general rule, the outgoing payee returns all conserved funds and any interest to SSA, and SSA reissues the money to the new payee or directly to the beneficiary.11Social Security Administration. POMS GN 00603.055 – Transfer of Conserved Funds
The outgoing payee has 30 days after receiving final notice of the change to return the funds.12Social Security Administration. POMS SI 01120.023 – Return of Conserved Funds by a Representative Payee SSA can approve a direct transfer from the old payee to the new one when the former payee was not removed for misuse, the transfer serves the beneficiary’s interest, and the former payee agrees to complete it within 30 days.11Social Security Administration. POMS GN 00603.055 – Transfer of Conserved Funds If a former payee simply fails to return conserved funds, SSA treats it as potential misuse and opens an investigation.
What the New Payee Signs Up For
Once you are appointed, your job is to use the beneficiary’s payments for their current needs, including food, housing, clothing, utilities, medical care, and personal comfort items. Any money not needed for current expenses is saved for future needs.13Social Security Administration. Frequently Asked Questions for Representative Payees Keep the beneficiary’s funds in a separate account titled to make clear the money belongs to the beneficiary and not to you.
SSA expects detailed records. Hold onto receipts, bank statements, lease agreements, bills, and invoices for at least two years plus the current year, and produce them if SSA asks.14Social Security Administration. Using Funds and Keeping Records Every year, SSA sends an accounting form asking how the benefits were spent and how much was saved; payees 18 and older can file it online. Skipping this annual report is one of the fastest routes to removal and one of the most common reasons SSA initiates a change in the first place.
Naming a Payee in Advance
If you currently receive Social Security, SSI, or Special Veterans Benefits and still manage your own affairs, you can name up to three people you would want as your payee if one is ever needed. SSA calls this advance designation.15Social Security Administration. Advance Designation of Representative Payee You rank your designees in order of preference, and SSA considers them in that order before turning to anyone else.
You can set up or update your advance designation through your my Social Security account, by calling 1-800-772-1213, or by visiting a local office. SSA needs each designee’s name and phone number; the relationship is optional, and no Social Security number for the designee is required.16Social Security Administration. POMS GN 00502.085 – Advance Designation of Representative Payee Organizations cannot be advance designees, and no one can file a designation on your behalf through a power of attorney. An advance designation is not an appointment: when the time comes, SSA still evaluates the person for suitability and runs a background check, and can pass them over if they do not qualify.15Social Security Administration. Removing a Payee to Manage Your Own Benefits
If you are the beneficiary and you want to manage your own money again, the goal is not to swap in a new payee but to remove the payee entirely. SSA does not use a single formal term for this; the request comes down to showing you are mentally and physically capable of handling your finances.17Social Security Administration. FAQs for Beneficiaries Who Have a Representative Payee The key piece of evidence is Form SSA-787, a capability questionnaire completed by your doctor, based on an examination or treatment within the past year. You will also sign an SSA-827 so SSA can obtain your medical records. SSA does not pay for the doctor’s evaluation, so any fee falls on you. Beyond the medical piece, SSA weighs how well you have handled money in daily life, input from people who know you, and your understanding of your financial obligations.18Social Security Administration.
