Certificate of Discharge: Bankruptcy, Mortgage, Tax Lien, and DD 214

A certificate of discharge is an official document confirming that a legal or financial obligation has been fulfilled and, where property is involved, that any related lien has been released. The same phrase shows up in bankruptcy court, mortgage payoffs, IRS lien matters, and military separation paperwork, and what it means for you depends entirely on which situation you’re in. The common thread: it closes the obligation on the record so no one can credibly come back later and claim you still owe.

In Bankruptcy

In a bankruptcy case, the certificate of discharge is a court order that eliminates your personal liability for the debts covered by the case. It works as a permanent injunction. Creditors cannot sue you on those debts, garnish your wages, call, send letters, or take any other collection action.1Office of the Law Revision Counsel. 11 USC 524 – Effect of Discharge This is the mechanism behind bankruptcy’s “fresh start.”

Not every debt is wiped out. Federal law keeps several categories alive regardless of the chapter you filed under:

  • Child support and alimony
  • Most student loans, government-backed and qualified private, unless you separately prove undue hardship
  • Recent income taxes, taxes where no return was filed, and taxes involving fraud
  • Debts obtained by fraud or arising from willful injury to a person or property
  • Criminal restitution, traffic tickets, and similar government fines and penalties
  • Personal injury or death claims caused by intoxicated driving

The statutory list runs longer, but those are the ones that most often surprise filers.2United States Courts. Discharge in Bankruptcy – Bankruptcy Basics

Timing depends on the chapter. In Chapter 7, the court typically grants the discharge about 60 days after the first date set for the meeting of creditors (the “341 meeting”), roughly four months after you file.2United States Courts. One prerequisite catches people out. Before the court will grant a Chapter 7 discharge, you have to complete an approved personal financial management course. Skip it and there is no discharge, however clean the rest of the case was.4Office of the Law Revision Counsel. 11 USC 727 – Discharge This is a separate requirement from the pre-filing credit counseling and is usually available online for a modest fee.

If a Creditor Keeps Trying To Collect

The discharge order is a federal court injunction, not a suggestion. A creditor that keeps trying to collect a discharged debt is violating a court order.1Office of the Law Revision Counsel. 11 USC 524 – Effect of Discharge You can raise the violation with the bankruptcy court, which has the power to hold the creditor in contempt, impose sanctions, and in some cases award you damages. If a collection call surfaces months after your discharge, you don’t have to handle it alone; your bankruptcy attorney or the court can step in.

What It Does Not Do To Your Credit Report

The discharge does not remove the bankruptcy from your credit report. A bankruptcy filing can remain on your report for up to 10 years from the date of the order, whether you filed under Chapter 7, 11, 12, or 13.6Consumer Financial Protection Bureau. How Long Does a Bankruptcy Appear on Credit Reports What the discharge does is confirm that the included debts are no longer owed. Individual discharged accounts should update to a zero balance, and you may need to dispute any that don’t.

On a Paid-Off Mortgage

When you finish paying a mortgage, the lender issues a document confirming the loan is satisfied and the lien on your property released. The name varies by state: satisfaction of mortgage, mortgage release, certificate of discharge. The effect is the same. The title to your property is clear of that lender’s claim.

Lenders are legally required to prepare the document once the loan is paid in full, and most states also require them to record it with the county recorder within a set window, commonly 30 to 90 days, with penalties for delay. Specifics vary by state, but the duty to clear the lien sits with the lender.

A missing recorded satisfaction is one of the most common title problems and can delay or kill a sale or refinance. If your original lender was acquired or went out of business, finding the right successor to issue the paperwork can get difficult. In that situation a title company or real estate attorney may need to file an affidavit or bring a quiet title action to clear the record.

From a Federal Tax Lien

When the IRS files a federal tax lien, it attaches to everything you own, real estate included. If you need to sell or refinance a specific property while the lien is still in place, you can ask the IRS to issue a certificate of discharge for that property. The discharge does not wipe out the underlying tax debt. It lifts the lien from one piece of property so the transaction can close, while the IRS keeps its lien on your other assets.7Office of the Law Revision Counsel. 26 USC 6325 – Release of Lien or Discharge of Property

The IRS will consider a discharge in several situations:

  • Your remaining property subject to the lien is worth at least twice the total tax debt plus any senior liens
  • You pay the IRS an amount at least equal to the government’s interest in the property
  • Debts ahead of the IRS lien, such as a first mortgage, exceed the property’s value, making the government’s interest effectively worthless
  • Sale proceeds go into an escrow account where the IRS keeps the same priority it had before the discharge
  • A third-party property owner (not the taxpayer) deposits cash or posts a bond equal to the government’s interest8Internal Revenue Service. Application for Certificate of Discharge of Property From Federal Tax Lien

You apply using IRS Form 14135 with supporting documentation such as appraisals, a proposed closing statement, and any escrow agreement. The IRS recommends submitting the application at least 45 days before the date you need the certificate; complex cases take longer.9Internal Revenue Service. Military Separation (DD Form 214)

In the military context, the certificate of discharge is the DD Form 214, formally the “Certificate of Release or Discharge from Active Duty.” The Department of Defense issues it to every service member leaving active duty. It records your dates of service, branch, rank, military occupational specialty, awards, and the characterization of your discharge.10National Archives. Request Military Service Records

The characterization matters because it drives which veterans’ benefits you can access. The five main types:

  • Honorable: full eligibility for federal and state veterans’ benefits, including education grants and loans, VA home loans, and employment preference
  • General (Under Honorable Conditions): some benefits may be available; eligibility for many programs is restricted
  • Other Than Honorable: most veterans’ benefits are not available
  • Bad Conduct: issued by a court-martial; veterans’ benefits are generally unavailable
  • Dishonorable: issued by a court-martial; benefits are unavailable and federal firearms restrictions apply11U.S. Army. Service Discharges – DD Form 214 Explained

Keeping the Document Where You Can Find It

Whichever certificate applies to you, store the original or a certified copy somewhere safe and keep a digital backup. Bankruptcy discharges can be pulled through PACER by searching the court where the case was filed or using the national PACER Case Locator.5Public Access to Court Electronic Records. These documents tend to matter most at exactly the moment you can’t find them: closing on a house, applying for a VA loan, pushing back on a collector who shouldn’t be calling. Having the paperwork ready is always faster than tracking it down.
