The C08 work permit is the employment authorization available to asylum seekers with a pending Form I-589. Who Qualifies
Eligibility comes from federal regulation and is narrower than many applicants assume. You need a properly filed, complete Form I-589 that has not yet been decided. From there, two waiting periods apply:

- USCIS cannot issue the permit until your asylum case has been pending for a full 180 days.2eCFR. 8 CFR 208.7 – Employment Authorization
Both counts exclude any days of delay you caused. A conviction for an aggravated felony under the Immigration and Nationality Act is an absolute bar with no discretionary waiver.2eCFR. 8 CFR 208.7 – Employment Authorization
One shortcut exists. If USCIS has already recommended your asylum application for approval, you can file Form I-765 immediately without waiting the 150 days. The Asylum EAD Clock
USCIS and the Executive Office for Immigration Review (EOIR) track your qualifying days on what’s called the asylum EAD clock. It starts the day USCIS receives your complete Form I-589 and pauses whenever you cause a delay. Because the clock controls when you become eligible, applicant-caused pauses are the most common reason a C08 filing gets rejected as premature.
According to the Form I-765 instructions, actions that stop the clock while your case is at a USCIS asylum office include:
- Missing an interview or fingerprint appointment
- Asking to reschedule your interview for a later date
- Requesting a case transfer to another asylum office, including transfers triggered by an address change
- Asking to submit additional evidence after your interview
- Failing to provide a competent interpreter at your interview when one is required

The clock also pauses between the day USCIS issues a request for evidence and the day it receives your response.2eCFR. 8 CFR 208.7 – Employment Authorization Government-caused delays, such as USCIS rescheduling your interview or a judge’s own continuance, do not stop the clock.
If you believe the clock has been stopped incorrectly, you can request a correction. For cases pending in immigration court, email the court hearing your case; for cases on appeal, the EOIR Office of the General Counsel handles the request. How to Apply
You apply by filing Form I-765, Application for Employment Authorization. USCIS accepts the form online through a USCIS account or by mail to the designated lockbox.5U.S. Citizenship and Immigration Services. The filing fee for an initial C08 permit is $560 as of January 1, 2026. A renewal costs $275.6U.S. Citizenship and Immigration Services. What to Submit
The documents required depend on whether your asylum case is at a USCIS asylum office or in immigration court proceedings:
- Proof your asylum application is pending. If you filed with USCIS, that means a copy of the Acknowledgement of Receipt, your interview notice, and your biometrics notice (Form I-797C). - A copy of a passport or other government-issued photo ID.
- A copy of any previous EAD you were issued.
- Proof of any name change since your asylum filing, such as a marriage certificate or court order.
If you file by mail, use a trackable delivery service and keep a full copy of the package.
Requesting a Social Security Number at the Same Time
Form I-765 contains a section where you can request a Social Security number and card together with your work permit. USCIS collects the information for the Social Security Administration, so a separate SSA visit isn’t needed. You’ll provide your name, date of birth, parents’ names, country of birth, and sex. Once USCIS approves the EAD, SSA mails the card separately, generally within 14 days of your EAD arriving. How Long the Card Is Valid
USCIS reduced the maximum validity period for C08 permits from five years to 18 months, effective December 4, 2025. The new limit applies to any application pending or filed on or after December 5, 2025.9U.S. Citizenship and Immigration Services. The practical consequence is more frequent renewals. With only 18 months on the card and processing times that can stretch, calendaring your renewal window is essential.
Renewing a C08 Permit
To renew, file a new Form I-765 with the $275 fee and updated supporting documents. USCIS recommends filing no more than 180 days before your current permit expires and at least 90 days before it expires.7U.S. Citizenship and Immigration Services. Automatic Extensions Have Ended
This is the most consequential change to the category in years. Before October 30, 2025, a timely-filed renewal automatically extended your work authorization by up to 540 days while USCIS processed the case. Under the old system, the Form I-797C receipt notice served as proof you could keep working while a renewal was pending. That is no longer true. The receipt for a renewal filed on or after October 30, 2025, expressly states that it is not evidence of employment authorization. If you filed your renewal before October 30, 2025, the old rules still cover you. What Happens If Your Asylum Case Is Denied
Because a C08 permit is tied to a pending asylum case, the outcome of the asylum decision affects the card. The rules depend on how and where the denial happens:
- Denied by a USCIS asylum officer and not referred to court: the EAD terminates on its printed expiration date or 60 days after the denial, whichever is later.12Federal Register. Employment Authorization Reform for Asylum Applicants

- Denied by an immigration judge, the Board of Immigration Appeals, or a federal court: if you file a timely appeal or petition for judicial review, the EAD remains valid through its expiration date and a renewal is available. Once every level of appeal is exhausted, you lose eligibility for a C08 renewal and cannot work past the card’s printed expiration date.
Common Reasons C08 Applications Get Denied
- Filing too early. If USCIS finds your asylum application has not been pending for 150 qualifying days after subtracting applicant-caused delays, the Form I-765 is rejected or denied.
- Applicant-caused clock pauses. Even if 150 calendar days have passed, missed interviews, rescheduling requests, and address-based transfers reduce qualifying days. Many applicants do not realize the clock has been stopped.
- Asylum denied before the EAD is adjudicated. If your asylum case is decided before USCIS rules on the work permit, the EAD application is denied automatically.2eCFR. 8 CFR 208.7 – Employment Authorization
- An aggravated felony conviction, which is an absolute bar.
- An incomplete filing. Unsigned forms, missing photos, or the absence of proof that asylum is pending can trigger rejection before USCIS reviews the merits.
If USCIS denies your application, the notice will explain why. Many denials can be corrected and refiled — for instance, once the clock genuinely reaches 150 days or once missing documents are assembled.
Working With a C08 Card
The C08 is an unrestricted Employment Authorization Document (Form I-766). It is not tied to a specific employer. You can work for any employer, change jobs, and hold multiple positions without further authorization from USCIS.
When you start a job, you’ll complete Form I-9. The EAD is a List A document, proving both identity and work authorization on its own; you should not be asked for additional documents when presenting a valid card.13U.S. Citizenship and Immigration Services.
