One benefit does remain: free Identity Defense Services through Pango, available to settlement class members until February 13, 2028.
The Claim Window Is Closed
The court granted final approval of the settlement on September 13, 2022, and the filing window closed at the end of that month. No late claims are being accepted, and check reissues have ended. Claimants who filed on time received a first payment beginning September 28, 2023, and a second distribution on September 4, 2024. All payment activity is complete.
What the Form Had Covered
The claim form allowed two types of monetary recovery. Out-of-pocket losses covered documented expenses tied to the breach, such as credit monitoring you paid for yourself, bank fees, and identity theft costs, supported by receipts, invoices, or bank statements. Lost-time claims covered up to 15 hours at $25 per hour, or a documented higher wage, for time spent dealing with the aftermath such as calling banks or reviewing credit reports.2United States District Court. Free Identity Defense Services Through February 13, 2028
If you were part of the affected class and never enrolled, this is the one remaining benefit worth claiming. Settlement class members can still sign up for up to five years of Identity Defense Services from Pango at no cost, available through February 13, 2028.1Capital One Data Breach Class Action Settlement. To enroll, call Pango at 833-317-4821 to obtain an enrollment code. Phone hours are Monday through Friday, 8 a.m. to 11 p.m. ET, and Saturday, 9 a.m. to 6 p.m. ET. Once you have your code, activate coverage at app.identitydefense.com/enrollment/activate/cap1.
Taxes on a Payment You Already Received
If you received a settlement payment, you may need to report it on your federal return. Payments that compensate for financial losses are generally taxable as ordinary income unless they relate to physical injury or sickness, which this settlement does not. Starting in tax year 2026, the IRS reporting threshold for Form 1099-MISC rose from $600 to $2,000, with inflation adjustments beginning in 2027.3IRS. Publication 1099 (2026), General Instructions for Certain Information Returns You are still required to report the income even if your payment fell below the threshold and you never received a 1099. Keep any check stubs or payment confirmations with your tax records.
