If Capital One is suing you over a credit card balance, your first job is to file a written response, called an answer, with the court before the deadline printed on your summons. That deadline is usually 20 to 30 days in state court, or 21 days in federal court, counted from the day you were served.1Cornell Law Institute. Federal Rules of Civil Procedure Rule 12 Miss it, and the court can rule for Capital One without ever hearing your side. Meet it, and you buy yourself the time to challenge the debt, negotiate a settlement, or consider bankruptcy.
File Your Answer Before the Deadline
The summons tells you which court the case is in and how long you have to respond. Treat that date as the one thing you cannot miss. Everything else in your defense depends on being an active party in the case.
In the answer, you go through each numbered allegation in the complaint and respond: admit, deny, or state that you lack enough information to answer. You also list any affirmative defenses — legal reasons the court should rule for you even if parts of the complaint are true. Common ones in credit card cases include an expired statute of limitations, an incorrect balance, and a lack of proper documentation. If the complaint itself is legally deficient, you can file a motion to dismiss instead of or alongside the answer.
Filing usually costs a court fee. Those fees range from roughly $15 to over $400 depending on jurisdiction. If you cannot afford it, most courts let you apply for a fee waiver by showing financial hardship or that you receive public benefits like Supplemental Security Income or food assistance. The application is confidential, and if it is approved you file your response without paying.
If You Already Missed the Deadline
When no answer is filed, Capital One can ask the court for a default judgment, which hands them everything in the complaint without a hearing. A default is not always permanent. Courts can set one aside if you file a motion showing a valid reason for the missed deadline (never receiving the papers, for example) and a legitimate defense worth hearing.2Cornell Law Institute. Federal Rules of Civil Procedure Rule 60
Improper service is one of the strongest grounds. If the process server left papers at the wrong address, handed them to someone who does not live with you, or did not follow your state’s rules for delivery, the court may lack authority over you. Act fast. In federal court, motions based on excusable neglect must be filed within one year, and motions based on a void judgment within a reasonable time.2Cornell Law Institute. Federal Rules of Civil Procedure Rule 60 State deadlines vary but tend to follow similar logic.
Defenses That Can Weaken Capital One’s Case
Capital One carries the burden of proof. It has to show a valid agreement existed, that you owed a specific amount, and that you failed to pay. Each piece is something you can challenge.
Start with the number. Credit card balances get inflated by fees, penalty interest, and charges you may never have authorized. If Capital One cannot produce statements that walk the balance forward from your last known payment to the figure in the complaint, that gap hurts their case. Use discovery to pin them down. Written questions answered under oath, requests for documents, and depositions are all available to you as a defendant.3Cornell Law Institute. Federal Rules of Civil Procedure Rule 26
Ask for the original credit card agreement with your signature, every monthly statement, and a full accounting of charges and payments. Older accounts in particular are often sued on with surprisingly thin paperwork. If Capital One cannot connect the agreement to the amount it claims you owe, you have real leverage.
If the debt was already discharged in a prior bankruptcy, Capital One has no right to collect it. A bankruptcy discharge permanently bars the creditor from any collection activity, lawsuits included.4Consumer Financial Protection Bureau. The Statute of Limitations Defense
Every state sets a time limit on how long a creditor can sue over an unpaid debt. For credit cards, those limits run from three to ten years, with most states falling between three and six. If Capital One files after the clock runs out, you can raise the expired statute as a defense. But raising it is on you: a court will usually still enter judgment on a time-barred debt if you never show up and never plead the defense.5Consumer Financial Protection Bureau. Can Debt Collectors Collect a Debt Thats Several Years Old
One wrinkle specific to Capital One: credit card agreements often include a choice-of-law clause naming the state whose law governs disputes. Capital One is headquartered in Virginia and has historically used Virginia law in its agreements. Whether a court applies your state’s limitations period or Virginia’s depends on the jurisdiction, so pull your cardholder agreement and check.
Do not reset the clock. In many states, a partial payment or a written acknowledgment of the debt starts the limitations period over, handing Capital One a fresh window to sue.5Consumer Financial Protection Bureau. When a Debt Buyer Sues Instead of Capital One
Not every lawsuit filed over a Capital One account actually comes from Capital One. Banks regularly sell delinquent accounts to debt buyers for pennies on the dollar. If the plaintiff is a third-party buyer rather than Capital One itself, you pick up an extra layer of defense.
A debt buyer has to prove it owns your specific account. That means an unbroken chain of sale documents tracing the account from Capital One to whoever holds it now. Bulk purchase agreements referencing thousands of accounts without identifying yours are often not enough. Missing links can get the case dismissed for lack of standing.
The Fair Debt Collection Practices Act applies to third-party debt collectors but generally does not cover original creditors like Capital One collecting their own debts.6GovInfo. 15 USC 1692a – Definitions Once a buyer is in the picture, the FDCPA applies. Within five days of first contacting you, the buyer must send written notice stating the amount owed, the name of the original creditor, and your right to dispute the debt within 30 days.7Office of the Law Revision Counsel. 15 USC 1692g – Validation of Debts If the buyer skipped that notice, you may have a counterclaim.
Negotiating a Settlement
Most credit card lawsuits settle before trial, and Capital One has dedicated settlement staff. A settlement typically involves paying less than the full balance in exchange for dismissal of the case. The size of the discount depends on how strong Capital One’s documentation is, how old the debt is, and how clearly you can show financial hardship.
Lump-sum offers tend to produce the biggest discounts, because they give Capital One immediate recovery with no further collection costs. If a lump sum is out of reach, structured payment plans are common. Get any deal in writing before you pay anything, and make sure the agreement says the lawsuit will be dismissed with prejudice so Capital One cannot refile over the same debt.
One trap worth knowing about before you sign: forgiven debt is often taxable. Any creditor that cancels $600 or more of your debt must report it to the IRS on Form 1099-C, and you are expected to include that amount as income.8Internal Revenue Service. Instructions for Forms 1099-A and 1099-C Two exceptions commonly rescue people being sued over credit card debt. If the debt is discharged in bankruptcy, the forgiven amount is excluded from gross income. If you were insolvent when the settlement happened — your total debts exceeded the fair market value of everything you owned — you can exclude the forgiven amount up to the extent of your insolvency.9Office of the Law Revision Counsel. 26 USC 108 – Income From Discharge of Indebtedness You claim the insolvency exclusion by filing IRS Form 982 with your return.10Internal Revenue Service. What Happens If Capital One Wins
A judgment does not pull money straight from your pocket, but it hands Capital One real collection tools. Knowing which parts of your income and property are protected lets you plan honestly.
Wage Garnishment
Federal law caps garnishment for consumer debt at the lesser of 25% of your disposable earnings or the amount by which your weekly pay exceeds 30 times the federal minimum wage. At $7.25 per hour in 2026, the protected floor is $217.50 per week.11Office of the Law Revision Counsel. 15 USC 1673 – Restriction on Garnishment If your weekly disposable earnings are $217.50 or less, nothing can be garnished. Several states protect more than the federal floor.
Bank Account Levies
Capital One can also obtain a court order to levy your bank account, freezing funds up to the judgment amount. Federal benefits such as Social Security and veterans’ payments get special protection. Banks served with a garnishment order must calculate how much in federal benefits was deposited in the previous two months and keep that amount accessible to you automatically, without any exemption paperwork from you.12Fiscal.Treasury.gov. Guidelines for Garnishment of Accounts Containing Federal Benefit Payments
Property Liens
A judgment can become a lien on real estate you own. The lien attaches to the property and typically has to be paid when the property is sold or refinanced. Most states shield a primary residence through homestead exemptions, though the amount of protection varies widely. In some jurisdictions, liens on non-exempt property can be enforced through a court-ordered sale.
Bankruptcy as an Option
Filing for bankruptcy triggers an automatic stay that immediately halts Capital One’s lawsuit along with any garnishments or collection calls already running. The stay kicks in the moment the petition is filed, and collection action taken in violation of it is void.13Office of the Law Revision Counsel. 11 USC 362 – Automatic Stay For someone staring down an imminent default judgment or active wage garnishment, the stay buys critical breathing room.
Chapter 7 bankruptcy wipes out most unsecured debts, credit card balances included, with a discharge usually coming about four months after filing. The trade-offs are that non-exempt assets can be sold to pay creditors and that you have to pass an income-based means test. Chapter 13 lets you keep your assets and repay debts through a court-approved plan over three to five years, after which the remaining unsecured balances are discharged.14United States Courts. Discharge in Bankruptcy – Bankruptcy Basics
Bankruptcy stays on your credit report for seven to ten years and makes borrowing more expensive during that period. If the Capital One account is your only serious debt, bankruptcy is probably overkill. If it is one of several debts pulling you under, it can be the most efficient reset.
Getting Help
You are not required to have a lawyer to defend a credit card lawsuit, and plenty of people handle these cases on their own, especially when the amount is small or the defense is straightforward. When the balance is large, the issues are unfamiliar, or Capital One has strong documentation, professional help changes the math.
Consumer defense attorneys usually charge a flat fee or an hourly rate. Flat fees for defending a credit card lawsuit generally run from $500 to $5,000 depending on complexity and whether the case goes to trial. Many offer free initial consultations, which can at least tell you how strong your defenses are before you commit.
Legal aid organizations provide free representation to people with low incomes in many areas. If you qualify, a legal aid attorney can file your answer, raise defenses, and negotiate with Capital One at no cost. Your state or county bar association can point you to local legal aid offices and lawyer referral services.
