Can You Work With an ITIN? Employer Checks, Risks, and Taxes

You cannot work in the United States with an ITIN alone. An Individual Taxpayer Identification Number is a nine-digit number the IRS issues strictly for federal tax purposes, and the agency states directly that it “creates no inference concerning your immigration status or your right to work in the United States.”1Internal Revenue Service. Topic No. 857, Individual Taxpayer Identification Number (ITIN) Work authorization is a separate matter, granted through immigration status, a work-authorized visa, or an Employment Authorization Document from U.S. Citizenship and Immigration Services.

What an ITIN Is Actually For

The IRS issues ITINs to people who need to file a federal tax return but don’t qualify for a Social Security Number. That includes certain foreign nationals, nonresident aliens with U.S.-source income, and dependents or spouses of U.S. citizens or residents. The IRS issues them regardless of immigration status because both resident and nonresident aliens can have tax filing obligations under the Internal Revenue Code.2Internal Revenue Service. Individual Taxpayer Identification Number (ITIN)

What an ITIN lets you do is narrow: file tax returns, report income, pay what you owe. The IRS says plainly that an ITIN does not qualify you for Social Security benefits, does not make you eligible for the Earned Income Tax Credit, does not provide or change immigration status, does not authorize work, and does not function as identification outside the federal tax system.2Internal Revenue Service. Individual Taxpayer Identification Number (ITIN)

Why an ITIN Is Not Work Authorization

Work authorization flows from immigration law, not tax law. To work legally in the United States, you need documentation that proves both your identity and your right to work. U.S. citizens and lawful permanent residents meet this with a Social Security Number paired with identity documents. Non-citizens typically need either a work-authorized visa or an Employment Authorization Document issued by USCIS.3USAGov. Work Permit (EAD)

An ITIN fits into none of these categories. It is not an acceptable document on Form I-9, and it cannot substitute for a Social Security Number on that form. E-Verify’s own guidance states that “ITINs and the cards on which they are printed do not provide evidence of employment authorization and are not acceptable for Form I-9 or E-Verify.”4E-Verify. My Employee Entered a Set of Numbers in the Social Security Number Field on Form I-9

What Employers Have to Verify

Every employer in the United States must complete Form I-9 for each new hire. The employee has to present documents proving identity and employment authorization within three business days of starting work. Accepted documents fall into three lists:5U.S. Citizenship and Immigration Services. Form I-9 Acceptable Documents

  • List A: a single document proving both identity and work authorization, such as a U.S. passport or Permanent Resident Card.
  • List B: a document proving identity only, such as a state-issued driver’s license.
  • List C: a document proving work authorization only, such as an unrestricted Social Security card.

An employee presents either one List A document or a combination of one List B and one List C document. An ITIN letter or card does not appear on any of these lists.6U.S. Citizenship and Immigration Services. 13.0 Acceptable Documents for Verifying Employment Authorization and Identity

E-Verify Will Catch It

Some employers use E-Verify, which cross-checks I-9 information against Social Security Administration and Department of Homeland Security records. If someone enters an ITIN where a Social Security Number belongs, E-Verify returns a Tentative Nonconfirmation. The employee has 10 federal working days to decide whether to contest the result and 8 federal working days after that to visit an SSA office or contact DHS.7E-Verify. Tentative Nonconfirmations (Mismatches) An ITIN holder has no way to resolve the mismatch, because the problem is the absence of work authorization, not a clerical error.

What Employers Face for Hiring Anyway

Federal law makes it illegal to knowingly hire, recruit, or refer someone who is not authorized to work in the United States. Civil penalties escalate with repeat violations:8Office of the Law Revision Counsel. 8 USC 1324a – Unlawful Employment of Aliens

  • First offense: $250 to $2,000 per unauthorized worker.
  • Second offense: $2,000 to $5,000 per unauthorized worker.
  • Third or subsequent offense: $3,000 to $10,000 per unauthorized worker.

Employers who show a pattern or practice of hiring unauthorized workers face criminal penalties of up to $3,000 per worker and up to six months of imprisonment.8Office of the Law Revision Counsel. 8 USC 1324a – Unlawful Employment of Aliens Separate paperwork penalties of $100 to $1,000 per worker apply for I-9 violations even when the worker turns out to be authorized. These penalties are the main reason compliant employers will not hire you on an ITIN, no matter how willing they otherwise might be.

The Independent Contractor Workaround Doesn’t Work

This is where many ITIN holders get bad advice. Independent contractors don’t complete Form I-9, and businesses that hire them aren’t required to verify work authorization through that form. Some people take this to mean freelance or gig work is a legal path for ITIN holders. It isn’t. Federal law prohibits individuals and businesses from contracting with an independent contractor when they know the contractor is not authorized to work in the U.S.9U.S. Citizenship and Immigration Services. Exceptions

The I-9 exemption for contractors is a paperwork distinction, not a grant of work authorization. And the IRS treats misclassification seriously. If a business labels a worker as an independent contractor but the working relationship actually looks like employment, with set hours, company-provided tools, and direct supervision, the business can be held liable for unpaid Social Security, Medicare, and unemployment contributions.10Internal Revenue Service. Worker Classification 101: Employee or Independent Contractor

One narrow point of confusion worth clearing up: an ITIN can appear as the payee’s taxpayer identification number on Form 1099-NEC. The IRS accepts ITINs there because the form serves a tax-reporting function, not an employment-authorization function.11Internal Revenue Service. General Instructions for Certain Information Returns Receiving a 1099 does not mean the underlying work was lawful from an immigration standpoint.

What Working Without Authorization Costs You

Unauthorized employment carries immigration consequences that can follow you for years. Under immigration law, it can bar you from adjusting your status to lawful permanent resident. USCIS policy states that if you accepted or continued unauthorized employment at any point before filing an adjustment application, you may be ineligible to adjust status, and this applies to your entire U.S. employment history, not just recent work.12U.S. Citizenship and Immigration Services. Chapter 6 – Unauthorized Employment

Leaving the country and reentering doesn’t erase the bar. USCIS officers review an applicant’s full employment record across all entries into the United States, with no time limit on how far back they look.12U.S. Citizenship and Immigration Services. Chapter 6 – Unauthorized Employment Certain categories are exempt from the bar, including immediate relatives of U.S. citizens and VAWA applicants, but for most people a history of unauthorized work becomes a serious obstacle to future legal status.

You Still Owe Taxes on Whatever You Earned

Here is the part that surprises many people: the IRS expects you to report all income and pay taxes on it, regardless of whether you were authorized to earn it. Immigration law and tax law operate on separate tracks. The IRS cares about whether you had income, not about your visa status.

ITIN holders with self-employment income of $400 or more must file Schedule SE and pay self-employment tax covering Social Security and Medicare. The IRS notes that you can use either an SSN or an ITIN to pay self-employment tax.13Internal Revenue Service. Self-Employment Tax (Social Security and Medicare Taxes) Resident aliens without an SSN can enter their ITIN on Form W-9 when a business requests their taxpayer identification number.14Internal Revenue Service. Form W-9 (Rev. March 2024) – Request for Taxpayer Identification Number and Certification

Filing with an ITIN carries real restrictions on credits. You cannot claim the Earned Income Tax Credit with an ITIN.1Internal Revenue Service. Topic No. 857, Individual Taxpayer Identification Number (ITIN) Taxes paid under an ITIN also do not earn Social Security credits while you hold only an ITIN. If you later receive a Social Security Number, earnings previously reported under your ITIN may be credited to your Social Security record once your tax accounts are combined. Failing to file doesn’t make the obligation go away; it adds penalties and interest, and if you later gain legal status, a clean tax history can help you in immigration proceedings while a record of non-filing works against you.

How to Actually Get Authorized to Work

For ITIN holders who want to work legally, the path runs through immigration law. The categories of people with work authorization are:

  • U.S. citizens, whether born or naturalized, who have an inherent right to work and need no additional permit.
  • Lawful permanent residents, who can work for any employer without restrictions.3USAGov. Work Permit (EAD)
  • Work visa holders in classifications such as H-1B for specialty occupations, which authorize employment for a specific employer and generally don’t require a separate work permit.15U.S. Citizenship and Immigration Services. 7.5 H-1B Specialty Occupations
  • EAD holders, whose Employment Authorization Document provides temporary work authorization for people in various immigration categories including asylum seekers, certain students, and applicants for permanent residency.16U.S. Citizenship and Immigration Services. Employment Authorization Document

If you hold only an ITIN and want to work legally, consult an immigration attorney about whether any pathway to work authorization fits your situation. The ITIN itself will not get you there. What it does is keep you in good standing with the IRS while you work through the immigration process, and if you later receive a Social Security Number, you must stop using the ITIN and notify the IRS so your prior tax records can be merged under the new number.17Internal Revenue Service.
