Can You Trade XAU/USD in the US? Rules, Futures, and ETFs

As a US resident, you generally cannot trade XAU/USD in the US the way overseas retail platforms offer it, because the Dodd-Frank Act closed off leveraged, off-exchange spot commodity trading for anyone who isn’t an eligible contract participant. Buying gold outright with no leverage is legal, and so are several regulated substitutes: gold futures on COMEX, gold ETFs, mining stocks, and gold held inside a self-directed IRA.

Why the Retail Spot Pair Isn’t Available

Section 742(a) of the Dodd-Frank Act amended the Commodity Exchange Act to cover “retail commodity transactions.” Any commodity agreement offered to someone who is not an eligible contract participant, entered into on a leveraged or margined basis or financed by the counterparty, is treated as a futures contract for enforcement purposes.1Federal Deposit Insurance Corporation. XAU/USD on a retail forex platform does neither.

XAU/USD is an over-the-counter spot instrument traded on margin, so it lands directly inside the restricted category. Domestic retail forex brokers simply leave it off their product lists. The law does not ban gold speculation; it bans the specific leveraged-spot delivery mechanism that makes the pair work for retail accounts abroad.

The 28-Day Delivery Exception Doesn’t Help Traders

One statutory exception applies when a leveraged or margined commodity sale results in actual delivery within 28 days.2Federal Deposit Insurance Corporation. None of that maps onto how people actually trade XAU/USD. A short-term trader looking for price exposure doesn’t want a shipment of bullion at the end of the week. The mismatch is why the restriction functions as a near-total block for retail accounts.

Paying the full purchase price for physical gold, with no margin or financing, sits outside these rules entirely. The Dodd-Frank restrictions target transactions that are “leveraged or margined” or “financed by the offeror.”2Federal Deposit Insurance Corporation. The Eligible Contract Participant Threshold

The Commodity Exchange Act carves out an exemption for eligible contract participants, who can trade off-exchange gold because the statute assumes they can handle unregulated OTC markets. For individuals speculating, that means more than $10 million in assets invested on a discretionary basis.4Office of the Law Revision Counsel. 7 USC 1a: Definitions If the trades hedge an existing position or business risk, the threshold drops to $5 million. Documentation has to go to the broker; self-certification is not enough.

Legal Ways to Get Gold Exposure

Gold Futures on COMEX

Gold futures traded on COMEX are the closest working substitute for XAU/USD. They are standardized, exchange-traded contracts under full CFTC oversight.5CME Group. Gold Futures and Options The standard contract covers 100 troy ounces, which at today’s prices is a large position for a retail account. Options on gold futures are available for defined-risk strategies.

Smaller accounts have Micro Gold futures, at 10 troy ounces per contract, one-tenth the size of the standard.6CME Group. Micro Gold Futures Contract Specs They trade under the ticker MGC with monthly contracts for February, April, June, August, October, and December across the nearest 24 months.

Gold ETFs

Exchange-traded funds are the simplest entry point. Physically backed ETFs such as SPDR Gold Shares (GLD) hold bullion in vaults and issue shares that track the spot price. Because ETFs trade on stock exchanges, they fall under SEC oversight and only require a standard brokerage account.7SEC.gov. Investor Bulletin: Exchange-Traded Funds (ETFs) You are buying shares of a trust rather than holding metal, and management fees gradually erode the fund’s gold holdings. Some newer gold-themed ETFs use futures or other derivatives instead of physical bullion, so check the prospectus if pure metal exposure matters to you.

Gold Mining Stocks

Shares of gold miners trade on ordinary stock exchanges. They tend to amplify gold’s price moves because high fixed costs make profits thin at low prices and expand quickly when gold rallies. That leverage runs both ways, and mining companies carry operational risks unrelated to gold: labor disputes, regulatory problems, and geological disappointments.

Gold IRAs

Self-directed IRAs can hold physical gold under strict IRS rules. IRC Section 408(m) requires IRA gold to meet the minimum fineness for COMEX futures delivery, with American Gold Eagles and certain other government-minted coins specifically permitted regardless of fineness.8Office of the Law Revision Counsel. 26 USC 408: Individual Retirement Accounts A qualified trustee must hold the metal; storing it at home or in a personal safe deposit box is not allowed. Custodial and storage fees run higher than an ETF, so gold IRAs mostly appeal to investors who want the tax shelter combined with actual metal.

How Each Option Is Taxed

Tax treatment varies enough between these vehicles to change which one makes sense.

Physical gold, gold coins, and physically backed ETFs like GLD are treated as collectibles. Long-term capital gains on collectibles are taxed at a maximum rate of 28%, above the 15% or 20% rates for stocks held longer than a year. Short-term gains are taxed as ordinary income.

Gold futures get more favorable treatment under IRC Section 1256. Regardless of holding period, gains and losses are split 60% long-term and 40% short-term at year-end.9Office of the Law Revision Counsel. 26 USC 1256: Section 1256 Contracts Marked to Market Section 1256 contracts are also marked to market on December 31, so unrealized gains at year-end are taxable even if the position is still open. For most taxpayers, the 60/40 blended rate lands below the 28% collectibles rate, which makes futures the more tax-efficient vehicle for active trading.

Gold held inside a traditional IRA grows tax-deferred, with distributions taxed as ordinary income. Inside a Roth IRA, qualified distributions come out tax-free. Either way, the collectibles rate does not apply while the metal sits in the account.

Broker reporting differs by product. Futures trades are reported in aggregate on Form 1099-B. For physical gold sales, brokers only report when the quantity sold meets or exceeds the minimum delivery amount for a CFTC-approved futures contract, with sales inside a 24-hour period aggregated to test that threshold.10IRS. 2026 Instructions for Form 1099-B – Proceeds From Broker and Barter Exchange Transactions Selling a single coin typically falls below the reporting threshold, but you still owe tax on the gain whether or not a 1099-B is issued.

Why Offshore XAU/USD Brokers Are a Bad Idea

Foreign brokers advertising XAU/USD to US residents are usually operating in violation of US law. Companies soliciting US customers to trade commodities, forex, or precious metals have to register with the CFTC.11U.S. Commodity Futures Trading Commission (CFTC). CFTC Publishes List of Foreign Entities that Illegally Solicit US Residents to Trade Foreign Currency and Binary Options Most offshore platforms don’t. If one disappears with your money, recovery through US courts is very limited.

The CFTC keeps a Registration Deficient (RED) List of foreign entities it believes are illegally soliciting US residents, and precious metals is flagged as a high-fraud category on that list.12CFTC. RED (Registration Deficient) LIST Checking it takes two minutes.

Beyond fraud risk, an offshore brokerage account creates US reporting obligations that many traders miss. If the aggregate value of your foreign financial accounts crosses $10,000 at any point during the year, you must file a Report of Foreign Bank and Financial Accounts (FBAR) with FinCEN.13Internal Revenue Service. Married couples filing jointly face thresholds of $100,000 and $150,000.14Internal Revenue Service. CFTC enforcement reaches both the foreign entities and any domestic individuals helping route US customer funds to them. Under the Commodity Exchange Act, civil penalties for general violations reach the greater of $100,000 or triple the violator’s gain per violation, rising to $1,000,000 or triple the gain for manipulation.15Office of the Law Revision Counsel. 7 US Code 13a-1 – Enjoining or Restraining Violations Inflation adjustments push the manipulation ceiling above $1.4 million per violation.16CFTC. Check Any Broker Before You Fund It

Before opening a futures or forex account, look up the firm in the National Futures Association’s BASIC database (Background Affiliation Status Information Center). The tool is free and returns current registration status, disciplinary history, and regulatory actions for any firm or individual.17National Futures Association. NFA A legitimate US broker offering gold futures or forex will be registered with the CFTC as a Futures Commission Merchant (FCM) or Retail Foreign Exchange Dealer (RFED) and hold NFA membership. If a firm doesn’t appear, or appears with a revoked or withdrawn registration, that’s the answer.
