You can no longer file a new claim for an unclaimed stimulus check. The three-year window to claim the first and second payments through a 2020 tax return closed on May 17, 2024, and the window for the third payment through a 2021 return closed on April 15, 2025.1Internal Revenue Service. Recovery Rebate Credit — Publication 5486-A What you can still do is confirm whether the IRS already sent you a payment you didn’t realize you received, and trace a payment that was issued but never reached you.
Why the Filing Deadlines Have Closed
Federal law gives you three years from a tax return’s original due date to claim a refund. After that, the IRS cannot legally issue the money, even if you were eligible.2Office of the Law Revision Counsel. 26 USC 6511 — Limitations on Credit or Refund The Recovery Rebate Credit, which was how anyone who missed a stimulus payment claimed it, sat on a tax return as a refundable credit and fell under this same three-year rule.
- The 2020 return, which carried the first and second stimulus payments, had an extended original due date of May 17, 2021. That made the final claim deadline May 17, 2024.1Internal Revenue Service. Recovery Rebate Credit — Publication 5486-A
- The 2021 return, which carried the third stimulus payment of up to $1,400 per person, was due April 18, 2022. That made the final claim deadline April 15, 2025.1Internal Revenue Service. Recovery Rebate Credit — Publication 5486-A
The same cutoff applied to amended returns. If you filed your 2020 or 2021 return on time but left the credit off, a Form 1040-X adding it had to reach the IRS before the same date.3Internal Revenue Service. Time You Can Claim a Credit or Refund
Check Whether the IRS Already Sent You a Payment
Before you conclude that a payment is missing, confirm what the IRS says it sent. Two things are worth checking.
First, in December 2024 the IRS announced special automatic payments to roughly one million taxpayers who had filed 2021 returns but had left the Recovery Rebate Credit line blank or entered zero.4Internal Revenue Service. Economic Impact Payments These went out to people who looked eligible based on what was already on their return. If you filed a 2021 return but never claimed the credit yourself, one of these payments may have reached you. People who never filed a 2021 return were not included.
Second, your full payment history is available in your IRS Online Account at irs.gov. The account transcript shows the amount, date, and delivery method for each of the three stimulus rounds. Setting up an account requires a photo ID such as a driver’s license, state ID, or passport, and identity verification through a selfie or short video chat.5Internal Revenue Service. The IRS also mailed paper confirmations after each round. Notice 1444 covered the first payment, Notice 1444-B the second, and Notice 1444-C the third.6Internal Revenue Service. 2020 Recovery Rebate Credit — Topic F: Finding the First and Second Economic Impact Payment Amounts If you kept those letters, they list exactly what the IRS believes it paid you.
Trace a Payment That Was Issued but Never Arrived
If IRS records show a payment was issued but you never received it, you can still ask the IRS to trace it. A trace is not a new claim, so the filing deadlines do not apply. This is the route to use when a check was lost or stolen in the mail, or when a direct deposit was sent to a bank account that had closed.
You can start a trace three ways: through the “Where’s My Refund?” tool at irs.gov, by calling 800-829-1954 to use the automated system, or by mailing Form 3911 (Taxpayer Statement Regarding Refund).7Internal Revenue Service. Refund Inquiries Joint filers cannot use the automated phone system and will need to speak with a representative or mail Form 3911.
Response times depend on how the payment was originally sent. For a paper check, expect about six weeks. For direct deposit, the process can take up to 120 days because the IRS has to work with the receiving bank.8Internal Revenue Service. 21.4.2 Refund Trace and Limited Payability If a paper check turns out to have been cashed by someone other than you, the Bureau of the Fiscal Service will send you a claim package with a copy of the cashed check for your review before deciding whether to issue a replacement.7Internal Revenue Service. If Your Refund Came in Smaller Than Expected
Some people who claimed the Recovery Rebate Credit received a smaller refund than the credit amount suggested. Once the credit landed on a tax return, it became a regular refund, and regular refunds can be reduced through the Treasury Offset Program to pay certain debts. The advance Economic Impact Payments themselves had some legal protections from seizure; the credit did not.
The Bureau of the Fiscal Service can apply your refund to:9Internal Revenue Service. Topic No. 203, Reduced Refund
- Past-due child support
- Federal agency nontax debts such as defaulted student loans
- State income tax obligations
- Certain unemployment compensation debts owed to a state, generally for overpayments due to fraud or unpaid contributions
If your refund was reduced, the Bureau of the Fiscal Service should have sent a notice showing the amount taken and which debt it went to. You can call the Treasury Offset Program at 800-304-3107 to find out whether an offset was applied. Disputes over the underlying debt have to go to the agency that reported it, not the IRS.
Claims Involving a Deceased Family Member
The same deadlines applied to claims filed on behalf of someone who died. If a final 2020 or 2021 return was already filed on time and a refund is still owed, the surviving spouse or estate representative may need Form 1310 (Statement of Person Claiming Refund Due a Deceased Taxpayer) to receive it.10Internal Revenue Service. Form 1310 — Statement of Person Claiming Refund Due a Deceased Taxpayer A surviving spouse filing a joint return with the deceased does not need Form 1310, and neither does a court-appointed personal representative who attaches the court certificate to the original return. New claims cannot be filed at this point.
