Bankruptcy does not end your chances of owning a home. Every major mortgage program lets you back in after a waiting period that runs one to four years, measured from your discharge or dismissal date. Buying a house after bankruptcy comes down to two variables: which chapter you filed, and which loan program you apply for. A bankruptcy stays on your credit report for up to ten years, but its effect on mortgage eligibility fades well before that.
How Long You Wait After Chapter 7
Chapter 7 wipes out most unsecured debts through liquidation. Because the slate clears so fast, lenders want a longer track record before writing a new mortgage. The clock starts on the discharge date, not the filing date.
- FHA: two years from discharge, with re-established good credit or a documented choice not to take on new debt during that time.1U.S. Department of Housing and Urban Development. How Does a Bankruptcy Affect a Borrower’s Eligibility for an FHA Mortgage?
- VA: two years from discharge.2Veterans Affairs. Don’t Delay! Act Now to Secure Your Hard-Earned VA Home Loan
- USDA: three years (36 months) from discharge or dismissal.3U.S. Department of Agriculture. Single Family Housing Guaranteed Loan Program Credit Analysis
- Conventional (Fannie Mae): four years from discharge or dismissal.4Fannie Mae. Significant Derogatory Credit Events – Waiting Periods and Re-Establishing Credit
The gap matters. At two years past discharge, an FHA loan may already be within reach while conventional financing is still two years away. That single difference sends most post-bankruptcy borrowers toward government-backed programs first.
How Long You Wait After Chapter 13
Chapter 13 involves a court-ordered repayment plan lasting three to five years. Because you’re actively paying creditors rather than liquidating, lenders shorten the waits, and in some cases you can qualify while the plan is still active.
- FHA: twelve months into the repayment plan, with satisfactory payment performance and written permission from the bankruptcy court.1U.S. Department of Housing and Urban Development. How Does a Bankruptcy Affect a Borrower’s Eligibility for an FHA Mortgage?
- VA: one year into the repayment plan.2Veterans Affairs. Don’t Delay! Act Now to Secure Your Hard-Earned VA Home Loan
- USDA: twelve months of completed plan payments.3U.S. Department of Agriculture. Single Family Housing Guaranteed Loan Program Credit Analysis
- Conventional (Fannie Mae): two years from discharge, after the full plan is completed.4Fannie Mae. Significant Derogatory Credit Events – Waiting Periods and Re-Establishing Credit
The court-permission requirement is a genuine hurdle. Your trustee has to confirm that a new mortgage payment won’t disturb the existing repayment schedule, and if your plan payments are already tight, that approval can be hard to get. Conventional loans avoid the issue by waiting until the plan ends and the case is discharged.
Discharged Versus Dismissed
A discharge means the court formally wiped out your eligible debts and the case closed successfully. A dismissal means the case ended before completion, often because of missed plan payments or procedural failures. Lenders treat the two differently.
Under Fannie Mae’s guidelines, a dismissed Chapter 13 triggers a four-year wait from the dismissal date, compared to two years from discharge for a completed case. With documented extenuating circumstances, the dismissed-case wait drops to two years. For Chapter 7, Fannie Mae measures four years from either the discharge or dismissal date, so the outcome is the same.4Fannie Mae. If you’re in a Chapter 13 plan now, finishing it cuts your conventional waiting period in half compared to a dismissal.
Shorter Waits for Extenuating Circumstances
If the bankruptcy was caused by events beyond your control, both FHA and Fannie Mae allow reduced waits. A medical emergency or sudden job loss reads differently to an underwriter than years of overspending.
FHA can qualify a borrower as early as twelve months after a Chapter 7 discharge instead of the standard two years, provided the borrower can show the bankruptcy stemmed from circumstances beyond their control and that they’ve managed money responsibly since.1U.S. Department of Housing and Urban Development. Medical records, layoff notices, divorce decrees, and insurance denial letters all count as evidence.
Credit Scores, Documents, and Underwriting
Clearing the waiting period is only the first gate. Lenders also need to see rebuilt credit and a properly documented case.
Minimum Credit Scores
FHA has the lowest floor. A score of 580 or above qualifies for maximum financing with 3.5% down. Scores between 500 and 579 still qualify but require at least 10% down. Below 500, FHA will not insure the loan.5U.S. Department of Housing and Urban Development. Does FHA Require a Minimum Credit Score and How Is It Determined?
Fannie Mae conventional loans require a minimum score of 620 for manually underwritten fixed-rate mortgages and 640 for adjustable-rate mortgages.6Fannie Mae. General Requirements for Credit Scores Post-bankruptcy applications frequently go through manual underwriting rather than automated approval, so 620 is the working minimum for most conventional borrowers in this situation.
What You’ll Need to Provide
Expect more paperwork than a typical borrower. You’ll need a complete copy of your bankruptcy petition with the schedule of debts, so the underwriter can confirm which obligations were eliminated. The formal discharge order is essential, because without it the lender cannot verify that your waiting period has started. If the credit report doesn’t show the discharge date, the lender must obtain the bankruptcy and discharge documents directly.1U.S. Department of Housing and Urban Development. You’ll also write a letter of explanation. Underwriters use it to judge whether the financial problems are likely to recur, so focus on specific events (medical crisis, divorce, job loss) and explain what has changed since. Vague explanations that skip the root cause invite more questions.
Manual Underwriting
If your bankruptcy was discharged within two years of your FHA application, the loan has to be manually underwritten rather than run through automated systems.1U.S. Department of Housing and Urban Development. How Does a Bankruptcy Affect a Borrower’s Eligibility for an FHA Mortgage? A person reviews your entire file. That’s slower and more searching, but it also means your individual circumstances carry weight. A strong letter and clean payment history since the filing can carry an application that an algorithm would reject.
Rebuilding Credit During the Wait
The waiting period is your window to build the profile lenders want. Layering different types of credit over time works best.
Start with a secured credit card, where a cash deposit sets your limit. Use it for small recurring purchases, keep the balance well below 30% of the limit, and pay in full every month. After roughly a year of clean history, an unsecured card is usually within reach. Add a small installment loan (a credit-builder loan or a short-term auto loan) so your file shows both revolving and installment credit handled well.
Aim for at least twelve to twenty-four months of on-time payments across multiple accounts by the time you apply. New late payments or high balances during the waiting period can sink an application even if you have technically cleared the time requirement. The lender needs to see that the trouble was a discrete event, not an ongoing pattern.
Rate pricing follows the same logic. A borrower who finishes the waiting period with a 720 score will see very different pricing than one who barely clears 620, so pushing the score as high as possible before you apply is the single most useful thing you can do.
