Can You Pay Employees With Venmo? Payroll, Contractors, and Risks

Paying employees with Venmo is legal in a narrow sense, but for W-2 workers it is not a substitute for payroll. Venmo cannot withhold income tax, calculate Social Security or Medicare, produce a pay stub, or file the returns the IRS expects. For independent contractors the picture is different: Venmo can move the money, and your job is mostly to document what you paid and report it correctly. Everything below turns on that distinction.

Employee or Independent Contractor

The first question is not which app to use. It is what kind of worker you are paying.

A W-2 employee triggers a full set of employer obligations: withhold federal income tax, withhold the employee’s share of Social Security and Medicare, pay the employer’s matching share, and pay federal unemployment tax. None of those steps happen inside Venmo. Sending gross pay through the app means you have skipped every withholding step the law requires.

An independent contractor generally handles their own taxes. You do not withhold. Your main duties are collecting a Form W-9 before you pay anyone, tracking what you paid, and filing the correct information return at year end.

Calling an employee a contractor to avoid this does not work. The IRS can hold you responsible for the employment taxes you should have withheld, plus penalties.1IRS. Worker Classification 101: Employee or Independent Contractor

Why Venmo Fails as Payroll for W-2 Employees

Every paycheck to a W-2 employee needs federal income tax withheld using the methods in IRS Publication 15-T and the employee’s Form W-4.2IRS.gov. Publication 15-T Federal Income Tax Withholding Methods For Use in 2026 On top of income tax, you owe:

  • Social Security at 6.2% withheld from the employee and 6.2% matched by the employer, on earnings up to $184,500 in 2026.3Social Security Administration. Contribution and Benefit Base
  • Medicare at 1.45% withheld and 1.45% matched, plus an additional 0.9% withheld from employees earning over $200,000.4Social Security Administration. 2026 Cost-of-Living Adjustment (COLA) Fact Sheet
  • Federal unemployment tax paid entirely by the employer on the first $7,000 of each employee’s wages per year.

Venmo does not calculate, withhold, remit, or file for any of these. If you use Venmo to move the money, you still have to run every calculation on the side, deposit the withheld tax on the required schedule, and file quarterly returns. Miss those steps and you can be personally liable under the trust fund recovery penalty in 26 U.S.C. § 6672 for the full amount of unpaid taxes.5Office of the Law Revision Counsel. 26 U.S. Code 6672 – Failure to Collect and Pay Over Tax, or Attempt to Evade or Defeat Tax Even if the employee later pays their own income tax, the employer still faces penalties for not withholding it.6Office of the Law Revision Counsel. 26 U.S. Code 3402 – Income Tax Collected at Source

Most states also require an itemized wage statement showing hours, rate, deductions, and net pay. Venmo does not produce one.

Consent and Access to Full Wages

Two federal rules constrain how you deliver wages electronically, whatever the platform.

First, the Electronic Fund Transfer Act bars requiring any person to open an account at a specific financial institution as a condition of employment.7Office of the Law Revision Counsel. 15 U.S. Code 1693k – Compulsory Use of Electronic Fund Transfers You cannot force an employee to open a Venmo account to get paid. You may require electronic payment, but the worker chooses where the money lands.8Consumer Financial Protection Bureau. CFPB Bulletin 2013-10 Payroll Card Accounts (Regulation E) In practice you need an alternative on offer, such as direct deposit to a bank of the employee’s choosing, a check, or cash. Many states add their own consent rules for electronic wage payments on top of the federal floor.

Second, federal regulations under 29 CFR Part 531 require wages to be paid at par value: the worker must be able to access the full agreed amount without losing part of it to fees.9eCFR. Part 531 Wage Payments Under the Fair Labor Standards Act of 1938 If a platform fee comes out of the worker’s side, that fee can push a minimum-wage employee below the legal minimum. Structure payments so any transaction fees are absorbed by the business.

Using Venmo for Independent Contractors

This is the case where Venmo actually fits. You are moving money to someone who handles their own taxes, and your obligations are documentary rather than mechanical.

Set up a Venmo business profile rather than paying contractors from a personal account. Creating one requires a taxpayer identification number: an EIN for a registered entity, or an SSN if you are a sole proprietor. Venmo may also ask for identity verification documents, including proof of your business name and EIN.10Venmo Help Center. Business Profile Identity Verification Documents Keeping the business profile separate from any personal account preserves a clean line between business and personal finances, which matters for tax reporting and for liability.

When you send a contractor payment, tag it as goods and services. That flags it as a commercial transaction, which affects how the platform treats fees and reporting. Use the note field for the pay period or a short description of the work; that gives both sides a basic digital record.

Fees

Payments received through a business profile carry a fee of 1.9% plus $0.10.11Venmo. About Venmo Fees If the recipient is on a personal account and the payment is tagged goods and services, the fee is 2.99%. The fee is charged to the recipient. If you want the contractor to net a specific amount, gross up the payment or agree in writing who absorbs the fee.

Year-End Reporting

Two separate reporting rules apply, and they are easy to confuse.

Venmo, as a third-party settlement organization under 26 U.S.C. § 6050W, must file Form 1099-K for a recipient only when both of these conditions are met in the same calendar year: total payments to that recipient exceed $20,000, and the number of transactions exceeds 200.12Office of the Law Revision Counsel. 26 U.S.C. 6050W – Returns Relating to Payments Made in Settlement of Payment Card and Third Party Network Transactions The One, Big, Beautiful Bill Act restored this threshold, reversing an earlier $600 threshold that had been scheduled to take effect.13IRS. IRS Issues FAQs on Form 1099-K Threshold Under the One, Big, Beautiful Bill — Dollar Limit Reverts to $20,000

Your own duty is separate. If you paid a contractor $600 or more for services during the year, you generally have to file a Form 1099-NEC directly, regardless of whether Venmo issues a 1099-K. The platform threshold governs the platform’s paperwork. It does not eliminate yours.

Recordkeeping the App Does Not Cover

For employees, 29 CFR 516.2 requires you to keep the worker’s full name and home address, hours worked each day and each week, regular pay rate, straight-time earnings, overtime pay, all deductions and additions, total wages, and the dates of each pay period.14eCFR. 29 CFR 516.2 – Employees Subject to Minimum Wage or Minimum Wage and Overtime Provisions A Venmo receipt shows an amount, a date, and a note. Nothing else. If Venmo is anywhere in your pay process, you need a separate system that captures the rest, or a Department of Labor audit will find you unable to prove compliance.

The Bottom Line on Risk

For W-2 employees, the mismatch between what payroll law requires and what Venmo does is not a small one:

  • No withholding infrastructure for income tax or FICA.
  • No pay stubs, so no way to meet state wage statement rules.
  • Payments are effectively irreversible once received, so a wrong amount or wrong recipient is your problem to negotiate.
  • Fees borne by the worker can drop take-home pay below the federal minimum.
  • Transaction history does not satisfy federal recordkeeping requirements.

For independent contractors, the same list is much shorter. You are not withholding, the contractor is responsible for their own records, and Venmo can serve as a straightforward transfer tool as long as you collect a W-9 up front, track what you pay, and file the right 1099 at year end. For W-2 payroll, use a payroll service or software that handles withholding, tax deposits, and wage statements.
