Can you open a bank account with an expired ID? At most banks, no. Federal law doesn’t flatly prohibit it, but nearly every bank’s internal compliance policy requires an unexpired government-issued photo ID, so a lapsed driver’s license will get you turned away at the counter. The good news is that an expired license isn’t the only door into the banking system, and several straightforward alternatives will get you an account the same day.
Why Banks Treat “Unexpired” as Mandatory
Banks verify your identity because federal law tells them to. Under the Bank Secrecy Act and the USA PATRIOT Act, every bank must maintain a written Customer Identification Program with risk-based procedures for verifying who you are before opening an account.1eCFR. 31 CFR 1020.220 – Customer Identification Program Requirements for Banks The bank must form a “reasonable belief” that it knows the true identity of each customer.
Federal banking regulators expect that, for most individual customers, banks will review an unexpired government-issued ID that shows nationality or residence and includes a photograph.2FFIEC BSA/AML Manual. Assessing Compliance with BSA Regulatory Requirements – Customer Identification Program A driver’s license or passport are the classic examples. The CIP regulation uses the word “unexpired” as an example of acceptable documentation rather than a hard prohibition, and it requires banks to maintain backup verification methods for people who can’t produce a current ID. In practice, compliance departments at nearly every bank close that gap by making “unexpired” a firm rule.
When an Expired ID Might Still Work
The CIP rule specifically says a bank’s procedures “must address situations where an individual is unable to present an unexpired government-issued identification document.” That language leaves a narrow opening. Non-documentary methods can include checking your information against consumer reporting agency databases, public records, or other financial institutions.1eCFR. 31 CFR 1020.220 – Customer Identification Program Requirements for Banks Some online banks lean on this kind of database matching, which is part of why their onboarding sometimes feels more flexible than a branch visit. Most brick-and-mortar banks default to “bring us a valid ID” and don’t advertise their non-documentary options.
Expired License With a Renewal Receipt
If your license lapsed because you’re waiting for a replacement, bringing the expired card together with your official renewal receipt can sometimes get you through. The expired ID still shows your photo and personal details, and the receipt proves you’re in the renewal pipeline. Whether this works depends entirely on the bank’s compliance department. Call the branch ahead of time rather than showing up and hoping.
State-Issued Grace Periods
During DMV shutdowns or administrative backlogs, state governors sometimes issue executive orders extending the validity of driver’s licenses. Banks in the affected state generally honor those extensions. The grace periods are temporary and clearly defined, so check whether your state has one in effect before assuming your expired license still counts.
Photo IDs That Will Work Instead
An expired driver’s license doesn’t lock you out of the banking system if you have another valid government-issued photo ID. Any of the following satisfies the CIP rule at essentially every bank:
- U.S. passport book or passport card. The passport book is accepted universally. The passport card is wallet-sized and proves both citizenship and identity.
- Permanent resident card (green card) for non-citizens with lawful permanent resident status.
- Department of Defense Common Access Card for active-duty service members, reservists, and eligible DoD civilians and contractors.
- A separate state-issued identification card, if your driver’s license has expired but your state ID is current.
- Government-issued tribal ID with a photo, though acceptance is less uniform than for the options above.
Bringing a second form of ID alongside your primary document strengthens the application.2FFIEC BSA/AML Manual. Assessing Compliance with BSA Regulatory Requirements – Customer Identification Program A Social Security card or birth certificate won’t work on its own because neither has a photo, but either can help confirm your details when paired with a valid photo document.
What Else You’ll Need to Bring
A photo ID gets you through the door; the application asks for more. Have these ready:
- Social Security Number or ITIN. Banks use this for tax reporting and identity verification. If you don’t have an SSN, an Individual Taxpayer Identification Number works at most institutions, and you can apply for one through IRS Form W-7.3Consumer Financial Protection Bureau. - Proof of address. A recent utility bill, lease agreement, or bank statement showing your physical street address. P.O. boxes usually don’t count.
- Full legal name and date of birth that match your photo ID exactly. A mismatch between the name on a utility bill and the name on your passport will slow things down.
Fill out every field on the application exactly as your documents read. Small discrepancies, like a middle initial on one document and a full middle name on another, are the most common reason applications get held for manual review.
What to Do If You’re Denied
A denial isn’t always about your ID. Banks also screen applicants through checking account reporting companies, and a history of unpaid negative balances or involuntary account closures can trigger a rejection on its own.
If a bank denies your application based on information from a checking account screening company, it must send you an adverse action notice that includes the name and contact information of the company that supplied the report.5Consumer Financial Protection Bureau. Denied for a Bank Account Heres What You Should Know You then have the right to a free copy of that report, which lets you see what the bank saw and dispute any errors.
If the denial was specifically about your identification, ask the banker to tell you exactly what documentation would satisfy their requirements. Sometimes the answer is as simple as coming back with a passport instead of an expired license.
Options If You Can’t Produce Any Current Photo ID
For people stuck in the gap, with a lapsed license, no passport, and a delayed renewal, a few workarounds exist.
Credit Unions
Credit unions follow the same federal CIP requirements as banks, but some take a more flexible approach to documentation. A few advertise accepting foreign-issued identification or working with members who have non-standard documents. Community development credit unions often serve populations that struggle with traditional ID requirements. Call ahead and explain your situation before visiting.
Second-Chance and Bank On Accounts
Second-chance checking accounts are designed for people flagged by screening companies for past banking problems. They don’t waive the ID requirement, but they remove the other major barrier to getting an account. The Bank On initiative certifies accounts at over 500 financial institutions that meet standards for low fees and accessibility.6BankOn. Accounts If your real problem is banking history rather than identification, these are worth looking into.
Prepaid Debit Cards
Reloadable prepaid cards that accept third-party deposits create a formal “account” under federal rules, so the issuing bank still has to run CIP verification.7Office of the Comptroller of the Currency. Prepaid Cards Interagency Guidance to Issuing Banks on Applying Customer Identification Program Requirements for Holders of Prepaid Cards A prepaid card can bridge a short gap while you renew your ID, but the fees add up quickly and the card lacks the consumer protections of a standard checking account.
Renew Your ID First
This is the plainest answer. Many states let you renew a driver’s license or state ID card online or by mail even after it’s expired, as long as the expiration happened within a certain window, and a renewal usually turns around faster than an original. If you need an account urgently, renewing your state ID while simultaneously applying for a U.S. passport card gives you two parallel paths to a valid photo document.
