Try to Get the Real W-2 First
Employers are supposed to send W-2s by January 31. When one doesn’t show up, call the employer’s payroll department. If the business moved, changed hands, or closed, try any successor company. Write down who you spoke with and when.
If the W-2 still hasn’t arrived by the end of February, call the IRS at 800-829-1040. Your final pay stub of the tax year is the single most useful document. Line 10 asks you to explain why the original W-2 wasn’t available and what steps you took to get it. This narrative matters. Say when you contacted your employer, what response you got, and whether you called the IRS. A few clear sentences are enough. The point is to show that Form 4852 was a last resort.
You sign Form 4852 under penalty of perjury, so the numbers need to reflect the best information you have, not guesses pulled from nowhere. Estimates from real records are fine. Fabricated numbers are not.
The figures on Form 4852 flow into your Form 1040 exactly the way a regular W-2 would. Total wages go on the income line, federal withholding on the payments line. If one W-2 is missing but you have others, attach the real W-2s and use Form 4852 only for the one you’re missing.
Attaching and Mailing the Return

The mailing address depends on your state and whether you’re sending a payment. A paper return with a substitute form goes through manual review, so expect a slower refund than with an e-filed return. That’s the tradeoff, not a penalty.
Proving You Filed on Time
Send the return by USPS certified mail with return receipt requested. If April 15 Is Close and You Still Don’t Have the W-2

An extension gives you more time to file, not more time to pay. If you owe tax, estimate from your last pay stub and send that amount by April 15 to avoid interest and the failure-to-pay penalty. If you’re expecting a refund, the extension costs you nothing.
If the Real W-2 Arrives After You File
When the W-2 finally shows up and the numbers match what you reported on Form 4852, you’re done. If you don’t amend, the IRS will eventually compare your return to the W-2 data your employer reported and send an automated notice proposing changes. Correcting it yourself first is easier than responding to that letter.
Don’t Let a Missing W-2 Stop You From Filing
The failure-to-file penalty is 5% of the tax you owe for each month a return is late, up to 25%.11Internal Revenue Service.
