No. Having a Taxpayer Identification Number does not let you legally work in the United States. A TIN, and specifically the Individual Taxpayer Identification Number (ITIN) that the IRS issues to people without a Social Security Number, exists for federal tax purposes only. The IRS states plainly that an ITIN does not authorize employment and does not change your immigration status.1Internal Revenue Service. Individual Taxpayer Identification Number (ITIN) Work authorization comes from immigration status (a visa, a green card, or an Employment Authorization Document), not from a tax number. The two systems run on separate tracks, and confusing them is where people get into trouble.
What a TIN Is For
A Taxpayer Identification Number is a nine-digit number the IRS uses to track tax obligations. For individuals who can’t get a Social Security Number, the IRS issues an ITIN so they can file returns and report income. You apply using Form W-7, and the number is used strictly inside the federal tax system.2Internal Revenue Service. About Form W-7, Application for IRS Individual Taxpayer Identification Number
Eligible applicants include nonresident aliens, resident aliens, and their spouses or dependents who have a U.S. tax filing obligation but don’t qualify for an SSN.3Internal Revenue Service. U.S. Taxpayer Identification Number Requirement The IRS accepts an ITIN on tax forms because federal tax law requires everyone earning income in the U.S. to report it, regardless of immigration status. That acceptance is about collecting tax. It is not a judgment that the work behind the income was authorized.
Why an ITIN Does Not Work for Employee Hiring
Every employer in the United States must complete Form I-9 for each new hire, verifying both identity and employment authorization.4U.S. Citizenship and Immigration Services. I-9, Employment Eligibility Verification Acceptable documents include a U.S. passport, a permanent resident card, an Employment Authorization Document (EAD), or certain visa-related documents. An ITIN card is not on any list of acceptable I-9 documents and cannot be used to satisfy the requirement.5U.S. Citizenship and Immigration Services. 13.0 Acceptable Documents for Verifying Employment Authorization and Identity
If the employer uses E-Verify, the system will not accept an ITIN at all. ITINs always begin with the digit 9, SSNs never do, and E-Verify blocks case creation when an ITIN is entered in the SSN field.6E-Verify. My Employee Entered a Set of Numbers in the Social Security Number Field on Form I-9 So an ITIN alone will not get you hired as an employee, and no legitimate employer can treat it as proof you may work.
The One Employee Scenario Where an ITIN Appears
There is a narrow case where an ITIN shows up in an employment file. If you already have valid work authorization through a visa or EAD but have not yet received your Social Security Number, you can use your ITIN on Form W-4 so your employer can set up federal income tax withholding.3Internal Revenue Service. U.S. Taxpayer Identification Number Requirement The employer reports wages on Form W-2 using the ITIN until the SSN arrives. The authorization to work in that scenario comes from the visa or EAD, not the ITIN; the ITIN is just a temporary placeholder for payroll tax reporting. Apply for the SSN through the Social Security Administration as soon as you are eligible.
Independent Contractors and ITINs
Independent contracting is where an ITIN gets the most practical use in work settings. When you perform services as a contractor, you give clients your ITIN by completing Form W-9, which the client keeps on file.7Internal Revenue Service. Forms and Associated Taxes for Independent Contractors – Section: Form W-9 Any client who pays you $600 or more during the year must report those payments to the IRS on Form 1099-NEC.8Internal Revenue Service. Instructions for Forms 1099-MISC and 1099-NEC (04/2025) – Section: Specific Instructions for Form 1099-NEC There is no Form I-9 requirement for independent contractors.
This is where tax compliance and work authorization need to be kept straight. The IRS will process a 1099 and a tax return with an ITIN either way. That processing is not permission to perform the work. Working without proper immigration authorization can create serious consequences for future visa applications, green cards, and other status adjustments, no matter how clean your tax filings look. The IRS and the immigration system do not clear each other’s requirements.
Backup Withholding
If you fail to give a client a valid TIN, or the IRS tells the client the number is incorrect, the client must withhold 24% of your payments and send that amount directly to the IRS. This is backup withholding, and it applies across 1099-reportable payments.9Internal Revenue Service. Publication 15 (2026), (Circular E), Employer’s Tax Guide You can claim the withheld amount as a credit on your return, but losing nearly a quarter of your income to withholding all year is a cash-flow hit. Keeping your ITIN current and providing it on Form W-9 at the start of the engagement prevents it.
Tax Obligations That Come With the Income
Earning income in the United States creates tax obligations regardless of how you were paid or what your status is. ITIN holders file under the same deadlines as everyone else.
When You Have to File
For tax year 2026, a single filer under 65 generally must file a federal return if gross income reaches $16,100, which equals the standard deduction.10Internal Revenue Service. IRS Releases Tax Inflation Adjustments for Tax Year 2026, Including Amendments From the One, Big, Beautiful Bill Independent contractors face a much lower threshold. If your net self-employment earnings reach just $400, you must file and pay self-employment tax, even if your total income is well below the standard filing threshold.11Internal Revenue Service. Self-Employment Tax (Social Security and Medicare Taxes)
Self-Employment Tax
Contractors pay self-employment tax at a combined rate of 15.3%, covering Social Security (12.4%) and Medicare (2.9%). Employees split these with their employer; contractors pay the full amount themselves.11Internal Revenue Service. Self-Employment Tax (Social Security and Medicare Taxes) For 2026, the Social Security portion applies to the first $184,500 of combined wages and self-employment income.12Social Security Administration. Contribution and Benefit Base The Medicare portion has no cap. If your self-employment income exceeds $200,000 for a single filer, an additional 0.9% Medicare tax applies to the amount above that threshold.13Internal Revenue Service. Quarterly Estimated Payments
No one withholds taxes from contractor payments, so the IRS expects you to pay as you go using Form 1040-ES. The 2026 due dates are April 15, 2026; June 15, 2026; September 15, 2026; and January 15, 2027. You can skip the January payment if you file your 2026 return and pay the balance in full by February 1, 2027.14Internal Revenue Service. 2026 Form 1040-ES Missing these deadlines triggers an underpayment penalty.15Internal Revenue Service. Penalties for Not Filing at All
Skipping the return is worse than underpaying. The failure-to-file penalty is 5% of unpaid tax per month, up to 25%.16Internal Revenue Service. Failure to File Penalty Filing on time and arranging a payment plan keeps the penalty much smaller even if you can’t pay in full.
If Your Status Changes and You Get an SSN
If you later become eligible for a Social Security Number, you must stop using your ITIN for tax purposes and switch to the SSN. The IRS requires it.17Internal Revenue Service. Additional ITIN Information
After receiving your SSN, notify the IRS so your old ITIN records are merged with the new number. You can visit a local IRS office or send a letter to:

Additional ITIN Information The IRS will void the ITIN and link your prior filings to the SSN. Skipping this step can mean wages and withholding reported under the ITIN don’t get credited to you, which can reduce future refunds and affect Social Security benefit calculations later.
