Can You File Taxes Without an SSN or ITIN?

Yes. If you’re required to file a U.S. tax return but can’t get a Social Security Number, filing taxes without an SSN is done by applying for an Individual Taxpayer Identification Number (ITIN) and submitting a paper return with the ITIN application attached. The ITIN exists for exactly this situation: people who owe federal tax but aren’t eligible for Social Security. Applying is free.

What an ITIN Is (and What It Doesn’t Do)

An ITIN is a nine-digit number issued by the IRS that begins with 9 and follows the same format as an SSN.1Internal Revenue Service. Taxpayer Identification Numbers (TIN) The IRS issues it for one purpose: federal tax reporting.

It doesn’t authorize you to work in the United States. It doesn’t qualify you for Social Security benefits. And it says nothing about your immigration status or your right to remain in the country.2Internal Revenue Service. Topic No. 857, Individual Taxpayer Identification Number (ITIN) Filing a return with an ITIN also doesn’t help you gain legal status. It’s a tax-administration tool, nothing more.

Form W-7: The ITIN Application

You apply on Form W-7, free on irs.gov. The form asks for your legal name, current mailing address, foreign address, and the reason you need the number — most commonly, because you’re filing a required federal return. You also indicate whether you’re a new applicant or renewing an expired ITIN.3Internal Revenue Service. About Form W-7, Application for IRS Individual Taxpayer Identification Number

The identity documentation is the part that trips people up. A current, valid passport is the easiest route because it proves both identity and foreign status on its own. Without a passport, you must submit at least two documents from the IRS’s approved list, which includes national identification cards showing your photo, name, address, date of birth, and expiration date; civil birth certificates; foreign driver’s licenses; and several other options. Every document must be an original or a certified copy from the issuing agency. Photocopies and notarized copies are not accepted.4Internal Revenue Service. Instructions for Form W-7 (Rev. December 2024)

Expired documents and missing fields are the most common reasons applications get rejected. Check dates before mailing anything.

Three Ways to Submit the Application

You have three options, and the choice matters because it decides how long your passport or other originals are out of your hands.5Internal Revenue Service. How to Apply for an ITIN

The first is mail. Send the completed W-7, your tax return, and your original supporting documents to Internal Revenue Service, ITIN Operation, P.O. Box 149342, Austin, TX 78714-9342. The IRS returns your originals to the address on your W-7 after processing, though that can take weeks. A prepaid express envelope can speed up the return.6Internal Revenue Service. ITIN Documentation Frequently Asked Questions (FAQs)

The second is an in-person appointment at an IRS Taxpayer Assistance Center (TAC) that offers ITIN document review. The employee authenticates your documents, hands them back at the appointment, and the office mails the application in. Appointments are required; call 844-545-5640 to book one.7Internal Revenue Service. IRS Taxpayer Assistance Centers Providing In-Person ITIN Document Review

The third is a Certifying Acceptance Agent (CAA). CAAs are IRS-approved individuals or organizations, often at tax preparation firms, who can authenticate most supporting documents, return them to you immediately, and forward your application to the IRS. Fees vary. CAAs operate both inside and outside the United States.8Internal Revenue Service. ITIN Acceptance Agents

If sending your passport away for weeks feels unacceptable, the TAC and CAA routes exist to solve exactly that problem.

Filing the Return Itself

A first-time ITIN application cannot be e-filed. You paper-file Form 1040 with the completed W-7 attached to the front. The IRS treats the package as one submission: it processes the W-7, assigns the ITIN, then sends the return into normal processing.9Internal Revenue Service. Individual Taxpayer Identification Number (ITIN) Do not file them separately.

Expect roughly seven weeks of processing during the off-season, stretching to nine to eleven weeks during peak filing season (January 15 through April 30).9Internal Revenue Service. Individual Taxpayer Identification Number (ITIN) Any refund you’re owed sits with the return until the ITIN is assigned. Filing well before the April deadline generally means a shorter wait.

If You Need More Time

If you can’t finish your return by the April deadline and don’t have an ITIN yet, you can still request an automatic extension using Form 4868. Write “ITIN TO BE REQUESTED” wherever the form asks for an SSN or ITIN. Do not include Form W-7 with the extension. Submit the W-7 later, with your actual return.9Internal Revenue Service. State Returns

An ITIN is a federal number issued for federal tax purposes.2Internal Revenue Service. Topic No. 857, Individual Taxpayer Identification Number (ITIN) Many states with an income tax accept ITINs on their returns, but the rules vary. Check with your state’s tax agency before assuming yours will.

Credits You Can and Can’t Claim

This is where ITIN filers most often lose money by misunderstanding the rules.

The Earned Income Tax Credit is not available if you or your spouse files with an ITIN. Even if your qualifying children have valid SSNs, neither parent can claim the EITC using an ITIN.10Internal Revenue Service. Basic Qualifications

The Child Tax Credit requires that the filer (or spouse, if filing jointly) and each qualifying child have a valid SSN issued before the return’s due date. An ITIN doesn’t satisfy that requirement for either the parent or the child.11Internal Revenue Service. Child Tax Credit

The Credit for Other Dependents, a $500 nonrefundable credit, is available to ITIN holders. The dependent needs an SSN, ITIN, or Adoption Taxpayer Identification Number. If your child or other dependent doesn’t qualify for the Child Tax Credit because of the SSN rule, this credit is the fallback.11Internal Revenue Service. Child Tax Credit

The gap is large. The Child Tax Credit can be worth over $2,000 per child; the Credit for Other Dependents caps at $500. ITIN filers who confuse the two sometimes expect refunds thousands of dollars larger than what actually arrives.

Dependents Who Don’t Have SSNs

Every dependent on your return needs a taxpayer identification number. If a dependent can’t get an SSN, you file a separate Form W-7 for each one along with your return.3Internal Revenue Service. About Form W-7, Application for IRS Individual Taxpayer Identification Number

To qualify as a dependent, a child generally must share your principal home for more than half the tax year, and all dependents must be a U.S. citizen, U.S. national, U.S. resident alien, or a resident of Canada or Mexico.12Office of the Law Revision Counsel. 26 USC 152 – Dependent Defined The Canada and Mexico exception is easy to overlook.

Documentation for dependents is stricter. A dependent’s passport works as a stand-alone document only if it shows a U.S. date of entry. Without that stamp, you’ll need additional records such as school or medical documents proving the dependent actually lived in the country.4Internal Revenue Service. Instructions for Form W-7 (Rev. December 2024) Dependents of U.S. military personnel stationed overseas, and dependents from Canada or Mexico claimed for certain benefits, are exceptions.

Renewing an Expired ITIN

ITINs expire. If yours isn’t used on a federal return for three consecutive years, it expires on December 31 of that third year.13Internal Revenue Service. How to Renew an ITIN An expired ITIN can still appear on information returns like a 1099, but you can’t file a tax return with it until it’s renewed.

Renewal uses the same Form W-7. Check the “Renew an existing ITIN” box, and enter your old ITIN on lines 6e and 6f if you have it. The identity documentation requirements are the same as for a new application. If your name has changed, include supporting documents such as a marriage certificate or court order.13Internal Revenue Service. How to Renew an ITIN Spouses and dependents renewing must appear on a federal return attached to the renewal, together with any schedule or form claiming the relevant benefit. The same three submission methods apply.

What Happens If You Skip Filing

Some people assume that not having an SSN or ITIN lets them skip filing. It doesn’t, and skipping is expensive. If you owe taxes and don’t file, the failure-to-file penalty is 5% of the unpaid tax for each month the return is late, capped at 25%. If the return is more than 60 days late, the minimum penalty for returns due after December 31, 2025, is $525.14Internal Revenue Service. Failure to File Penalty

The IRS can waive the penalty for reasonable cause, but “I didn’t have an ITIN” is a weak argument when the application is free and available year-round.15Internal Revenue Service. Check if You Need to File a Tax Return If you earn income in the U.S. and meet the filing thresholds, you owe a return regardless of citizenship or immigration status. Apply for the ITIN and file.
