Can You File Taxes Without a Social Security Number?

You can file a federal tax return without a Social Security number by applying for an Individual Taxpayer Identification Number (ITIN) from the IRS. What an ITIN Is (and Isn’t)

An ITIN is a nine-digit number that begins with “9” and is formatted like a Social Security number. The IRS issues it to nonresident aliens, resident aliens, and their spouses or dependents who need to file a federal tax return but are not eligible for a Social Security number.2Internal Revenue Service. An ITIN exists for one purpose: federal tax processing. It does not give you the right to work in the United States, and it does not qualify you for Social Security benefits.3Internal Revenue Service. How to Apply for an ITIN

Form W-7 and Your Filing Reason

You apply by completing IRS Form W-7 and checking the reason that fits your situation. The categories include nonresident aliens filing a return, resident aliens who meet the substantial presence test, dependents or spouses of U.S. citizens or residents, and foreign students, professors, and researchers temporarily in the country.4Internal Revenue Service. Documents You Need

Your application must prove both your identity and your foreign status. A valid passport is the simplest option because it covers both on its own. Without a passport, you need at least two documents from an IRS list of 13 acceptable items, and at least one must show a photograph (with an exception for dependents under 14, or under 18 if a student).4Internal Revenue Service. All documents must be originals or certified copies from the issuing agency. Notarized photocopies are not accepted.

Three Ways to Submit

The standard route is to attach Form W-7 to the front of your paper federal tax return and mail the package to the IRS ITIN Operation in Austin, Texas.5Internal Revenue Service. The drawback is that your original documents travel with the application and can be out of your hands for weeks.

You can instead visit an IRS Taxpayer Assistance Center that offers ITIN services, where staff verify your documents in person and hand them back the same day. Appointments are required through 844-545-5640, and wait times can run several weeks. Each applicant, including spouses and dependents, must appear in person. Most documents can be authenticated on the spot, though school and medical records for dependents still have to be mailed.6Internal Revenue Service. A third option is to work with an IRS-authorized Certifying Acceptance Agent (CAA). CAAs verify your identity and original documents in person and submit the application for you, so you do not have to mail your passport to the IRS.7Internal Revenue Service. ITIN Acceptance Agent Program They charge a fee, often ranging from around $50 to several hundred dollars depending on the provider and whether tax preparation is included.

How Long It Takes

The IRS generally processes an ITIN application in about seven weeks and notifies you of the outcome. Applications filed during tax season (January 15 through April 30) or from outside the United States can take 9 to 11 weeks.3Internal Revenue Service. The date the IRS receives your Form W-7 usually becomes your ITIN assignment date. That matters because some tax credits require the taxpayer number to be issued on or before the return’s due date, including extensions.8Internal Revenue Service. Which Credits You Can Claim With an ITIN

An ITIN lets you file and pay, but it does not open every credit on the return. Two of the largest refundable credits are off-limits.

You cannot claim the Earned Income Tax Credit with an ITIN. The statute defines the required taxpayer number for the EITC as a Social Security number issued by the Social Security Administration, and both spouses on a joint return must have valid Social Security numbers.9Office of the Law Revision Counsel. 26 U.S.C. 32 – Earned Income10Internal Revenue Service. The Child Tax Credit and Additional Child Tax Credit require each qualifying child to have a Social Security number valid for employment, issued before the return’s due date. An ITIN does not satisfy that requirement.11Internal Revenue Service. Child Tax Credit

If your child or dependent has an ITIN or ATIN, you may still qualify for the Credit for Other Dependents, worth up to $500 per dependent. The dependent must be claimed on your return and be a U.S. citizen, national, or resident alien.11Internal Revenue Service. Child Tax Credit

A refund on an ITIN return can therefore be smaller than one for an otherwise identical filer with a Social Security number. Knowing which credits apply before you file helps you avoid claims that will be denied and delay processing.

Renewing an Expired ITIN

An ITIN expires on December 31 of the third consecutive year in which it is not used on a federal return.12Internal Revenue Service. How to Renew an ITIN Some older ITINs issued before 2013 have already been phased out based on middle digits, so confirm your number is still active before filing.

Renewal uses the same Form W-7, with the “Renew an existing ITIN” box checked. You submit the same kinds of identity documents and attach the renewal to a federal return (or qualify for an exception). If your legal name has changed, include documentation such as a marriage certificate or court order.12Internal Revenue Service. Pending Adoptions: The ATIN

If you are adopting a child who is a U.S. citizen or resident and cannot get a Social Security number for the child in time to file, you can apply for a temporary ATIN using Form W-7A.13Internal Revenue Service. Form W-7A collects the child’s basic information along with the adoptive parents and placement agency, and it must be supported by legal proof that the child has been placed in your home for adoption. That can be a placement agreement from an authorized adoption agency or a court order establishing legal guardianship, showing placement by a government-authorized entity.13Internal Revenue Service. Once issued, the ATIN goes in the dependent section of your return where a Social Security number would appear. It lets you claim the Credit for Other Dependents and other applicable benefits during the adoption. The IRS deactivates an ATIN within two years, so it is strictly temporary. After the adoption is finalized, get a Social Security number for the child, notify the IRS so the ATIN is deactivated, and use the Social Security number on future returns. That switch also opens the door to the full Child Tax Credit if the other requirements are met.

What Happens If You Don’t File

Lacking a Social Security number is not a reason to skip filing. If you owe tax and do not file, the IRS charges a failure-to-file penalty of 5% of the unpaid tax for each month or partial month the return is late, up to 25%.14Internal Revenue Service. Beyond the dollar penalties, gaps in your tax history can complicate later immigration applications and make it harder to show a consistent record if you eventually apply for a Social Security number or adjust status. Getting an ITIN and filing on paper avoids both problems.
