Can You Claim Stamp Duty Back? Deadlines, Process, and Interest

You can claim Stamp Duty back from HMRC in a handful of defined situations: most often when you paid the higher rate surcharge on a new home and then sold your previous main residence, but also when you paid the non-UK resident surcharge and later met the residency test, when a property was wrongly classified as residential, or when your original SDLT return contained an error. Each route has its own deadline, and missing it almost always means losing the money for good.

When You Can Reclaim SDLT

You Replaced Your Main Home

This is the most common refund. If you bought a new home while still owning your previous one, HMRC would have charged the higher rate surcharge at completion. From 1 April 2025, that surcharge is 5 percentage points on top of every band of the standard residential scale; for purchases completed before that date it was 3 percentage points.1GOV.UK. Stamp Duty Land Tax: Higher Rates on Purchases of Additional Residential Properties Sell the old home within three years, and the transaction is treated as a straightforward replacement of your main residence under Schedule 4ZA of the Finance Act 2003. The surcharge portion becomes refundable.3UK Government. Finance Act 2003, Schedule 4ZA

Two conditions matter. The property you sold must have genuinely been your main home; selling a buy-to-let or holiday place you happen to also own does not qualify. And the new property must become your main residence, so a purchase you always intended to let out is outside the relief.

You Paid the Non-UK Resident Surcharge and Later Met the Residency Test

Buyers who were not UK residents at completion pay an extra 2% on top of the standard or higher rates. If you subsequently meet the residency test, that 2% is reclaimable by amending your SDLT return.4GOV.UK. Rates of Stamp Duty Land Tax for Non-UK Residents

The test is presence in the UK for at least 183 days in any continuous 365-day period that begins no more than 364 days before the purchase and ends no more than 365 days after it. Where more than one person bought together, each buyer must pass the 183-day test individually, though they can each pick a different 365-day window.4GOV.UK. The Property Was Wrongly Classified

If a property was genuinely uninhabitable at the point of purchase, it may not count as a residential dwelling for SDLT, and non-residential rates (which are lower) should have applied. The test is whether the building functioned as a dwelling at the time the SDLT charge arose, not whether it could be renovated back into one.

Approach this with caution. HMRC has been actively targeting what it calls bogus reclassification claims, using civil and criminal powers against dishonest agents and buyers. A dated kitchen or cosmetic disrepair does not qualify; the building must lack the fundamental characteristics of a dwelling.5GOV.UK. Homebuyers Warning as HMRC Gets Tough on Bogus Stamp Duty Claims

Separately, a purchase that included both residential and non-residential elements (a flat above a shop, for example) should have been taxed at mixed-use rates, which are substantially lower than residential rates.6GOV.UK. Rates for Non-Residential and Mixed Land and Property If your solicitor classified a genuinely mixed-use purchase as purely residential, the difference may be reclaimable.

The Original Return Contained an Error

Wrong band, missed relief, wrong property type: return errors are more common than most buyers expect. You can amend your SDLT return within 12 months of the filing date.7GOV.UK. One relief that used to feature in these corrections no longer exists. Multiple Dwellings Relief was abolished for SDLT transactions completing on or after 1 June 2024.8HM Revenue & Customs. For anything completing on or after 1 June 2024, MDR is unavailable.

The Deadlines

SDLT refund deadlines are strict, and late claims are usually refused outright.

For the main residence replacement refund, your previous home must sell within three years of buying the new one.9GOV.UK. The “sale date” is the effective date of the transaction, which is normally legal completion rather than exchange. Where a contract was substantially performed before completion, that earlier date can become the effective date instead.7GOV.UK. Stamp Duty Land Tax Online and Paper Returns

For the non-resident surcharge, you have two years from the effective date of the transaction to claim.10GOV.UK. Apply for a Repayment of the Non-UK Resident Stamp Duty Land Tax Surcharge

Exceptional Circumstances

If you could not sell the previous home within three years for reasons genuinely beyond your control, HMRC may accept a late claim, but the bar is high. Exceptional circumstances typically involve events affecting large groups of people rather than your individual transaction: government-imposed restrictions on property sales or actions by a public authority blocking the sale are the examples HMRC gives.9GOV.UK. What does not qualify: failing to find a buyer at your asking price, delays over terms, a broken chain. Those are treated as normal risks of selling. And even where circumstances do qualify, you must sell without further delay once the obstacle lifts.9GOV.UK. Apply for a Refund of the Higher Rates of Stamp Duty Land Tax

What You Need Before You Apply

Have these details to hand:

  • Your Unique Transaction Reference Number (UTRN), the 11-character code on your SDLT5 certificate or on correspondence from HMRC after your purchase.11GOV.UK. Business Rules for SDLT Returns – Stamp Taxes Online
  • The full address of the new home you bought and the old home you sold.
  • The completion date of the new purchase and the completion date of the old home’s sale.
  • The total SDLT originally paid, so HMRC can calculate the refundable surcharge.
  • Your account number and sort code for the refund transfer.

Cross-check every field against your completion statements. A minor discrepancy on an address or date can trigger manual review and add weeks. If a solicitor or accountant is applying for you, they need a signed letter of authority.9GOV.UK. Apply for a Refund of the Higher Rates of Stamp Duty Land Tax

How to Submit the Claim

For the main residence replacement refund, HMRC’s online service is the fastest route. Sign in with your existing credentials or set up an account. The form prompts each required field and generates a confirmation on submission. Online claims are typically processed within 15 working days.9GOV.UK. The non-resident surcharge has a separate online process. Sign in with your Self Assessment credentials, or apply using an email address if you have none. If an agent is submitting the claim, upload a signed letter of authority. Where the refund needs to go to an account that is not yours, the authority letter must specifically authorise that and include the account details.10GOV.UK. Interest You’ll Receive, and the Risk of a Bad Claim

HMRC pays repayment interest on refunds, calculated from the date you paid the tax to the date it is refunded. As of January 2026 the rate is 2.75%, set at the Bank of England base rate minus 1% with a floor of 0.5%.12GOV.UK. Rates and Allowances: HMRC Interest Rates for Late and Early Payments On a large surcharge refund that takes a year or two to resolve, it is a useful addition.

The consequences of an inaccurate claim go the other way. HMRC has warned publicly that a false or inflated claim can leave you repaying the full refund plus penalties and interest, and homebuyers can end up paying more than the amount they were trying to recover. This applies even where an agent submitted the claim on your behalf.5GOV.UK. Homebuyers Warning as HMRC Gets Tough on Bogus Stamp Duty Claims The focus of the crackdown is uninhabitable-property claims pushed by agents on properties that plainly still function as homes. If a firm approaches you promising an easy SDLT refund based on the condition of your property, treat that with real scepticism.
