You cannot currently change the Social Security gender marker on your record. The Social Security Administration stopped accepting sex field changes on the Numident database on January 31, 2025, and staff have been instructed to tell anyone who asks that the agency is “not able to accept or process a sex field change” at this time.1Social Security Administration. Why the SSA Stopped Processing These Changes

The suspension traces to Executive Order 14168, signed January 20, 2025, which defines sex for federal purposes as an immutable biological classification and directs agencies to offer only “male” or “female” on government forms.2The White House. Between roughly October 2022 and January 2025, the SSA had allowed self-attestation: an applicant could select “Male” or “Female” on Form SS-5 without a doctor’s letter, court order, or amended birth certificate.4Social Security Administration. Could the Policy Change

Possibly, through court orders, new executive action, or legislation. Legal challenges to Executive Order 14168 are underway in multiple areas of federal policy. In the closest parallel, a federal judge in Massachusetts temporarily blocked enforcement of the order against transgender and nonbinary passport applicants, and the Supreme Court was weighing that injunction as of late 2025.

No comparable court order has been issued requiring the SSA to resume processing sex field changes. This is an area of active litigation, so the answer for any given month depends on what has happened in court recently.

What You Can Still Do at the SSA

Name changes remain available. The SSA still processes them through Form SS-5 with appropriate legal documentation: a court order, marriage certificate, divorce decree, or naturalization certificate proving the new legal name.5Social Security Administration. The online “my Social Security” portal handles name changes, contact information, communication preferences, and citizenship status. State IDs and Other Documents

Many states still allow gender marker changes on driver’s licenses, state IDs, and birth certificates through their own procedures. Requirements vary: some accept self-attestation, others require a court order or medical documentation, and a few do not allow changes at all. A state-level update will not change your federal Social Security record, but it does update the identification you use day to day. If aligning your daily-use ID is the immediate priority, your state’s vital records office and motor vehicle agency are the practical next stops.

The U.S. passport situation is unsettled. The same executive order directed the State Department to issue passports reflecting biological sex only, and federal courts have temporarily blocked enforcement against some applicants. That litigation was before the Supreme Court as of late 2025, and the outcome will shape how broadly the order applies to federal identity documents.

What a Mismatch Between Your Records Can Cause

The sex marker on your Social Security record feeds into other federal systems, which is why a locked-in marker can create friction in adjacent processes.

Tax Filing

The IRS cross-references your name and Social Security number against SSA records when processing returns. A mismatch between the marker on file and what an employer reports can flag a return for manual review and delay a refund. If your SSA record shows a designation that no longer matches your other documents, that mismatch may persist until federal policy changes.

Medicare and Health Coverage

Medicare enrollment draws directly from Social Security data. The marker on your Numident record is what Medicare uses for eligibility determinations and billing codes. If you enrolled in Medicare or applied for marketplace health insurance before the suspension, your current designation is what those systems reflect. Conflicting markers across your records can create friction with insurers and providers.

Employment Verification and E-Verify

When an employer runs you through E-Verify, the system checks your Form I-9 information against SSA and Department of Homeland Security records.
