Can You Buy Laudanum? Legal Status, Prescriptions, and Costs

You can buy laudanum in the United States only with a prescription from a licensed, DEA-registered practitioner, and it will be dispensed as opium tincture, the modern pharmaceutical name for the same preparation. It is a Schedule II controlled substance, so there is no over-the-counter option, no legal online purchase without a prescription, and no importing it from a foreign pharmacy. In practice, doctors rarely write for it because safer alternatives exist for almost every condition it once treated.

Why It’s Prescription-Only

Opium and its derivatives sit in Schedule II of the federal Controlled Substances Act. That category is for drugs the government recognizes as having legitimate medical uses but also a high potential for abuse leading to severe physical or psychological dependence.1Office of the Law Revision Counsel. 21 USC 812 – Schedules of Controlled Substances Oxycodone, fentanyl, and amphetamine share the same schedule, which tells you how the drug is treated at the federal level.

The product itself is potent. Each 100 milliliters of opium tincture contains 1 gram of morphine, equivalent to 10 grams of powdered opium, dissolved in a 19% alcohol solution.2Drugs.com. Opium Tincture: Package Insert / Prescribing Information That works out to 10 milligrams of morphine per milliliter. Morphine is the primary active ingredient, though the tincture also contains other opium alkaloids such as codeine.3National Cancer Institute. Opium Tincture – NCI Drug Dictionary

How a Prescription Actually Works

To get opium tincture, you need a written or electronic prescription from a practitioner registered with the Drug Enforcement Administration. A pharmacist can accept an oral prescription in an emergency, but the prescriber has to deliver a written version within seven days.4eCFR. Part 1306 Prescriptions

Refills are prohibited. Once your prescription is filled, you need a brand-new one for any additional supply.5Office of the Law Revision Counsel. 21 USC 829 – Prescriptions A practitioner can issue multiple prescriptions at the same visit covering up to a 90-day supply total, but each one is its own document with its own fill date. If a pharmacist can only partially fill your prescription and you don’t return for the balance, the remaining portion expires after 30 days, or 72 hours if it was an emergency oral order.4eCFR. Part 1306 Prescriptions

Federal law does not set an express ceiling on how much a doctor can prescribe at one time. What it does require is that every prescription be for a legitimate medical purpose issued in the usual course of professional practice.6Drug Enforcement Administration. Practitioner’s Manual States add their own rules on top, including prescription drug monitoring programs that log every controlled substance dispensed at every pharmacy. Prescribers who participate in Medicare Part D must also transmit at least 70% of their Schedule II through V prescriptions electronically.7eCFR. 42 CFR 423.160 – Standards for Electronic Prescribing

Why Doctors Rarely Prescribe It

Opium tincture has two remaining medical uses, and even for those it is not usually the first choice.

The more common use is treating severe, persistent diarrhea that has not responded to standard medications like loperamide or diphenoxylate. The FDA granted opium tincture orphan drug designation in 2011 for chronic diarrhea in short bowel syndrome patients who do not respond adequately to other treatments.8U.S. Food and Drug Administration. Orphan Drug Designations and Approvals Even with that designation, the drug has not received FDA approval for the orphan indication.

The second use is managing neonatal opioid withdrawal syndrome in newborns exposed to opioids before birth. In those cases the tincture is diluted 25-fold and tapered over days or weeks. Morphine sulfate solutions have increasingly replaced it in that role.

For nearly everything else laudanum was once used to treat, better options exist. Pain gets treated with NSAIDs, acetaminophen, nerve blocks, or more predictable opioid formulations when opioids are truly needed. Coughs get dextromethorphan or codeine-based products. The clinical era for laudanum is over, which is why a prescription request will usually be met with an alternative recommendation.

Can You Buy It From Overseas or Online?

No, and this is where people run into trouble. Federal law broadly prohibits importing any Schedule I or II controlled substance into the United States, except for quantities the Attorney General approves to meet domestic medical or scientific needs.9Office of the Law Revision Counsel. 21 USC 952 – Importation of Controlled Substances Ordering opium tincture from a foreign online pharmacy or having it mailed from abroad falls inside that prohibition, regardless of whether the source country treats the drug differently.

Traveling with a personal supply is a separate situation. If you already have a valid U.S. prescription and are returning from abroad, U.S. Customs and Border Protection asks you to declare the medication, keep it in its original container, carry a copy of the prescription or a doctor’s letter, and bring only a quantity reasonable for personal use. A U.S. resident crossing a land border without a prescription from a DEA-registered practitioner cannot import more than 50 dosage units. Foreign visitors should carry no more than a 90-day supply along with documentation in English.10U.S. Customs and Border Protection. Traveling With Medications

What Happens If You Buy or Possess It Without a Prescription

Simple possession of a controlled substance without a valid prescription is a federal crime. A first offense carries up to one year in prison and a minimum fine of $1,000.11Office of the Law Revision Counsel. 21 USC 844 – Penalties for Simple Possession

Distributing or selling it is far worse. For a Schedule II substance, federal law allows up to 20 years in prison and fines reaching $1 million for an individual. If someone dies or suffers serious bodily injury from the substance, the minimum sentence jumps to 20 years and can reach life. A second felony drug offense pushes the ceiling to 30 years, and if death results after a prior conviction, life imprisonment is mandatory.12Office of the Law Revision Counsel. 21 USC 841 – Prohibited Acts A Those are the federal numbers alone; state charges can stack on top.

What It Costs With a Prescription

Opium tincture is expensive. The retail cash price for a standard 118-milliliter bottle (about 4 ounces) without insurance typically runs between $740 and $970, though pharmacy discount programs may bring that down. Insurance coverage varies and often requires prior authorization, given the Schedule II status and the availability of cheaper alternatives. If your doctor believes the drug is medically necessary and your insurer denies coverage, ask the prescriber to submit a prior authorization explaining why standard treatments have failed.

The Short Version

Laudanum is legal to buy in the United States only through a licensed prescriber who determines it is the right treatment, filled at a U.S. pharmacy, with no refills and no mail-order shortcut from abroad. If your interest is historical or curiosity-driven rather than medical, there is no lawful path to purchase. If it is medical, the conversation to have is with a doctor, who will most likely explain why a different medication is a better fit.
