Can You Buy Hot Food With EBT? Restaurant Program and Waivers

In most cases, you cannot buy hot food with EBT. Federal SNAP rules exclude “hot foods and hot food products prepared for immediate consumption” from what your benefits will cover.1eCFR. 7 CFR 271.2 There are two exceptions: the Restaurant Meals Program, which operates in nine states and only serves certain households, and temporary disaster waivers issued after a Presidential Disaster Declaration.

What Counts as Hot Food

The rule turns on temperature at the register, not how the food was originally made. If the item is warm when you carry it to checkout, SNAP will not pay for it. That covers rotisserie chickens, hot soup from a deli bar, heated sandwiches, pizza kept under a heat lamp, and hot coffee from a store counter.2Food and Nutrition Service. What Can SNAP Buy

The same food sold cold is a different story. A frozen pizza from the freezer case is eligible. A cold rotisserie chicken in the refrigerated section is eligible. Slide either one under a warmer, and it becomes ineligible.

Cold Prepared Foods Are Eligible

A common misconception is that SNAP only covers raw ingredients. It doesn’t. SNAP covers any food for the household so long as it isn’t hot at the point of sale and doesn’t fall into a few excluded categories like alcohol or tobacco.2Food and Nutrition Service. If you’re standing at a deli and the version you want is available cold, you can buy it with SNAP. The restriction is about heat, not preparation.

The Restaurant Meals Program

The Restaurant Meals Program (RMP) is a state option that lets certain SNAP households buy prepared meals, including hot food, at approved restaurants. Eligibility is narrow.   • Age 60 or older
  • Receiving disability or blindness payments, or government disability retirement benefits for a condition considered permanent
  • Homeless, meaning you lack permanent housing where you can store and prepare food
  • Married to someone who meets one of the above

The “every member” piece catches people. If you are 65 and share a SNAP household with a 30-year-old who isn’t disabled, the household doesn’t qualify even though you personally do.

States That Run the Program

  • Arizona
  • California (many counties, the largest footprint in the country)
  • Illinois (Cook and Franklin Counties only)
  • Maryland
  • Massachusetts
  • Michigan
  • New York
  • Rhode Island
  • Virginia

Even inside these states, individual restaurants choose whether to participate. Look for signage at the restaurant or check with your state SNAP agency for a list of authorized locations. If you live outside these nine states, the program is not available to you regardless of your household’s circumstances.

Using the Card at a Restaurant

The transaction works the same way it does at a grocery store. You swipe the EBT card at the terminal and enter your PIN, and the amount comes out of your SNAP balance.4Food and Nutrition Service. Disaster Waivers

After a Presidential Disaster Declaration for individual assistance, a state or territory can ask the USDA to waive the hot-food restriction. If approved, all SNAP households in the affected area can temporarily buy hot, prepared meals with their benefits.5Food and Nutrition Service. Waivers are time-limited and tied to the specific disaster. You don’t need to enroll or apply separately. If you already receive SNAP in the covered area, the waiver applies automatically for the window USDA sets.

What Happens If You Try to Work Around the Rules

  • First intentional program violation: one-year disqualification
  • Second violation: two-year disqualification
  • Third violation: permanent disqualification

Criminal charges are a separate track. Unauthorized use of benefits worth $5,000 or more is a federal felony carrying up to 20 years in prison and fines up to $250,000.
