Buying a house after Chapter 13 bankruptcy is possible, and for many borrowers it happens sooner than they expect. FHA, VA, and USDA loans can be approved as early as 12 months into an active repayment plan if payments are current and the bankruptcy court signs off. Conventional loans backed by Fannie Mae or Freddie Mac require a two-year wait measured from the discharge date. The right path depends on which loan type you qualify for, whether your plan is still active or already discharged, and your payment record inside the plan.
Buying During an Active Chapter 13 Plan
Chapter 13 is a court-supervised repayment plan that runs three to five years, during which you keep your property and pay creditors through a trustee.1United States Courts. Chapter 13 Bankruptcy Basics You don’t have to wait until it ends to buy a home, but the requirements are specific.
For government-backed loans, the core requirement is 12 months of consecutive, on-time plan payments. FHA guidelines allow a borrower to get an FHA-insured mortgage as long as at least 12 months of the payout period have elapsed, all required payments were made on time during that period, and the borrower received written permission from the bankruptcy court to enter the mortgage transaction.2U.S. Department of Housing and Urban Development. A single missed or late payment during that first year effectively restarts the clock. Both the trustee and your lender will pull your payment ledger, so there’s no way around a lapse. Your plan also needs to be confirmed by the court before most lenders will proceed. Until confirmation, your budget isn’t finalized, and underwriters can’t assess whether a mortgage fits on top of the plan payments.
The Motion to Incur Debt
You can’t close on a house during Chapter 13 without a signed court order. Under 11 U.S.C. ยง 1305, a creditor’s claim for debt taken on after filing can be disallowed entirely if the creditor knew that getting trustee approval first was practical and didn’t bother.5Office of the Law Revision Counsel. 11 USC 1305 – Filing and Allowance of Postpetition Claims No legitimate mortgage lender will fund the loan without that order in hand.
Your bankruptcy attorney files what’s called a Motion to Incur Debt, sometimes labeled a Motion for Authority to Incur Debt.6United States Bankruptcy Court. Motion to Incur Debt The motion includes a loan estimate showing the purchase price, interest rate, and full monthly payment with principal, interest, taxes, and insurance. It also includes the trustee’s payment ledger.
The trustee reviews whether the new mortgage fits your budget without jeopardizing existing creditors. If the numbers work, the trustee files a recommendation and the judge schedules a hearing, typically within 30 to 45 days of the motion. The signed order has to match the loan estimate’s terms. If your interest rate changes between the motion and closing, you may need an amended order before the title company will close.
Along with standard mortgage documentation (two years of tax returns and W-2s, recent pay stubs, 60 to 90 days of bank statements showing seasoned funds for your down payment), the trustee’s payment ledger is the critical piece. It functions as a substitute credit history, demonstrating that you’ve carried a large recurring obligation without default. A pre-approval letter from a lender experienced with bankruptcy cases helps too, especially one stating that the loan is contingent only on court approval and the final appraisal.
Waiting Periods After Discharge
Once you complete your plan and receive a discharge, more loan options open up. Each program has its own timeline.
FHA Loans
FHA is usually the most accessible option. Because FHA already permits applications 12 months into an active plan, borrowers who complete the plan face no additional waiting period.2U.S. Department of Housing and Urban Development. VA Loans
VA-backed loans follow a similar pattern, with a typical waiting period of one year for Chapter 13.3U.S. Department of Veterans Affairs. Dont Delay Secure Your VA Home Loan Because plans run three to five years, most borrowers who finish the plan have already satisfied this requirement well before discharge.
USDA Loans
USDA guaranteed loans require 12 months of on-time payments during an active plan. Conventional Loans
Conventional loans backed by Fannie Mae carry a two-year waiting period measured from your discharge date.7Fannie Mae. Significant Derogatory Credit Events – Waiting Periods and Re-establishing Credit Freddie Mac applies the same two-year benchmark from discharge.8Freddie Mac. Guide Section 5202.1 Add that to the three-to-five-year plan itself, and conventional financing typically becomes available five to seven years after your original filing.
Discharge Versus Dismissal
Whether your case ends in discharge or dismissal changes the timeline dramatically. A discharge means you completed every payment in your plan and the court released you from remaining eligible debts. A dismissal means the case ended without completion, usually because payments were missed or the plan became unworkable.
For Fannie Mae conventional loans, a dismissed Chapter 13 triggers a four-year waiting period from the dismissal date, double the two-year wait after a discharge.7Fannie Mae. Significant Derogatory Credit Events – Waiting Periods and Re-establishing Credit Freddie Mac follows the same four-year timeline from dismissal.8Freddie Mac. Guide Section 5202.1 Fannie Mae allows a reduction to two years after dismissal with documented extenuating circumstances such as a serious medical event or job loss outside your control; there are no exceptions to the two-year wait after a standard discharge.
For FHA and VA loans, a dismissal eliminates the favorable 12-month in-plan pathway. These borrowers face longer waits and must demonstrate re-established credit before applying. If you’re struggling with payments, working with your attorney to modify the plan is almost always better than letting it get dismissed.
Credit Scores and Down Payments
Your credit score after Chapter 13 determines both which loans you qualify for and how much cash you need upfront.
- FHA loans: a score of 580 or higher qualifies for the minimum 3.5% down payment, while scores between 500 and 579 require 10% down. FHA also allows the down payment to come from a family member, employer, or charitable organization as a gift.9U.S. Department of Housing and Urban Development. How Can FHA Help Me Buy a Home
- VA loans: no down payment is required in most cases, which makes these loans particularly valuable for eligible veterans and service members rebuilding after bankruptcy.
- USDA loans: no down payment required, though the property must sit in an eligible rural area and your household income must fall within program limits.
- Conventional loans (Fannie Mae): minimum credit score of 620 for fixed-rate mortgages and 640 for adjustable-rate mortgages. Down payments start at 3% to 5% depending on the program, though borrowers coming out of bankruptcy often face higher requirements or need private mortgage insurance.10Fannie Mae. General Requirements for Credit Scores
Because Chapter 13 filers usually see their scores drop significantly, FHA and VA are where most post-bankruptcy home purchases happen. Reaching 620 is realistic within a year or two of discharge for borrowers who manage new credit carefully; the 700+ range that unlocks the best conventional rates takes longer.
How Long Chapter 13 Stays on Your Credit Report
A Chapter 13 bankruptcy remains on your credit report for seven years from the filing date, not the discharge date. Since the plan itself runs three to five years, you’ll carry the notation for roughly two to four years after discharge. That’s better than Chapter 7, which stays on your report for 10 years.
The impact on your score diminishes over time, especially as you add positive credit history. Secured credit cards, small installment loans paid on time, and low credit utilization all accelerate recovery. Lenders will pull your credit through the standard bureaus and many will also verify your bankruptcy’s final status through the Public Access to Court Electronic Records system.11Public Access to Court Electronic Records. Public Access to Court Electronic Records Check that your report accurately shows the bankruptcy as discharged rather than active. Errors are common and can delay or derail an application.
Manual Underwriting and Compensating Factors
Automated underwriting systems tend to reject applications from borrowers in active bankruptcy, so most of these loans go through manual underwriting instead. A human underwriter weighs factors an algorithm would dismiss. The stronger your compensating factors, the higher the debt-to-income ratio the lender will tolerate.
The most common compensating factors include cash reserves equal to at least three months of mortgage payments after closing, a new mortgage payment that increases your current housing cost by no more than $100 or 5%, and residual income meeting established benchmarks based on family size and region. Borrowers with no consumer debt beyond their plan payments also receive favorable treatment. These factors matter most when your debt-to-income ratio sits above 43%, which is where many bankruptcy applicants land once a mortgage is layered on top of existing plan obligations.
