Can Teachers Collect Spousal Social Security Now?

Teachers can now collect spousal Social Security benefits without the reduction that used to wipe them out. The Social Security Fairness Act, signed on January 5, 2025, eliminated the Government Pension Offset, and the change is retroactive to benefits payable starting January 2024.1Social Security Administration. What the Repeal Actually Did

For decades, the Government Pension Offset subtracted two-thirds of a teacher’s non-covered government pension from any Social Security spousal or survivor benefit. For most teachers with a full career pension, that math zeroed the benefit out entirely, which is why so many never bothered filing.

The Social Security Fairness Act ended the GPO and the related Windfall Elimination Provision. December 2023 is the last month either rule applies. SSA began adjusting monthly payments on February 25, 2025. Most affected people started receiving the new amount in April 2025. As of July 7, 2025, the agency had completed over 3.1 million payments totaling $17 billion.1Social Security Administration. Do You Qualify for a Spousal Benefit

The basic eligibility rules apply to teachers the same way they apply to anyone else. You must be at least 62, and your marriage must have lasted at least one continuous year before you apply.2Office of the Law Revision Counsel. 42 USC 402 – Old-Age and Survivors Insurance Benefit Payments

Divorced? You can still qualify if the marriage lasted at least ten years, you haven’t remarried, and your former spouse is eligible for benefits.2Office of the Law Revision Counsel. 42 USC 402 – Old-Age and Survivors Insurance Benefit Payments Your ex doesn’t need to have filed yet, and your claim doesn’t touch their benefit or their current spouse’s.

At full retirement age, the spousal benefit is 50 percent of the primary worker’s benefit. Claim earlier and the percentage drops: 25/36 of one percent for each of the first 36 months you claim early, then 5/12 of one percent for each additional month. If You Were Already Getting a Reduced Benefit

You don’t need to file anything. SSA is handling the recalculation automatically. You’ll get a one-time retroactive payment covering the increase back to January 2024, plus a higher ongoing monthly amount. If You Never Applied Because of the GPO

This is the group that needs to act. The Fairness Act did not change how far back an application can reach. Retroactivity for retirement and spousal benefits is generally limited to six months before the month you file.1Social Security Administration. Apply online if you’re 62 or older, or call SSA at 1-800-772-1213. Have your marriage certificate, proof of your age, and your spouse’s Social Security number ready. Divorced spouses should also bring the final divorce decree.4Social Security Administration. Survivor Benefits Are Bigger and Also Reopened

The GPO repeal applies to survivor benefits as well. If your spouse has died and you were previously denied or reduced because of the offset, those benefits are now payable in full.1Social Security Administration. If you remarried after age 60, you may still qualify for survivor benefits on your deceased spouse’s record or benefits on your new spouse’s record. SSA can tell you which pays more.5Social Security Matters. Will Remarrying Affect My Social Security Benefits?

One catch: survivor applications are not available online. You have to call 1-800-772-1213 to file.1Social Security Administration. Teachers Who Also Have Their Own Social Security Credits

Plenty of teachers worked summers, held private-sector jobs before entering the classroom, or moved into covered employment later. Those teachers earned their own Social Security credits alongside the state pension. The Windfall Elimination Provision used to shrink the benefit calculated from that covered work. It’s gone under the same timeline as the GPO, and SSA is recalculating those benefits automatically for people already on the rolls. If you never filed on your own record because WEP made the number look negligible, you’ll need to apply, and the six-month limit applies here too.1Social Security Administration. When you qualify for both your own retirement benefit and a spousal benefit, SSA pays whichever is higher. With both the WEP and GPO gone, run both numbers. A teacher with 15 or 20 years of covered employment may find the own-record benefit exceeds the spousal amount.

Teachers in States That Already Pay Into Social Security

Roughly 13 states and the District of Columbia have teacher retirement systems that sit outside Social Security. In every other state, teachers pay into Social Security alongside the state pension. If you paid Social Security taxes throughout your teaching career, neither the GPO nor the WEP ever touched you, and the Fairness Act doesn’t change your situation. Your spousal benefit works like any other worker’s.

Not sure which category you fall into? Check your Social Security statement at ssa.gov. Years you paid Social Security taxes will show earnings. Years of non-covered teaching will show zero, even if you worked full-time.

If SSA Gets the Number Wrong

SSA is processing millions of recalculations, and mistakes happen. If your adjusted benefit looks wrong, or your pension information was recorded incorrectly, you have 60 days from the date you receive the determination to request reconsideration.6Social Security Administration. If SSA is working from an outdated pension figure, a current statement from your pension administrator can change the outcome.
