Can Someone Seeking Asylum Work in the US? EAD and 180-Day Wait

If you have a pending asylum case, you can qualify for an asylum seeker work permit, but only after your application has been on file for 180 days and only if you submit a separate application on Form I-765. The permit is called an Employment Authorization Document, or EAD, and it is filed under eligibility category (c)(8). As of December 2025, USCIS issues these permits with a maximum validity of 18 months, down from the previous five years.

The 180-Day Waiting Period

You cannot apply for a work permit the moment you file Form I-589. Federal regulations require your asylum application to be pending for at least 150 days before you can submit Form I-765, and USCIS cannot approve the work permit until day 180.1eCFR. 8 CFR 208.7 – Employment Authorization2U.S. Citizenship and Immigration Services. Asylum Filing at day 150 gives USCIS a 30-day window to process the application, but approval will not come earlier than the 180-day mark no matter how quickly the agency works.

USCIS tracks this timeline through the “180-Day Asylum EAD Clock.” The clock starts when a complete asylum application is received by USCIS or an immigration court.

What Stops the EAD Clock

The clock does not always tick continuously. Delays that you cause or request pause it, which can push your eligibility date weeks or months later. USCIS stops the clock when you:2U.S. Citizenship and Immigration Services. Asylum

  • Ask to reschedule your asylum interview
  • Fail to appear for an interview or biometrics appointment
  • Ask for more time to submit evidence at or after an interview
  • Fail to provide a competent interpreter when one is required
  • Request a case transfer to a different asylum office, including transfers caused by a change of address

Missing an interview is particularly costly. Without a showing of exceptional circumstances, USCIS will stop your EAD clock and may refer the case to an immigration judge, and you become ineligible for asylum-based work authorization unless you can later establish that the absence was justified.3U.S. Citizenship and Immigration Services. How to File the Work Permit Application

The application is Form I-765, Application for Employment Authorization.4U.S. Citizenship and Immigration Services. I-765, Application for Employment Authorization You can file online through a USCIS account or mail a paper form to the USCIS lockbox designated for your state. Enter your A-Number and select eligibility category (c)(8) for a pending asylum application.5U.S. Citizenship and Immigration Services. Supporting Documents

Submit two identical passport-style photos taken within the last 30 days, with your name and A-Number written lightly on the back of each. Include a copy of a government-issued identity document such as a passport, and a copy of your Form I-94 Arrival/Departure Record if you were issued one.

You also need proof that the asylum application is still pending. If you filed with USCIS, include the receipt notice (Form I-797C). If you filed in immigration court, include a copy of the court-stamped application.

Fees

The first (c)(8) EAD application has no filing fee.6U.S. Citizenship and Immigration Services. After You File

USCIS will send you a receipt notice (Form I-797C) with a receipt number for online case tracking. You may be scheduled for a biometrics appointment at a local Application Support Center for fingerprints, a photograph, and a signature.

Once the 180-day mark passes, an officer reviews and decides the application. If approved, the physical EAD card is mailed to the address on file, typically by Priority Mail, and can take up to 30 days to arrive.

Getting a Social Security Number and Starting Work

You need both the EAD and a Social Security number to work. The simplest route is to request an SSN directly on Form I-765. USCIS will share your information with the Social Security Administration, which mails the card after the EAD is approved, usually within about a week.

If you did not request an SSN on the I-765, apply in person at a Social Security office after your EAD arrives. Bring the EAD card along with proof of identity and age, such as a passport and birth certificate, and complete Form SS-5 at the office.9Social Security Administration. When you start a job, your employer will ask you to complete Form I-9.11U.S. Citizenship and Immigration Services. I-9, Employment Eligibility Verification The EAD is a “List A” document, meaning it establishes both identity and work authorization on its own. No additional documents are needed.

Do Not Work Before the EAD Is Approved

Working before your EAD arrives counts as unauthorized employment under immigration law, and the consequences reach beyond the asylum case. If you later seek a green card through adjustment of status, any period of unauthorized employment can permanently bar that path, even if you leave the country and return.12U.S. Citizenship and Immigration Services. How Long the Permit Lasts and How to Renew

Effective December 5, 2025, USCIS reduced the maximum validity of asylum-based EADs from five years to 18 months. The change applies to all initial and renewal (c)(8) applications pending or filed on or after that date.13U.S. Citizenship and Immigration Services. To renew, file a new Form I-765 before your current card expires. Renewals require a filing fee unless you qualify for a fee waiver through Form I-912. Check the current amount on the USCIS fee calculator, since fees are updated periodically.

Automatic Extensions Have Ended

Until recently, a timely renewal filing kept your work authorization alive for up to 540 days past the card’s expiration. That safety net is gone for most new filings. An interim final rule effective October 30, 2025, eliminated automatic EAD extensions for renewals filed on or after that date.14U.S. Citizenship and Immigration Services. The 540-day extension still applies to renewals filed before October 30, 2025. If you filed before that date and your receipt notice shows a receipt date before both the filing deadline and your card’s expiration, the expired card remains valid for up to 540 days from expiration or until USCIS decides the renewal, whichever comes first.15Federal Register. Keep Your Address Current With USCIS

If you move while the application is pending, report the new address to USCIS within 10 days.16U.S. Citizenship and Immigration Services. Have You Moved Recently? A stale address can mean a lost EAD card and weeks of delay while a replacement is sent.

What Happens When the Asylum Case Is Decided

If Asylum Is Granted

Asylees are authorized to work indefinitely as a matter of status, and that authorization does not expire.18U.S. Citizenship and Immigration Services. Many asylees still apply for one under category (a)(5) as a convenient document to show employers, but a Form I-94 showing asylee status combined with a state-issued ID is also acceptable for Form I-9.

If Asylum Is Denied

A final USCIS denial ends eligibility for a (c)(8) EAD immediately.19U.S. Citizenship and Immigration Services. Filing an appeal or motion to reopen does not keep the case “pending” for EAD purposes; the asylum case is only pending again once the Board of Immigration Appeals or a federal court actually grants the motion or petition.

A Proposed 365-Day Waiting Period

In February 2026, DHS published a proposed rule that would extend the waiting period from 180 days to 365 calendar days before an asylum applicant can receive work authorization.20Federal Register. A similar 2020 rule was vacated in federal court in 2022 and the original framework was restored. Anyone with a pending case should watch USCIS announcements for changes.

Taxes Once You Start Working

Earning income creates federal tax obligations regardless of immigration status. Most asylum seekers who have been in the country for a meaningful period qualify as resident aliens for tax purposes under the substantial presence test, which counts days of physical presence in the U.S. over a three-year period.21Internal Revenue Service.
