Yes, someone can assume your mortgage, but only if the loan allows it and the lender signs off. Mortgages insured by the FHA, guaranteed by the VA, or made through the USDA are built to be assumable, while conventional loans backed by Fannie Mae or Freddie Mac almost always contain a due-on-sale clause that blocks a transfer. Which Mortgages Can Actually Be Assumed
The loan type decides the question before anything else does.
FHA Loans
FHA-insured mortgages are assumable, with the rules keyed to when the loan was originated. Anything closed before December 1, 1986, is freely assumable with no creditworthiness review. Loans closed between December 1, 1986, and December 14, 1989, carried assumption restrictions that are no longer enforceable, so those are effectively free to assume as well. VA Loans
VA-guaranteed mortgages are assumable, and the buyer does not have to be a veteran or a service member. USDA Loans
USDA Rural Housing Service loans contain a due-on-sale clause, but the agency will approve an assumption if it decides the transfer serves the government’s interest. Depending on the buyer’s eligibility and the property, the assumed loan can carry program or nonprogram terms. Conventional Loans
Conventional mortgages sold to Fannie Mae or Freddie Mac are almost never assumable. The mortgage instrument contains a due-on-sale clause letting the lender demand full repayment when the property changes hands, so the lender can re-lend at current rates rather than stay stuck with a below-market loan. A handful of very old conventional loans from the 1970s or early 1980s may lack the clause, but those are rare enough that no buyer should count on finding one.
Transfers That Don’t Need Lender Approval
Even where a due-on-sale clause exists, federal law blocks the lender from enforcing it against certain family-related transfers. - Transfers by will, intestacy, or operation of law when a joint tenant or co-owner dies.
- Transfers to a relative on the borrower’s death.
- Transfers to the borrower’s spouse or children during the borrower’s lifetime.
- Transfers to a spouse or ex-spouse under a divorce decree, legal separation, or property settlement.
- Transfers into a revocable living trust where the borrower stays a beneficiary and continues to occupy the home.
- Adding a subordinate lien, such as a second mortgage or HELOC, behind the existing mortgage.
- Granting a lease of three years or less with no purchase option.

These transfers matter because they happen without lender approval or a credit review. A surviving spouse who inherits the home, a child who receives the family house, or an ex-spouse awarded the property in a divorce can simply keep making the payments. The lender cannot call the loan due.
What the Buyer Has to Qualify For
When none of those exceptions apply, the buyer goes through underwriting that looks a lot like applying for a new mortgage. Credit, income, and employment all get reviewed to confirm the new borrower can carry the payments.

Debt-to-income is where most assumption applications get stuck. FHA generally caps the back-end ratio at 43 percent of gross monthly income, with compensating factors like strong reserves pushing the ceiling to 50 percent. The assumed mortgage payment and any secondary financing used to bridge the equity gap both count in that ratio, which is why big equity gaps kill so many deals. Lenders also want to see roughly two years of stable employment in the same field, plus enough cash reserves for closing costs and any upfront equity payment. Government-backed loans generally require the buyer to occupy the home as a primary residence, so investors looking for rentals can rarely use an assumption.
Covering the Seller’s Equity
The assumed loan balance is almost always well below the home’s current value, and the buyer has to make up the difference. On a $400,000 home with a $250,000 remaining balance, the buyer needs $150,000 to make the seller whole. Buyers usually pull that together one of four ways:
- Cash, if they have it sitting available.
- A second mortgage from a bank or credit union that sits behind the assumed first lien. The combined loan-to-value ratio often caps around 85 to 90 percent, and the second lien’s payment counts toward the buyer’s debt-to-income.
- A seller carryback, where the seller finances part of the gap on negotiated terms and takes on the credit risk.
- A personal loan, which is fast but comes with higher rates and short terms that can push the buyer over the DTI limit.
For VA assumptions, any secondary financing has to stay subordinate to the VA first lien, the proceeds can only cover the seller’s equity and allowable closing costs, and the buyer cannot receive cash back. When a seller carryback is used, both sides should sort out upfront whether the second lien will be assumable by a future buyer, because a non-assumable second can complicate a later sale.
Timeline and Fees
Processing speed depends on the servicer and the loan program. The VA holds servicers with automatic processing authority to a 45-day decision window once a complete package is accepted. Budget 45 to 90 days from a complete submission to a decision, and expect delays if the servicer asks for more documentation.
FHA caps the assumption processing fee at $1,800, up from $900 after a 2024 change meant to compensate servicers for the cost of handling these transactions.10Department of Housing and Urban Development. On top of that, expect standard closing costs like title insurance, recording fees, and notary charges that vary by jurisdiction.
Getting the Seller Off the Loan
Closing the assumption is not the same thing as clearing the seller. Without a written release of liability from the lender, the original borrower stays on the promissory note. If the new owner stops paying, that can show up as late payments on the seller’s credit and, in a worst case, the lender can pursue the seller for a deficiency after foreclosure. Sellers should insist on the release as a condition of the sale, not treat it as paperwork to sort out afterward. VA entitlement restoration is a separate matter, and it trips up plenty of sellers. Release of liability does not free the entitlement. If a non-veteran assumes the loan, the seller’s entitlement stays committed to that property until the loan is paid off, which blocks the seller from using it for a new VA home loan.
