You can use your Social Security Number in place of an EIN if you’re a sole proprietor or a single-member LLC treated as a disregarded entity, you have no employees, and you owe no employment or excise taxes. In every other situation the IRS requires you to get an Employer Identification Number. So the short answer to “can I use my SSN as my EIN” is yes, but only inside a narrow lane, and stepping outside it, even briefly, triggers the EIN requirement.

When Your SSN Is Enough

A sole proprietor with no employees reports all business income and expenses on Schedule C of the personal Form 1040. Two conditions have to hold at once: zero employees, and no requirement to file employment or excise tax returns. If either one changes, you need an EIN.

When the IRS Requires an EIN

  • Hiring employees. A single hire, even part-time, means you must get an EIN to withhold and report payroll taxes.
  • Forming a partnership or corporation. These entities are separate taxpayers, so the owners’ SSNs aren’t sufficient.

  • Creating a solo 401(k), SEP-IRA, or other qualified retirement plan.
  • Establishing a tax-exempt organization.

Household Employees Count Too

Hiring a nanny, housekeeper, or other household worker can also cross you into EIN territory. If you pay a household employee $3,000 or more in cash wages during 2026, you owe Social Security and Medicare taxes on those wages and must file employment tax forms that require an EIN.5Internal Revenue Service. What Happens If You Don’t Get One

Why Many Sole Proprietors Get an EIN Anyway

Even when the law lets you use your SSN, the IRS confirms you can request an EIN for banking or state tax purposes without a federal filing obligation.9Internal Revenue Service. Employer Identification Number Two practical reasons drive most voluntary applications.

Keeping Your SSN Off Business Paperwork

Running a business on your SSN means putting that number on vendor forms, state registrations, sales tax applications, and client paperwork. An EIN identifies your business federally, but it doesn’t unlock your personal credit, bank accounts, or government benefits the way your SSN does. Using the EIN on documents that pass through many hands, particularly Form W-9 requests from clients, limits your personal exposure.10Internal Revenue Service. One nuance worth knowing: the IRS W-9 instructions say a sole proprietor “may enter either your SSN or EIN,” and the IRS actually encourages using the SSN on that form. Many sole proprietors still prefer to give clients the EIN to keep their SSN out of circulation.

Business Banking and Credit

Most banks ask for an EIN when you open a business checking account, though sole proprietors can typically substitute an SSN.11U.S. Small Business Administration. How to Get an EIN if You Need or Want One

The online application is the fastest route and issues your number immediately. The tool is available Monday through Friday from 6:00 a.m. to 1:00 a.m. Eastern, Saturday from 6:00 a.m. to 9:00 p.m., and Sunday from 6:00 p.m. to midnight.3Internal Revenue Service. Get an Employer Identification Number You can request only one EIN per responsible party per business day, so if you’re forming multiple entities, spread the applications out. When approval comes through, download and save the CP 575 confirmation notice right away; it’s your formal proof of the number.

If you’re forming an LLC, partnership, corporation, or nonprofit, finish your state entity registration before you apply. The IRS warns that applying before the state has recognized the entity can delay processing.

Fax and Mail

One boundary to keep in mind: an EIN doesn’t replace your SSN on your personal Form 1040. Even after you get one, a sole proprietor still files Schedule C under a personal return tied to the SSN. The EIN sits alongside the SSN for payroll, excise, and business-account purposes rather than replacing it on your individual tax filings.
