Can I Use My Passport If My Name Changed? Rules and Renewal

Yes, you can use your passport if your name has changed. U.S. Customs and Border Protection lets citizens re-enter the country on a passport in a former name as long as they carry proof of the change, such as a marriage certificate, divorce decree, or court order.¹ The catch is that CBP is only one of several gatekeepers between you and your destination, and the others are less flexible. If your passport was issued in the last year, the State Department will update it for free.²

What Actually Happens When You Travel on the Old Name

CBP’s rule covers your return to the U.S. It does not cover the airline counter, the TSA checkpoint, or the immigration desk in another country. Those are the places where a mismatch tends to cause trouble.

CBP itself tells travelers to buy tickets in the exact name that appears on their passport or official ID, and warns that a mismatch could lead an airline or TSA to demand additional identity documents before allowing boarding.³ So if you fly on the old passport, book the ticket in the old name. If you’ve already updated your driver’s license to the new name but not your passport, those two IDs now disagree with each other, and that disagreement is exactly what stops the line at security.

Foreign countries add their own risk. CBP specifically advises checking entry requirements at your destination, because some countries won’t accept a passport whose name doesn’t match your visa or other travel documents.¹ A certified marriage certificate or court order helps, but no rule requires a foreign border officer to accept it.

Short version: legally allowed, practically fragile. If you have time before your trip, update it.

Update It Free Within One Year

The single most important date for anyone in this situation is the issue date on the passport. If your passport was issued less than a year ago and your name change is also less than a year old, you can update it using Form DS-5504 with no application fee.² You mail in the form with your current passport, the name-change document, and one passport photo.⁴ If you need it faster, expedited processing is $60.⁵

Miss either condition and DS-5504 is off the table. You’ll pay the standard fee through one of the two routes below.

Which Form You File

DS-82: Renewal by Mail

Most people whose passport is older than a year use Form DS-82. You qualify if your most recent passport was issued within the last 15 years, was issued when you were 16 or older, is undamaged, and has never been reported lost or stolen.⁶ Send in the form, your current passport, and a certified copy of your name-change document.

The State Department also runs an online renewal option for routine service.⁶ Whether it accepts name changes isn’t spelled out, so the mail-in route is the safe default if you have any doubt.

DS-11: In Person

You’ll apply in person on Form DS-11 if your passport was issued more than 15 years ago, was issued before you turned 16, has been lost or stolen, or is significantly damaged.² Acceptance facilities include many post offices, county clerk offices, and some libraries. DS-11 costs an extra $35 facility acceptance fee on top of the application fee.⁵

What to Send With Your Application

Regardless of form, the core paperwork is the same:

Your most recent U.S. passport. On a DS-11 where you can’t turn it in, you’ll need alternate citizenship evidence such as a birth certificate.
Legal proof of the name change: marriage certificate, divorce decree, or court-ordered name change. Originals, certified copies, and in many cases clear photocopies are accepted.⁷
One color passport photo, plain white or off-white background, taken within the last six months, no glasses.⁸
For DS-11 only: a valid photo ID such as a driver’s license, plus a photocopy of it.²

The name-change document has to clearly link the old name to the new one. If it doesn’t provide enough identifying information, the State Department can ask for more.⁷

If You Don’t Have a Court Order or Marriage Certificate

Some name changes happen without a clean paper trail. If you’ve been using a different name for years but can’t produce a court order, marriage certificate, or divorce decree, you apply in person on Form DS-11 and may also need Form DS-60, an affidavit regarding a change of name. Two people who have known you by both names must complete the affidavit, and you’ll need at least three certified or original public records showing you’ve used the new name for five or more years.² Driver’s licenses, tax documents, school records, and employment records all qualify.⁷

What It Costs and How Long It Takes

Adult passport book fees as of February 2026:

DS-5504 within the one-year window: no fee.²
DS-82 renewal by mail: $130.⁵
DS-11 in person: $130 plus a $35 facility fee, for $165 total.⁵
Expedited processing: add $60. That takes routine 4–6 week processing down to 2–3 weeks.⁹
1–3 day return shipping: $22.05.⁵

Passport fees are nonrefundable even if the passport isn’t issued.⁵

One Note on Domestic Flights

REAL ID enforcement started May 7, 2025, and a valid U.S. passport is accepted as an alternative to a REAL ID–compliant driver’s license for boarding domestic flights and entering federal facilities.¹⁰ If you’re mid-name-change and your license and passport don’t yet match, the passport, in either name, will still get you through TSA domestically. That buys you time on paperwork; it does not fix the international problem.

After the New Passport Arrives

Once the State Department issues the new passport, the name change carries forward to any future passport or passport card you apply for.⁷ Line up the rest before your next trip: driver’s license, Social Security card, and any trusted traveler memberships such as Global Entry. The mismatches that cause airport problems are between documents, not on any one of them, so the fix is getting them all to agree.
