Yes, you can sue Cash App, but the Terms of Service you accepted when you opened your account push almost every dispute into private arbitration instead of a courtroom. The realistic paths are arbitration through National Arbitration and Mediation, small claims court if your claim fits under your state’s dollar limit, a free complaint to the Consumer Financial Protection Bureau, or, if you’re still within 30 days of opening your account, opting out of the arbitration clause entirely to preserve your right to a regular lawsuit.
Why You Probably Can’t File a Regular Lawsuit
Cash App’s Terms of Service contain a binding arbitration clause. By agreeing to them, you gave up the right to a jury trial and the right to join a class action. Disputes go to a private arbitrator whose decision carries the same legal weight as a court judgment and is almost impossible to appeal. All claims must be brought individually.
The current terms name National Arbitration and Mediation (NAM) as the arbitration provider.1Cash App. US Terms of Service If NAM is unavailable, either side can ask a court to appoint an arbitrator under the Federal Arbitration Act.
The 30-Day Opt-Out That Preserves Your Right to Sue
Most users never notice this window. Within 30 days of creating your Cash App account, you can reject the arbitration clause in writing and keep your right to sue in regular court. Mail the opt-out to Block, Inc., Attn: Arbitration Agreement, 1955 Broadway, Suite 600, Oakland, CA 94612. Cash App provides a downloadable form asking for your name, address, $Cashtag, phone number, and the email address linked to the account.1Cash App. US Terms of Service
Opting out doesn’t restrict your account. It only removes the arbitration requirement. If you’re past the 30-day window, arbitration and small claims court are the paths available to you.
Steps You Have to Take Before Filing Anything Formal
The Terms of Service require specific pre-filing steps. Skipping them gives Cash App grounds to dismiss or delay your claim.
Contact Support and Document Everything
Start with in-app support or call 1-800-969-1940.2Cash App. Cash App Terms Save chat screenshots, log the dates and times of calls, note the representative’s name or ID, and write down what you were told. If support resolves the issue, you’re done. If not, that record shows you tried in good faith.
Send a Written Notice of Dispute
If support doesn’t fix the problem, you must send a formal Notice of Dispute by certified mail to Block, Inc., 1955 Broadway, Suite 600, Oakland, CA 94612. The notice needs to include your name and mailing address, the phone number and email on your account, a clear description of the dispute, and the specific outcome you want, such as a refund or account reinstatement.1Cash App. US Terms of Service
Use certified mail with a return receipt for proof of delivery. Block then has 60 days to try to resolve the dispute informally. Only after those 60 days pass without a resolution can you move to arbitration or small claims court.
Build Your Evidence File
Use the 60-day waiting period to gather transaction IDs, dates and amounts of every disputed transfer, screenshots of errors or unauthorized charges, all correspondence with support, and your certified mail receipt. If the dispute involves an unauthorized transfer, note the date you first discovered it and the date you reported it. Federal law protects you against unauthorized transfers, but the definition matters: if a scammer accessed your account without your permission and moved money, that’s unauthorized; if you tapped “send” yourself, Cash App will almost certainly treat the payment as final.3Consumer Financial Protection Bureau. File a CFPB Complaint While You Wait
Filing a complaint with the Consumer Financial Protection Bureau is free, takes about 15 minutes, and creates a formal record the company has to respond to. You can file at consumerfinance.gov/complaint.4Consumer Financial Protection Bureau. Submit a Complaint
Once filed, the CFPB forwards your complaint to Cash App, which generally must respond within 15 days. Complex cases can take up to 60 days, but the company must tell you it’s still working. Complaints are added to a public database that regulators use in enforcement decisions. The CFPB’s 2025 action against Block was built in part on the pattern of consumer complaints.5Consumer Financial Protection Bureau. A CFPB complaint doesn’t replace arbitration or small claims court for binding legal relief, but it often produces faster results than support alone. You can file with the CFPB while you’re running out the 60-day Notice of Dispute period.
Filing Arbitration With NAM
Once the 60-day informal resolution period passes without a satisfactory outcome, you can file a written demand for arbitration with National Arbitration and Mediation. The demand describes your claim, the relief you want, and the relevant facts. The initiating party pays the filing fee, though NAM’s consumer rules keep that fee lower than what a business would pay.1Cash App. US Terms of Service
NAM assigns an arbitrator with authority to award the same damages a court could, including actual monetary losses, statutory damages, and injunctive relief limited to your individual situation. The decision is final and legally binding. You can only challenge it in court under narrow circumstances like fraud or arbitrator misconduct.
Consumer arbitration can often be handled through written submissions alone, without a live hearing, which makes it more approachable than it may sound. You’re still building a legal case, though. For claims involving significant money, talking to a consumer protection attorney before filing is worth considering, especially because the Electronic Fund Transfer Act allows recovery of attorney fees if you win.
Small Claims Court as an Alternative
The Terms of Service include an exception that lets either side take a dispute to small claims court instead of arbitration, as long as the claim fits within that court’s dollar limit.1Cash App. US Terms of Service Limits vary widely, running from $2,500 in some states to $25,000 in others. Most states set the cap between $5,000 and $10,000.
Small claims court is less formal than traditional litigation. You usually don’t need a lawyer, filing fees are modest, and cases often move faster than arbitration. You present evidence to a judge, and the proceedings are public.

Legal – Government Service of process rules vary by court. Most small claims courts allow service by certified mail through the clerk, by sheriff, or by a professional process server. Block does not accept service by email or in person at its offices.
If you’ve already filed for arbitration, Cash App can ask that the case be moved to small claims court if it qualifies. Conversely, if your claim exceeds your local small claims limit, arbitration is the default.
What You Can Recover if You Win
If Cash App violated the Electronic Fund Transfer Act, federal law gives you three categories of damages. You can recover your actual losses, meaning the money taken from your account or the costs you incurred because of the violation. You can also recover statutory damages between $100 and $1,000 per violation, even if your actual losses were smaller. And if you win, Cash App must pay your reasonable attorney fees and court or arbitration costs.7Office of the Law Revision Counsel. 15 USC 1693m – Civil Liability
The fee-shifting provision matters more than it looks. A consumer rights lawyer may take your case knowing Cash App pays the legal bill if you prevail. For claims where the unauthorized transfer itself was only a few hundred dollars, statutory damages plus fee recovery can make the case economically viable when it otherwise wouldn’t be.
EFTA claims must generally be filed within one year of the violation. Missing that deadline can forfeit your right to statutory damages and fee recovery even when the violation is clear.
If Your Dispute Involves Stocks or Bitcoin
Investment disputes follow different rules. Cash App Investing LLC is a separate entity registered as a broker-dealer with the SEC and a member of FINRA.8Cash App. Cash App Investing Customer Account Agreement Claims involving your investing account go to FINRA Dispute Resolution in California, not NAM. FINRA arbitration has its own procedures, fees, and timelines. If your problem hit both your payment balance and your investment account, you may have to file separate claims through separate channels.
The 2025 CFPB Settlement May Already Cover You
