You can roll a 401(k) into gold without a penalty, but the gold cannot sit inside the 401(k) itself. The penalty-free path is a direct trustee-to-trustee transfer from your 401(k) into a self-directed IRA, which then purchases IRS-qualifying bullion or coins that are held at an approved depository. Done that way, rolling a 401(k) into gold triggers no income tax and no 10% early withdrawal penalty. Done any other way, the risks stack up quickly.
Is Your 401(k) Even Eligible to Move
A 401(k) from a former employer is fully portable. You can move some or all of the balance into a self-directed IRA once you’ve left the job, with no age requirement and no waiting period beyond completing the plan’s transfer paperwork.
A 401(k) with your current employer is harder. Most plans restrict distributions while you’re still on the payroll. The main exception is an in-service distribution, which most plans only allow once you turn 59½, and some plans don’t offer them at all. Check your plan documents or call the administrator. Hardship withdrawals are not eligible for rollover into another retirement account, so that route doesn’t work for a gold IRA.1Internal Revenue Service. 401k Resource Guide – Plan Participants – General Distribution Rules
The same approach works for a 403(b), a 457(b), or the federal Thrift Savings Plan, each with its own transfer procedures. A Roth 401(k) balance rolls into a Roth self-directed IRA and keeps its tax-free withdrawal treatment.
Use a Direct Rollover, Not an Indirect One
There are two mechanical ways to move the money, and only one of them reliably avoids a penalty.
Direct Rollover (Trustee-to-Trustee)
In a direct rollover, your 401(k) administrator sends the funds straight to the self-directed IRA custodian. The money never passes through your hands. There is no tax withholding, no 60-day clock, and no risk of accidentally converting your retirement savings into a taxable event. The administrator either wires the funds or mails a check made payable to the new custodian “for the benefit of” you. This is the method to use.
Indirect Rollover (60-Day Rollover)
In an indirect rollover, the plan sends the money to you personally, and you have 60 calendar days to deposit it into the self-directed IRA. Miss that deadline by one day and the IRS treats the entire amount as a taxable distribution, with income tax owed plus the 10% early withdrawal penalty if you’re under 59½.2Office of the Law Revision Counsel. 26 USC 402 – Taxability of Beneficiary of Employees Trust
There is also mandatory withholding. Federal regulations require your 401(k) plan to withhold 20% of the distribution for income taxes before sending you the check.3eCFR. 26 CFR 31.3405(c)-1 – Withholding on Eligible Rollover Distributions On a $100,000 balance, you receive $80,000. To complete the rollover without owing taxes, you have to deposit the full $100,000 within 60 days, which means covering the missing $20,000 out of pocket. You get the withheld amount back when you file your tax return, but the cash flow gap is yours in the meantime. Any shortfall is treated as a taxable distribution.
The IRS also allows only one indirect rollover between IRAs in any 12-month period. That limit doesn’t apply to 401(k)-to-IRA rollovers, and it doesn’t apply to direct trustee-to-trustee transfers at all.4Internal Revenue Service. Rollovers of Retirement Plan and IRA Distributions Another reason to go direct.
Why You Need a Self-Directed IRA
Standard 401(k) plans hold mutual funds, stocks, and bonds. Physical gold requires a self-directed IRA, a type of IRA that permits alternative investments including precious metals. Regular brokerages and banks generally don’t administer these accounts, so you’ll work with a specialty custodian.
The custodian holds the account on your behalf, handles paperwork, reports to the IRS, and executes buy and sell orders at your direction. They don’t give investment advice and don’t pick your metals. Their fee schedule, responsiveness, and depository relationships will shape your experience for as long as you hold the account.
The Gold Must Live at an Approved Depository
Your gold cannot come home with you. The statute requires IRA bullion to remain “in the physical possession of a trustee” at all times.5Office of the Law Revision Counsel. 26 USC 408 – Individual Retirement Accounts That means an IRS-approved depository. Not your house, not a personal safe, not a bank safe deposit box you control. In McNulty v. Commissioner, the tax court confirmed that storing IRA metals at home constitutes “unfettered control,” and the IRS treats the entire account value as a taxable distribution when that happens.
Depositories typically offer two arrangements. Segregated storage keeps your metals physically separated and individually labeled, generally with stronger insurance coverage. Commingled storage pools your metals with others’ and costs less, but you receive equivalent metals on withdrawal rather than the exact bars or coins you bought.
Which Gold Actually Qualifies
The IRS treats most physical collectibles held in a retirement account as an immediate taxable distribution equal to the purchase price. Artwork, antiques, gems, stamps, and most coins all fall under that rule. The tax code carves out narrow exceptions for bullion and coins that meet strict purity thresholds.5Office of the Law Revision Counsel. 26 USC 408 – Individual Retirement Accounts
Gold bullion must have a fineness of at least 0.995 (99.5% pure), the delivery standard set by the COMEX futures exchange.6CME Group. Chapter 126 Gold (Enhanced Delivery) Futures Gold bars and rounds meeting that standard must also come from a manufacturer or refiner accredited by an organization such as the London Bullion Market Association.
American Gold Eagle coins qualify despite being only 91.67% gold (22 karat). The statute specifically exempts coins described in 31 U.S.C. § 5112(a), which includes all four denominations of the Gold Eagle.7Office of the Law Revision Counsel. 31 USC 5112 – Denominations, Specifications, and Design of Coins The Canadian Gold Maple Leaf and Australian Gold Kangaroo qualify because they clear the 0.995 fineness bar on their own.
Silver must reach 0.999 fineness.8CME Group. Silver Futures Contract Specs Platinum and palladium each require 0.9995. The American Silver Eagle is exempted by statute regardless of alloy composition.
Buying metal that fails these standards is where people get hurt. The IRS treats a non-qualifying purchase as a distribution from your account equal to what you paid, meaning income tax on the full amount plus the 10% early withdrawal penalty if you’re under 59½.9Internal Revenue Service. Retirement Topics – Exceptions to Tax on Early Distributions Once funds arrive at the custodian, you direct the purchase, the custodian pays an approved dealer, and the dealer ships the metal straight to the depository. You never handle the gold yourself.
Prohibited Transactions That Detonate the Whole Account
The IRS is aggressive about prohibited transactions in self-directed IRAs, and the consequence is severe. If you or a “disqualified person” engages in a prohibited transaction at any point during the year, the IRS treats your entire IRA as having distributed all its assets on January 1 of that year. The full fair market value becomes taxable income, and the early withdrawal penalty applies if you’re under 59½.10Internal Revenue Service. Retirement Topics – Prohibited Transactions
Disqualified persons include you, your spouse, your parents, your children and their spouses, any fiduciary of the account, and anyone providing services to it.11Office of the Law Revision Counsel. 26 USC 4975 – Tax on Prohibited Transactions The most common violations with gold IRAs:
- Selling personal gold to your own IRA. You cannot transfer bullion you already own into the account. Every purchase must be made by the custodian from a third-party dealer using IRA funds.
- Storing metals at home. Taking physical possession, even temporarily, is treated as a distribution. The “home storage IRA” schemes promoted by some dealers have been rejected by the tax court and by the IRS.
- Personal use of the metals. You cannot borrow against the gold, display it, or pledge it as collateral for anything.
Custodians don’t police your investment decisions the way a traditional brokerage would. They process what you direct. If you direct a prohibited transaction, the custodian may execute it, and you carry the full tax consequences when the IRS finds out.
The Costs Are Real
Gold IRAs are significantly more expensive than standard IRAs or 401(k) plans, and the fee stack catches many investors off guard. A one-time account setup fee typically runs $50 to $250. Annual custodian administration runs $75 to $300. Depository storage and insurance runs $100 to $300, with segregated storage on the higher end. Wire fees for purchases or sales usually run $30 to $50 each.
The cost most people underestimate is dealer markup. Bullion dealers charge a premium over spot, typically 3% to 8% per transaction. On a $50,000 purchase, that’s $1,500 to $4,000 before any custodian or storage fee. First-year costs often run 5% to 7% of the amount invested. Recurring costs in later years usually settle into the $200 to $400 range. Compare that against a low-cost index fund IRA at $0 to $20 per year, and the drag on returns is meaningful.
Distributions, RMDs, and Reporting
Withdrawals from a traditional gold IRA follow the same rules as any traditional IRA. Distributions before age 59½ face income tax plus the 10% penalty unless an exception applies.12Internal Revenue Service. Retirement Plans FAQs Regarding IRAs Distributions (Withdrawals) After 59½, withdrawals are taxed as ordinary income with no penalty.
Required minimum distributions begin at age 73.13Internal Revenue Service. Retirement Plan and IRA Required Minimum Distributions FAQs Meeting an RMD from a gold IRA means either selling enough metal for cash or taking an in-kind distribution of the metal itself, with the fair market value taxed as income in the year received. Liquidation runs through the dealer and custodian and takes several business days, so don’t wait until late December to start.
Your custodian reports the account’s fair market value annually on Form 5498, and any distributions on Form 1099-R.14Internal Revenue Service. Form 5498 – Asset Information Reporting Codes and Common Errors A properly executed direct rollover shows up on a 1099-R with a code indicating a non-taxable transfer. Keep the transfer paperwork, custodian statements, and purchase invoices. If the IRS ever questions the rollover, those records are your proof.
