Can I Renew My Green Card Before 6 Months? Exceptions and Rules

You can renew a Green Card before the six-month mark only if you qualify under a specific exception. For a standard 10-year card that is simply approaching expiration, USCIS lets you file Form I-90 no earlier than six months before the expiration date, and applications filed too early for a routine renewal can be rejected with the fee kept.1United States Citizenship and Immigration Services (USCIS). Replace Your Green Card If your reason for filing is something other than routine renewal, the six-month window does not apply and you can file right away.

The Six-Month Rule for Routine Renewals

If you hold a standard 10-year Green Card and want to renew it because it is expiring, USCIS accepts Form I-90 once the card has expired or will expire within the next six months.1United States Citizenship and Immigration Services (USCIS). Replace Your Green Card Filing earlier than that for a routine renewal is not permitted. There is no strategic benefit to trying, and a rejected filing costs you the fee.

When You Can File Before the Six-Month Window

The six-month limit governs routine renewals only. Several situations let you file Form I-90 at any time, no matter how far off the expiration date is.1United States Citizenship and Immigration Services (USCIS). Replace Your Green Card

  • Your card was lost, stolen, or destroyed. You can file immediately.
  • Your card is mutilated or so worn that the information on it cannot be read.
  • USCIS printed incorrect information on your card. You can file right away, and there is no fee for this correction.2USCIS. G-1055 Fee Schedule
  • Your legal name has changed through marriage, divorce, or a court order. File I-90 with a copy of the legal document showing the change.3USCIS. Form I-90, Instructions for Application to Replace Permanent Resident Card
  • You received your card before your 14th birthday and it expires after your 16th birthday. You can apply for a new card once you turn 14, and the replacement is free.2USCIS. G-1055 Fee Schedule
  • You are still carrying one of the older card formats issued between January 1977 and August 1989 (such as Form AR-3, AR-103, or I-151). USCIS no longer accepts these as proof of status and you must replace them.1United States Citizenship and Immigration Services (USCIS). Replace Your Green Card

In each of these cases you are technically filing a replacement rather than a renewal, which is why the timing rule for routine renewals falls away.

Conditional Residents Follow Different Rules

If your Green Card is valid for only two years because you gained status through marriage or an investment-based petition, none of the above applies to you. You cannot use Form I-90 to renew a conditional card.3USCIS. Form I-90, Instructions for Application to Replace Permanent Resident Card

Instead, you file a petition to remove the conditions during the 90-day window before the card expires. Marriage-based conditional residents file Form I-751, and investor-based conditional residents file Form I-829.3USCIS. Form I-90, Instructions for Application to Replace Permanent Resident Card File earlier than 90 days out and USCIS will reject the petition. Once USCIS accepts a timely I-751 or I-829, the receipt notice extends your card’s validity for 48 months past its expiration date.4USCIS. If Your Card Has Already Expired or Is About to

Permanent resident status does not end when the card expires. The card proves the status; it is not the status itself. The Social Security Administration has confirmed that permanent residents with expiring or expired 10-year cards do not lose their permanent resident status.5Social Security Administration (SSA). Evidence of Lawful Permanent Resident (LPR) Status for an SSN Card

Still, an expired card creates real problems. On a Form I-9, an expired Green Card by itself is not acceptable as a List A document. You need to pair it with a Form I-797C receipt notice showing a pending I-90 renewal or a pending N-400 naturalization application for the two together to satisfy the requirement.6USCIS. Lawful Permanent Residents (LPR) For international travel, USCIS requires a valid, unexpired Green Card at a U.S. port of entry.7USCIS. International Travel as a Permanent Resident Arriving with only an expired card and no receipt notice or temporary stamp risks delays, secondary inspection, or trouble boarding your return flight.

The 36-Month Automatic Extension

Once you file, USCIS sends a Form I-797C receipt notice confirming acceptance. As of September 10, 2024, that notice extends your Green Card’s validity for 36 months beyond the expiration date printed on the card, up from the previous 24 months.8USCIS. USCIS Extends Green Card Validity Extension to 36 Months for Green Card Renewals During those 36 months, carry the receipt notice together with your expired Green Card as proof of status for employment, travel, and benefits.

Filing Fees and Fee Waivers

The Form I-90 fee is $415 online and $465 by paper, and both amounts now include the biometrics fee.9Federal Register. U.S. Citizenship and Immigration Services Fee Schedule and Changes to Certain Other Immigration Benefit Request Requirements Three situations carry no fee: replacing a card USCIS printed with incorrect information, replacing a card that was mailed but returned to USCIS as undeliverable, and the age-14 replacement when the card expires after the applicant’s 16th birthday.2USCIS. G-1055 Fee Schedule

If you cannot afford the fee, file Form I-912 alongside your I-90 to request a waiver.10USCIS. Form I-912, Instructions for Request for Fee Waiver USCIS approves waivers on three grounds: you receive a means-tested benefit such as Medicaid, SNAP, or SSI; your household income is at or below 150 percent of the federal poverty guidelines; or you can document a financial hardship such as a medical emergency, job loss, or eviction.

Should You Apply for Citizenship Instead?

If your card is near expiration and you have held permanent resident status for five years (or three years if you gained status through marriage to a U.S. citizen), applying for naturalization may make more sense than renewing. Form N-400 costs $710 online or $760 by paper.11USCIS. N-400, Application for Naturalization That is more than the I-90 fee, but you would never need to renew a Green Card again.

You can file Form N-400 while an I-90 renewal is pending. The N-400 receipt notice also extends your Green Card’s validity, so you keep proof of status either way.6USCIS. Lawful Permanent Residents (LPR) If USCIS approves your naturalization before the I-90 is processed, the renewal becomes moot.
