Can I Legally Ship Alcohol to a Friend? State Laws and Penalties

Shipping alcohol to a friend is legal in most cases, but only if a licensed business does the actual shipping. You cannot personally take a bottle to a shipping counter and send it: federal law bans alcohol from the U.S. mail, and FedEx and UPS accept alcohol only from licensed shippers who have signed dedicated alcohol agreements. The workable path is to buy from a winery, distillery, or online retailer that holds a permit to ship into your friend’s state, then have them send it as a gift. Whether that works depends on what you want to send and where your friend lives.

Why You Can’t Just Mail It Yourself

Under 18 U.S.C. ยง 1716, all intoxicating liquors are nonmailable. The U.S. Postal Service defines that as any beverage of 0.5 percent alcohol by volume or higher, which covers essentially every beer, wine, and spirit sold.1Office of the Law Revision Counsel. 18 USC 1716 – Injurious Articles as Nonmailable2Postal Explorer. 422 Mailability The only carve-out is for federal and state agency employees mailing samples for official testing.

FedEx and UPS are not a workaround. FedEx accepts alcohol only from licensed shippers, and states plainly that individuals cannot ship alcohol under any circumstances, even as a personal gift.3FedEx. How to Send It the Legal Way

Every legal method involves a licensed third party doing the shipping. You are the buyer; they are the shipper.

Order From a Licensed Winery, Distillery, or Online Retailer

The most direct route is ordering from a winery, brewery, distillery, or online liquor retailer that holds a shipping permit for your friend’s state. Most offer gift shipping at checkout: you enter the recipient’s address, and the business handles packaging, labels, tax collection, and age verification at delivery. Before you order, confirm the seller ships to your friend’s specific state. Most retailers list eligible states on their site.

Use a Gift-Focused Alcohol Service

Several online platforms curate alcohol gifts and operate as licensed retailers or partner with licensed fulfillment centers. They have already worked out which products can ship where, which saves you the compliance homework. Selection tends to be narrower and prices higher than buying directly from a producer.

Same-Day Delivery Apps

When your friend lives in a city where an alcohol delivery app operates, that can be the fastest option. These platforms tap into local licensed retailers and drop the order at the recipient’s address the same day. The delivery rules still apply: your friend has to be home, present ID, and sign.

Whether the Shipment Is Legal Depends on Your Friend’s State

The 21st Amendment gave each state broad authority to control alcohol coming across its borders, so the rules that matter are set state by state. A shipper licensed in one state still cannot deliver into a state that prohibits inbound direct shipments, and a state that allows wine may prohibit spirits.5Cornell University Legal Information Institute (LII). Wine Is Widely Allowed

Nearly all states and Washington, D.C. permit licensed wineries to ship wine directly to consumers, though the paperwork and volume rules vary. A handful of states still prohibit inbound direct wine shipments entirely. In states that allow it, the winery generally needs a destination-state shipping permit, which involves an application, a fee, and a commitment to collect the applicable taxes.6National Conference of State Legislatures. Spirits Are Much More Restricted

If your friend prefers bourbon or tequila, the map shrinks. As of 2025, only about nine states and Washington, D.C. permit interstate direct-to-consumer spirits shipping. The rest either ban it or have no legal framework for it, which amounts to the same thing. Even in states that do allow spirits, volume caps and licensing rules are often tighter than for wine.

How Much You Can Send

Most states cap what one person can receive by direct shipment. The specifics differ:

  • Twelve cases per person per year is the most common annual cap, used by roughly 20 states.
  • Some states allow 24 or even 36 cases per person per year.
  • About a dozen states use monthly caps, ranging from one case to ten cases per month.
  • A few states, including California and Colorado, impose no volume limits on wine shipments.

These caps apply per recipient, though some states track by household address. Going over the limit is a violation even if the shipment complies with every other rule.

Dry Counties Can Block Delivery Even in “Wet” States

Local option matters. Several states specifically prohibit licensed shippers from delivering into jurisdictions that have voted their areas dry. If your friend lives in a dry county or municipality, the shipment can be illegal regardless of state-level permission. Some states build the check into their licensing systems and require shippers to screen the recipient’s address before processing an order.6National Conference of State Legislatures. What Happens When the Package Arrives

Whichever licensed shipper sends it, the delivery has strict rules. The recipient must be at least 21. The carrier is required to obtain an adult signature and verify age with a government-issued photo ID. FedEx requires its Adult Signature Required service on every domestic alcohol shipment, and UPS follows the same protocol.3FedEx. How to Ship Alcohol – Regulations, Licenses and Services4UPS. The driver will not leave the package on a porch or hand it off to a minor. If nobody eligible is home, carriers typically try up to three times before returning the shipment to the sender. The adult signature service also adds a surcharge, generally around $6 to $8 per package. Tell your friend the delivery is coming so the package doesn’t bounce back.

Taxes on a Shipped Gift

You don’t handle taxes as the buyer, but you’ll see them. A licensed shipper crossing state lines collects and remits state excise tax and applicable sales or use tax to the destination state, treating the sale as if it happened there.6National Conference of State Legislatures. Direct Shipment of Alcohol State Statutes Those charges typically fold into the purchase price or appear as line items at checkout.

Penalties If You Ship It Yourself Anyway

Putting alcohol in the U.S. mail is a federal offense. Knowingly depositing nonmailable liquor in the mail carries a fine of up to $100,000 and up to one year in federal prison.1Office of the Law Revision Counsel. 18 USC 1716 – Injurious Articles as Nonmailable7Office of the Law Revision Counsel. 18 USC 3571 – Sentence of Fine The maximum is unlikely to hit a one-time personal shipment, but the statute makes no exception for gifts.

State penalties for unlicensed shipping range widely. On the lighter end, some states treat a first offense as a civil infraction with fines of $100 to $500 per shipment. On the heavier end, unlicensed shipping is a felony in several states, carrying potential prison time up to two years or fines as high as $25,000 per violation. A few states escalate with each repeat offense, and some also authorize seizure of the alcohol and, in extreme cases, the vehicle used to transport it.6National Conference of State Legislatures. The risk sits mostly with whoever ships. But if you get an unlicensed friend to drop a bottle in a FedEx box and lie about what’s inside, both of you have potentially committed an offense. Carriers that discover undeclared alcohol will confiscate the package, and repeat attempts can get you permanently banned from their services.
