Can I Get a Job With an Expired ID? I-9 Docs and Receipts

Yes, you can get a job with an expired ID. Federal law requires the documents you show for Form I-9 to be unexpired, but it lets you choose from a long list of acceptable documents, and it builds in receipts and automatic extensions for the situations where your main ID has lapsed. In most cases the answer is already in your filing cabinet.

What the I-9 Actually Requires, and When

Every U.S. employer has to verify the identity and work eligibility of anyone hired after November 6, 1986, using Form I-9.1U.S. Citizenship and Immigration Services. Form I-9 Statutes and Regulations You fill out Section 1 no later than your first day of work for pay. Your employer examines your original documents and completes Section 2 within three business days after that first day. If the job will last fewer than three days, Section 2 must be done on day one.2U.S. Citizenship and Immigration Services. Completing Section 2, Employer Review and Attestation

That three-business-day window is the deadline that matters when an ID has expired. You don’t need documents in hand when you accept the offer. You need them by the end of your third business day on the job. Start Monday, deadline Thursday.

The Documents You Can Actually Present

USCIS sorts acceptable documents into three lists. List A proves both identity and work authorization. List B proves identity only. List C proves work authorization only. You present one document from List A, or one from List B paired with one from List C.3U.S. Citizenship and Immigration Services. Form I-9 Acceptable Documents This is where an expired-ID problem often solves itself.

Common List A documents (identity and work authorization):

  • U.S. passport or passport card
  • Permanent Resident Card (Form I-551)
  • Employment Authorization Document (Form I-766)

Common List B documents (identity only):

  • State driver’s license or ID card with a photo
  • Federal, state, or local government ID with a photo
  • School ID card with a photo
  • U.S. military card
  • Voter registration card

Common List C documents (work authorization only):

  • Unrestricted Social Security card (cards marked “NOT VALID FOR EMPLOYMENT” do not count)
  • U.S. birth certificate with an official seal
  • U.S. Citizen ID Card (Form I-197)

Every document you present must be unexpired.4E-Verify. 2.1.3 Unexpired Document Required But look at the range. If your driver’s license expired, you can skip List B entirely with an unexpired U.S. passport from List A. Or you can pair a voter registration card from List B with your Social Security card from List C. Neither of those has an expiration date. Before you assume the expired license is a problem, inventory what you already have.

One rule that works in your favor: your employer cannot tell you which documents to present.5U.S. Citizenship and Immigration Services. Instructions for Form I-9, Employment Eligibility Verification You pick from the acceptable lists.

If Your Document Was Lost, Stolen, or Damaged: The 90-Day Receipt

If your document was lost, stolen, or damaged, and you’ve applied for a replacement, you can present the receipt showing you filed for that replacement. The receipt is valid for 90 days from your hire date, giving you time to get the actual document.6U.S. Citizenship and Immigration Services. Form I-9 Acceptable Documents – Receipts The receipt stands in for whatever list the original belonged to. If you lost a passport (List A), the receipt counts as a List A document during that 90-day window.

A few catches. Employers cannot accept receipts for jobs lasting fewer than three business days. When the 90 days are up, you must present the actual replacement or a different acceptable document from the same list.7U.S. Citizenship and Immigration Services. Handbook for Employers M-274 – 4.4 Acceptable Receipts If the replacement isn’t back in time, you still have flexibility: a receipt for a lost List A document can be satisfied at the 90-day mark by presenting any other List A document, or one document each from List B and List C instead.

Note the limit. The receipt rule covers lost, stolen, or damaged documents. It does not cover a document that simply expired on its own timeline. For that, look to the automatic extensions below or to a different document entirely.

Expired Green Card or Work Permit With a Pending Renewal

Some expired documents aren’t really expired for I-9 purposes.

Expired Green Card

If you filed Form I-90 to renew your Permanent Resident Card, USCIS automatically extends the card’s validity for 36 months beyond the printed expiration date.8U.S. Citizenship and Immigration Services. USCIS Extends Green Card Validity Extension to 36 Months for Green Card Renewals Present the expired green card together with the Form I-797 receipt notice showing USCIS accepted your renewal. The combination counts as an unexpired List A document.4E-Verify. 2.1.3 Unexpired Document Required

Expired Employment Authorization Document

Certain EAD holders who filed a timely renewal receive an automatic extension of their work authorization. The expired EAD paired with the Form I-797C receipt notice showing the timely filing counts as a List A document during the extension period.4E-Verify. 2.1.3 Unexpired Document Required The length of the extension and the categories that qualify have shifted with recent regulatory changes, so confirm the current guidance for your EAD category before relying on it.

What Your Employer Cannot Do

The Immigration and Nationality Act, enforced by the Department of Justice’s Immigrant and Employee Rights Section, prohibits three categories of document-related misconduct in hiring:9U.S. Citizenship and Immigration Services. Handbook for Employers M-274 – 11.2 Types of Employment Discrimination Prohibited Under the INA

  • Demanding more paperwork than the I-9 calls for
  • Insisting on a specific document, such as a green card or passport, when other valid documents would work
  • Rejecting documents that reasonably appear real and relate to the person presenting them

These become unlawful when tied to citizenship status, immigration status, or national origin.10United States Department of Justice. About the Immigrant and Employee Rights Section If you show up with a valid passport or a voter registration card and Social Security card, and the employer still insists on seeing a renewed driver’s license, that pattern is the problem. You choose the documents. The employer reviews what you present.

Practical Steps Before Your Start Date

  • Inventory what you have. An unexpired passport, passport card, military ID, voter registration card, Social Security card, or birth certificate may already give you a valid combination.
  • Start the renewal now. If you need to renew your driver’s license or replace a lost document, file the application immediately. Replacement state IDs typically take two to four weeks by mail, and many DMV offices issue same-day temporary documents.
  • Keep the receipt. If you applied to replace a lost, stolen, or damaged document, the application receipt is valid for I-9 purposes for 90 days.6U.S. Citizenship and Immigration Services. Form I-9 Acceptable Documents – Receipts
  • Give your employer a heads-up. Mentioning that you’ll be presenting alternative documents avoids confusion on day one. You don’t owe an explanation for why the license expired.

A Note on Reverification

Reverification is separate from getting hired. When an employee’s work authorization has an expiration date, the employer must reverify continued authorization using Supplement B of the Form I-9 (formerly Section 3), with a document from List A or List C.11U.S. Citizenship and Immigration Services. I-9, Employment Eligibility Verification This applies only to work authorization documents. An expired driver’s license or other identity-only document does not trigger reverification, because U.S. citizens and permanent residents have work authorization that does not expire with a state ID.
