Can I File Without My 1099? Records, Reporting, and Penalties

Yes, you can file taxes without a 1099. Federal law taxes the income, not the paperwork, so if a form never arrived you report what you earned from your own records and file on time. The company that paid you has its own filing duty with the IRS, but that duty is separate from yours, and its failure to send you a copy doesn’t excuse you from reporting or delay your return.

The Form Doesn’t Decide What You Owe

Gross income under the tax code is all income from whatever source derived, including compensation for services, business income, interest, rents, and royalties.1Office of the Law Revision Counsel. 26 USC 61 – Gross Income Defined A 1099 is an information return the payer sends to the IRS reporting what it paid you. It’s a copy of a filing, not the trigger for your tax liability.

The reporting threshold is also moving. For payments made after December 31, 2025, the threshold for issuing a Form 1099-NEC rises from $600 to $2,000.2Internal Revenue Service. Form 1099 NEC and Independent Contractors For the 2026 tax year, clients who paid you less than $2,000 aren’t required to send a 1099-NEC at all. That will leave more freelancers formless, and it changes nothing about what’s taxable. Self-employment tax kicks in once net earnings reach just $400.3Internal Revenue Service. Rebuild the Number From Your Own Records

Start with bank statements. Pull every statement for the tax year and flag each deposit tied to client payments, platform payouts, or other earned income. Match those deposits against invoices so every payment lines up with documented work. If you use bookkeeping software or a spreadsheet, reconcile those totals too. What you’re after is one figure: gross receipts, everything you brought in before deductions.

Federal law requires anyone who owes tax to keep records sufficient to establish gross income, deductions, and credits.4Office of the Law Revision Counsel. 26 USC 6001 – Notice or Regulations Requiring Records, Statements, and Special Returns For freelancers and contractors, deposit records, electronic payment notifications from platforms like PayPal or Venmo, and written agreements with clients all count. Don’t skip the small payments that fell below reporting thresholds. Those are the ones most likely to be missed when you lean on forms instead of your own tracking.

One line item worth checking as you reconstruct: if you never provided a Taxpayer Identification Number to a client, that client may have withheld 24% from your payments and sent it to the IRS as backup withholding.5Internal Revenue Service. Tax Withholding Types If a $1,000 invoice landed as a $760 deposit, the $240 difference likely went to the IRS on your account and you can claim it as a credit when you file.

Ask the Payer, Then Ask the IRS

Contact the payer first. A short email or call asking for a summary of total payments for the year usually produces the number, along with the payer’s Employer Identification Number if you need it for your records.6Internal Revenue Service. Am I Required to File a Form 1099 or Other Information Return? If the payer has gone quiet or out of business, the IRS itself holds a copy of what was filed under your Social Security number.

The IRS Wage and Income Transcript lists data from every information return filed under your SSN, including W-2s, 1099-NECs, 1099-MISCs, and other forms. It’s available for the current processing year and nine prior years.7Internal Revenue Service. Transcript Types for Individuals and Ways to Order Them The fastest access is through your Individual Online Account on irs.gov after identity verification; a mail request through the same site takes five to ten calendar days, and Form 4506-T is the paper alternative.8Internal Revenue Service. Timing matters. Data for the current tax year generally doesn’t appear on the transcript until the first week of February.7Internal Revenue Service. Transcript Types for Individuals and Ways to Order Them If you check earlier, you’ll see “No Record of Return Filed,” which just means the data hasn’t loaded yet. Pulling the transcript before you file also shows you exactly what the IRS will match your return against.

How to Report the Income Without the Form

Freelance, independent contracting, and other side-business income goes on Schedule C (Profit or Loss From Business), which flows into Form 1040.9Internal Revenue Service. 2025 Instructions for Schedule C (Form 1040) – Profit or Loss From Business Enter your total gross receipts on Line 1. You don’t attach copies of any 1099s. Tax software walks you through this by asking for the amounts directly, and it doesn’t require you to enter a form that doesn’t exist.

Self-employment tax on net earnings of $400 or more goes on Schedule SE, which attaches to the 1040.3Internal Revenue Service. Self-Employment Tax (Social Security and Medicare Taxes) E-filing sends the return straight to the IRS and typically produces an acknowledgment within 24 to 48 hours. That acknowledgment means the return is in the system, not that the numbers have been accepted; the matching against third-party filings happens later.

When You’re Out of Time But Still Missing Data

If the April deadline is close and you’re still reconstructing, Form 4868 gives you an automatic six-month extension to file. The trap is that the extension covers filing, not paying.10Internal Revenue Service. IRS: Need More Time to File, Request an Extension You still owe your best estimate of the year’s tax by the original April date, and interest and late-payment penalties accrue on any unpaid balance from that date forward.

When you estimate, round up. Overpaying with the extension is refunded when you file the complete return; underpaying invites penalties on top of whatever’s still due.

If the Numbers Don’t Match Later

If you report less income than what payers reported to the IRS, expect a CP2000 notice. It isn’t an audit or a bill. It’s a letter explaining that the income on your return doesn’t match third-party records, identifying the specific payer and amount, and proposing an adjustment.11Internal Revenue Service. Understanding Your CP2000 Series Notice

If the proposed change is right, you don’t amend. The IRS makes the correction and sends a bill for the additional tax plus interest.12Taxpayer Advocate Service. Notice CP 2000 If it’s wrong, you respond with the bank statements and invoices that back your figure. Ignoring the notice doesn’t make it go away; the IRS assesses the proposed changes and bills you either way.

A late 1099 that arrives after you’ve filed is a different situation. If it shows income you didn’t report, or amounts that differ from your estimate, file Form 1040-X to correct the return. You can e-file a 1040-X for the current year and up to three prior years.13Internal Revenue Service. What to Do When a W-2 or Form 1099 Is Missing or Incorrect If the late form matches what you already reported, no amendment is needed.

What Underreporting Actually Costs

The accuracy-related penalty for a substantial understatement of income tax is 20% of the underpaid amount, with an understatement generally treated as substantial if it exceeds the greater of 10% of the correct tax or $5,000.14Office of the Law Revision Counsel. 26 USC 6662 – Imposition of Accuracy-Related Penalty on Underpayments Interest runs on any unpaid tax from the original due date until it’s paid off.

The way to stay clear of all of it is the same either way: report income from your own records, check the Wage and Income Transcript before filing so you know what the IRS sees, and keep the documentation for at least three years after you file. A missing 1099 is an administrative inconvenience. Unreported income is the expensive problem.
